It has environmental and cultural characteristics that differentiate it from other regions. Among them, โ€˜Minbuk Villageโ€™ built by the state can be said to be a representative place that shows the peculiarities of Cheorwon, the border region. Yugok-ri Village, located in Geunbuk-myeon, Cheorwon-gun, which this study intends to examine, is one of the Minbuk villages in Cheorwon and is a representative propaganda village. Minbuk Village is a special space constructed according to the national strategy and should be viewed as a special space that is distinct from the general rural village. Although it can be said to be the main potential resource of the DMZ, it has been neglected and, like general rural villages, the village is expected to disappear due to aging and population hollowing. This study focused on Minbuk Village, which is the main resource of the DMZ but is marginalized. In particular, the village of Tongilchon in Yugok-ri, located in Geunbuk-myeon, Cheorwon, which is in danger of extinction due to the lack of accessibility and aging, was selected as the target. Since Minbuk Village is a propaganda village built under the leadership of the state, it was judged that it would be distinguished from other regions by a sense of place. The purpose of this study is to examine the social and spatial characteristics of the space of Yugok-ri village, collect and classify local resources and the memories of residents, and interpret the spatiality of the current Yugok-ri village. The purpose of this study was to extract the village resource elements of the target site to which the concept of place memory was applied, and to interpret the spatiality of Minbuk Village in Yugok-ri through in-depth interviews with residents based on the resource elements. In this study, place memory was expanded to memory of everyday life, and it was viewed as the memory of everyday life left centered on place. First, in order to increase the effectiveness of place memory, the characteristic places in the village were listed through literature and field research, and interviews were conducted centered on these places. A total of 9 places in the village were classified, and based on this, 1:1 or 1:2 in-depth interviews were conducted. The spatiality of Yugok-ri village through the collected memories can be largely interpreted in three ways. First, as a space built only in physical form, it is a village that failed from the beginning and could not be called a village. Because it was a house with a strong exhibition character, only physical space was given, and there was only an elementary school nearby. Besides, the security was so tight that even going outside was not free. They broke through the great competition, but the reality was different. Moreover, Yugok-ri village has been thoroughly neglected after the death of President Park Chung-hee. Although 40 years have passed, it is still a painful and regrettable place for the residents. Second, it was built for military purposes, but as time went on, the military purpose disappeared, and it was gradually changing into an ordinary place. Yugok-ri Village is a village of unification with a clear military purpose built by the state. In the midst of this ideology and non-routine, the everyday concept of a house conflicted, and the village of Yugok-ri continued to change. Third, with the passage of time, the physical structure deteriorated, and the inhabitants were aging together. Minbuk Village is recognized for its conservation value as a heritage of the border region. However, Minbuk Village has been completely ignored by the state since its construction. Although it is true that villages belonging to the northern region of the Civil Control Line are subject to many regulations in terms of development and land use planning as a military border region, it is important to find directions through the history contained in the village and the memories of lesser-known residents. If further research is continued on the remaining Minbuk villages, it will be helpful in setting the direction of village planning for the coming unification era. However, there are limitations to the research in that it is difficult to verify the history of an in-depth interview centered on personal experiences and meanings such as life history.     There are some proposed formulas by ACI, PCA, CEB-FIP and B3 which can be used to analyze column shortening, and each model has difference in calculating inelastic shortening that has influence on differential shortening. This study performed a comparative analysis on parameter of each proposed formula for column shortening, and analyzed column shortening of two columns of 54-story C apartment in Haewoondae according to a proposed formula by each model. The analysis includes comparing the elasticity, creep, drying shrinkage shortening, the whole shortening, and differential shortening by each model with the column shortening analysis using the deterministic method, and the probabilistic method utilizing monte carlo simulation. And this study shows that the potential maximum shortening can be predicted using each formula by comparing shortening in each confidence interval with field measurement and probabilistic analysis. The results in this research are as follows. 1. As the result of comparing time-dependent creep rate and drying shrinkage rate with CEB-FIP, there was great difference on the day of completion 1000 days, between ACI and PCA, thus it was not appropriate to compare the influence of variable with probabilistic analysis, and it was also not appropriate to compare B3 model with variable of other models that had different formula of calculating creep shortening. Therefore, the researcher developed the method of analyzing probabilistic column shortening that is easy to compare the influence of variable with PCA model in previous studies. 2. As the result of deterministic analysis, it indicated that drying shrinkage shortening of PCA model were 1.6โˆผ1.7 times greater than that of ACI model. Subsequent to slab installation shortening by PCA model was 114 โˆผ116%, and the total shortening was 129โˆผ134%. 3. Differential shortening and the total shortening of PCA was 1.11โˆผ1.14 times and 1.15โˆผ1.27 times greater respectively as compared with ACI as the width of confidence interval was increased more subsequent to slab installation. 