    Challenges for a CBR framework for argumentation in open MAS

    [EN] Nowadays, Multi-Agent Systems (MAS) are broadening their applications to open environments, where heterogeneous agents could enter into the system, form agents’ organizations and interact. The high dynamism of open MAS gives rise to potential conflicts between agents and thus, to a need for a mechanism to reach agreements. Argumentation is a natural way of harmonizing conflicts of opinion that has been applied to many disciplines, such as Case-Based Reasoning (CBR) and MAS. Some approaches that apply CBR to manage argumentation in MAS have been proposed in the literature. These improve agents’ argumentation skills by allowing them to reason and learn from experiences. In this paper, we have reviewed these approaches and identified the current contributions of the CBR methodology in this area.     Integration and the Context of Law: Why the European Court of Justice is not a Political Actor

    What characterizes the EU today is that it is not only a multi-level governance system, but also a multi-context system. The making of Europe does not just take place on different levels within the European political framework, executed and fostered by different groups of actors or institutions. Rather, it also happens in different and distinguishable social contexts – distinct functional, historical, and local frameworks of reasoning and action – that political science alone cannot sufficiently analyze with conventional and generalizing models of explanation. The European law is such a context and it should be perceived as a self-contained sphere governed by a specific logic and rationality that constitute a self-generating impetus for integration. As a consequence, Europe’s legal sphere and the processes happening within its boundaries have to be carefully distinguished from politics. Following this line of argument, it will be shown that the perception of the European Court of Justice as an actor engaging in judicial politics or politically motivated expansionist lawmaking has to be rethought. Only by examining and analyzing the context of European law as an independent space of reasoning and action may the role of Europe’s high court in the process of integration be adequately captured.European Court of Justice; European law; integration theory

    The family of decision analysis techniques can be applied effectively to support practical negotiators in international settings. These techniques are most appropriate in support of the prenegotiation phase, when parties are diagnosing the situation, assessing their own plans and strategies, and evaluating likely reactions and outcomes. The paper identifies how these approaches have and can be used to assist negotiation practitioners, offer a rationale for the application of decision analytic approaches in terms of the particular analytical requirements of the prenegotiation period, suggests how these process-oriented tools can be integrated with substantive tools, and discusses ways in which these tools can be presented and delivered to practitioners in a practical and confidence-building manner

    The Art of Persuasion: International/Comparative Human Rights, The Supreme Court of Canada and the Reconstitution of the Canadian Security Certificate Regime

    In this dissertation, the author explores the jurisprudential foundations of the “relevant and persuasive” doctrine, which authorizes Canadian judges to rely on international and comparative human rights when interpreting the Charter of Rights and Freedoms. Viewed in its best light, this doctrine improves respect for human rights in two distinct ways: securing Canada’s compliance with its international human rights obligations and enhancing the responsiveness of state law to the global and multicultural context of Canadian society. However, actual jurisprudence suggests that the doctrine has helped undermine principles of respect for constitutional supremacy and respect for international law, in part because it does not contain clear, objective criteria governing what counts as a relevant and persuasive norm. In the absence of such criteria, “result-oriented” judges are free to instrumentally pick norms that help rationalize decisions made entirely on the basis of political and ideological factors. Some would go so far as to argue that the doctrine enables judges to use the rhetoric of human rights to constitutionally entrench relations of domination; there is some empirical evidence to support this claim. Given the increasingly global context of contemporary judicial decision-making, it is surprising that judges have not yet offered a convincing justification for the relevant and persuasive doctrine. This dissertation attempts to offer such a justification. Weaving together a wide range of legal and moral philosophy, argumentation theory and international law/international relations theory, the author hypothesizes that judicial decisions about the relevance and persuasiveness of international and comparative human rights follow the contours of rhetorical and dialogical processes distinctive to law. With a view to testing this hypothesis, he develops analytical frameworks that help observers rationally identify, construct and evaluate “persuasive” international and comparative human rights arguments. Using the court-led reconstitution of the Canadian security certificate regime as a case study, he then attempts to demonstrate how the relevant and persuasive doctrine operates, how it coheres with principles of respect for constitutional supremacy and international law, and how it can improve respect for human rights among a wide range of globally-situated discursive communities

    Hoy en dĂ­a los sistemas informĂĄticos complejos se pueden ven en tĂ©rminos de los servicios que ofrecen y las entidades que interactĂșan para proporcionar o consumir dichos servicios. Los sistemas multi-agente abiertos, donde los agentes pueden entrar o salir del sistema, interactuar y formar grupos (coaliciones de agentes u organizaciones) de forma dinĂĄmica para resolver problemas, han sido propuestos como una tecnologĂ­a adecuada para implementar este nuevo paradigma informĂĄtico. Sin embargo, el amplio dinamismo de estos sistemas requiere que los agentes tengan una forma de armonizar los conflictos que surgen cuando tienen que colaborar y coordinar sus actividades. En estas situaciones, los agentes necesitan un mecanismo para argumentar de forma eficiente (persuadir a otros agentes para que acepten sus puntos de vista, negociar los tĂ©rminos de un contrato, etc.) y poder llegar a acuerdos. La argumentaciĂłn es un medio natural y efectivo para abordar los conflictos y contradicciones del conocimiento. Participando en diĂĄlogos argumentativos, los agentes pueden llegar a acuerdos con otros agentes. En un sistema multi-agente abierto, los agentes pueden formar sociedades que los vinculan a travĂ©s de relaciones de dependencia. Estas relaciones pueden surgir de sus interacciones o estar predefinidas por el sistema. AdemĂĄs, los agentes pueden tener un conjunto de valores individuales o sociales, heredados de los grupos a los que pertenecen, que quieren promocionar. Las dependencias entre los agentes y los grupos a los que pertenecen y los valores individuales y sociales definen el contexto social del agente.