4. As the result of comparing field measurement with probabilistic analysis, the result by ACI model was closer to field measurement than the result by PCA. Furthermore, field measurement of ACI and PCA was between the mean value and the lowest value in 68.26% of confidence interval.     The prediction of Concrete Filled in steel Tube(CFT) column shortening, causing serviceability problem and additional stresses in horizontal structural members, is of fundamental importance. According to the available study and experimental data about the long term behavior of CFT columns, the creep and shrinkage of concrete in CFT columns are smaller than those of RC columns because of the confinement effect of outer steel columns. Specifically, it examines how The Chukan Digest and The Farmersโ€™ Weekly put out by the Department of Public Information (DPI, USAMGIK), as well as The World News, put out by the United States Army Force in Koreaโ€™s Office of Civil Information (OCI, USAFIK), served as propaganda on US policy toward Korea and the question of establishing a state in Korea, and traces this propaganda discourse. Previous research on US public information policies and campaigns during the period of occupation have focused on how the USโ€™s public information policy towards Korea changed to closely reflect US policy towards Korea, and revealed how the public information agencies and campaigns on the ground in Korea during the time of US military occupation were affected by these changes. Because early in its occupation of Korea the USโ€™s public information policy toward Korea adhered to comprehensive guidelines, the activities of USAMGIKโ€™s Department of Public Information were more directly linked to South Koreaโ€™s political, social, and economic circumstances and the public opinion of Koreans than to promoting US policy toward Korea. However, when the US decided to withdraw from collaborations with the Soviet Union and to take Korean question into its own hands, the Office of Civil Information was established as part of the United States Army Force in Korea. The Office of Civil Information carried out propaganda regarding the USโ€™s policy toward Korea and the US itself. Based on previous literature that has shown that changes in the USโ€™s policy towards Korea swayed MGโ€™s public information policies, as well as public information agencies and their pursuits, this dissertation traces the messages that were published in official MG media, that is, the changes in propaganda discourse. By examining how the newspapers published by the occupation authority throughout the period of US occupation of Korea mediated Washingtonโ€™s policies and the reality in South Korea and propagandized US policy toward Korea, we can better understand the process of how the US reshaped public opinion in Korean society, which in the wake of liberation from Japanese imperialism desired to eradicate colonial vestiges and establish a new and autonomous country, into a mentality of cold war logic. As a process of discerning how Koreans went from believing that post-colonial reforms and establishing a unified Korean state to be the first step following independence to three years later believing that it was possible to realize the establishment of an independent government under the US-Soviet Cold War order, this is significant in that it illustrates the process by which the โ€˜Cold Warโ€™ and โ€˜cold war mentalityโ€™ were formed. This dissertation is largely divided into two sections. The first chapter reviews the nature of the public information agencies and the media they put out, while chapters two and three analyze the messages that appeared in these papers, as well as their propaganda discourse. Chapter one reveals how, following changes to US policy toward Korea, MGโ€™s public information agency was split into two separate agencies, the Department of Public Information and the Office of Civil Information, on May 30, 1947. Moreover, it covers how though from the start of US troops being stationed in Korea in September 1945, those who lead public information activities for MG were career soldiers with no knowledge of the fields of public relations or propaganda, once the Office of Civil Information was established, propaganda specialists from the Office of War Information began to lead the public information activities of MG, following the policy guidelines of the US State Department and the Department of War. Along with my analysis of the public information agencies and actors, in the first chapter of this dissertation I look at three newspapers that were published by these agencies: The Chukan Digest, The Farmersโ€™ Weekly, and The World News. By analyzing the publication objectives, audience, page layout, quantity published, distribution range, as well as subjects of articles in each of the three papers, I shed light on the MGโ€™s objectives for publishing these papers and explicate the nature of the media. According to my analysis, by keenly countering the tone of Korean newspapers and actively promoting a logic that challenged criticism of the MG, The Chukan Digest played the role of safeguarding urban readersโ€”particular readers in Seoulโ€”from the discourses that appeared in privately managed newspapers. The Farmersโ€™ Weekly, a newspaper published in Hangeul and distributed in rural areas, communicated MGโ€™s positions on pressing issues to every last farmer, promoting awareness in rural communities. Whereas the nature of the Department of Public Informationโ€™s The Chukan Digest and The Farmersโ€™ Weekly was that of conveying US policy on Korea, MGโ€™s positions on pressing issues to the Korean people, and challenging the discourse critical of MG, the paper put out by the Office of Civil Information, The World News, propagandized the international confrontation between democracy and communism, and the positive role of the US, thus encouraging Korean readers to interpret Koreaโ€™s problems in this framework established by the OCI. Chapter two examines the propaganda messages and propaganda discourse in the weekly newspapers put out by the DPI, The Chukan Digest and The Farmersโ€™ Weekly. In doing so, it reveals that between liberation from Japan in 1945 and late 1946, MG exhibited a vast discrepancy with US State Department policy and focused primarily on promoting their occupational rule. The Moscow Conference held in December 1945 agreed on the establishment of a provisional Korean government, and that a four-state (US, UK, China, USSR) trusteeship of up to five years would be necessary. Rather than immediately reporting this decision in Korea, MG, which had already been picking up on Koreansโ€™ desire for independence, was more concerned with what effect this news might have on the state of affairs in South Korea, as well as what effect it would have on its own position in Korea. Accordingly, reports from MG on US policy toward Korea focused on the problem which Koreans felt most sensitive about, that is, the problem of whether there should be a trusteeship present or not, rather than explaining the steps and procedures for setting up a united government of their own. Moreover, in June of 1946, directly following the breakdown of the 1st US-Soviet Joint Commission, the US established new policies towards Korea centered on social reform within South Korea, and though they instructed MG to enact and promote this, MG expressed their skepticism on this and instead bolstered their counterpropaganda against the political left. Unable to win the support of the Korean people on their occupation policy alone, MG responded by warding off criticism of the MG. In particular, though the Daegu October Incident of 1946 arose as a result of complex interplay between MGโ€™s stance that it was unable to follow US policy for social reform in South Korea, new tactics by the Communist Party of Korea, and the fury of the South Korean masses due to the MGโ€™s policy failures, MG linked all the press that criticized them as being connected to leftists, North Korea, or the Soviets, or formed a propaganda discourse that considered those who criticized them as having been deceived by pernicious propaganda. Chapter three analyzes the propaganda messages and propaganda discourse of The World News, a weekly paper published by the OCI. Because while The World News was in circulation The Chukan Digest was discontinued and The Farmersโ€™ Weekly had started to be published biweekly, I examine The Farmersโ€™ Weekly in addition to The World News. As the Korean question passed into the hands of the UN, The World New propagandized the Korean question in the context of the global Cold War. But public opinion surveys from the time show that Koreans were most concerned about the division of Korea. Accordingly, when in February of 1948 the Little Assembly decided to hold an election for a constitutional assembly in only the southern half of Korea, the Office of Civil Information stressed that even if there were to a be an election held only in South Korea, that this was the first step toward a unified Korean government. That is, the OCI publicized the upcoming election as being part of the process to establish a democratic and unified Korean government. However, when the North-South Conference of April 1948 made the public looked forward to the possibility of establishing a unified government, the justification for the election changed into being for the sake of establishing a democratic state so that the Soviet Union could not set up a puppet state government in Korea. In addition, those who supported the North-South Conference and opposed the election were designated as being traitors who supported the establishment of a Soviet Union satellite state. That is, the democracy advocated for by the MG ahead of the May 10th election in 1948 in fact referred to representative democracy and anti-communism. Directly following liberation from Japan, democracy was used to signify a system oriented towards the establishment of a post-colonial, autonomous, and independent Korean state, not a choice between Soviet style democracy or US style democracy. However, during MG occupation, the essence of democracy amounted to nothing more than representative democracy and anti-communism. Through an analysis of the media put out by MG during its occupation, this dissertation sheds light on the process by which the project of establishing a post-colonial and autonomous independent state directly following liberation from imperialism shifted into one of representative democracy and anti-communism, and characterizes this as the โ€˜cold war mentalityโ€™ promoted by MG.     A Study on Conduct Barring Limitation of Shipowner's Liability

    Considering that shipping industries activate international trade among nations and contribute to the economies of those nations, with regard to public interest, it is necessary to establish institutional strategies for shipping industries. A shipownerโ€™s limitation of liability entails that the shipowner can limit his liability in certain circumstances when loss or damage has been caused to the property of others carried on his vessel during its voyage. However, in cases where the right to limitation is denied, if the standard of determination is obscure and unclear, a legal dispute often occurs and the shipownerโ€™s or the claimantโ€™s rights to a fair result can be compromised, which goes against the legislative purpose of the act on the limitation of liability. Therefore, due to the nature of maritime incidents in which foreign legal relationships are frequently involved, it is necessary to establish a uniform standard regarding conduct that bars the limitation of a shipownerโ€™s liability. The Korean Commercial Code also confirms the right on the shipowner to limit his liability. However, the application of this Code should be discussed in conjunction with the provisory clause, which sets forth conduct barring limitation under certain circumstances. Thus, despite an effective claim under the limitation regime, when the shipowner indulges in illegal behavior leading to such liabilities, the right to any limitation may be denied. This thesis would analyze the shipownerโ€™s limitation of liability and its conduct barring limitation from the perspective of the shipownerโ€™s willful misconduct or other reckless acts or omissions while duly recognizing the concern about the incurrence of such damage, by referencing cases based on the regime in each country. In addition, the question of who has the onus of providing proof, which is not specified in the Code, will be discussed. This thesis would analyze international conventions such as the ใ€ŒInternational Convention relating to the Limitation of the Liability of Owners of Sea-going ships, 1957ใ€and the ใ€ŒConvention on Limitation of Liability for Maritime Claims, 1976ใ€ and then, the regime of the shipownerโ€™s limitation of liability in each country such as the UK, the US, and Japan.
