    EVIDENCE-EFFECT OF PRESUMPTION AGAINST SUICIDE

    Get PDF
Asserting that the deceased met his death by accidental drowning, appellant sued as beneficiary to recover under a double indemnity clause of an insurance policy issued to the deceased by the defendant. The defense was that the deceased committed suicide and that a clause in the policy prevents recovery of double liability under such circumstances. The jury found for the defendant and, on appeal, the beneficiary contended that the trial judge committed prejudicial error against her by refusing to instruct the jury that there was a strong presumption against suicide and in favor of accidental death. Held, the code provides that the presumption against suicide should be considered by the jury when determining its final verdict, and failure to so instruct the jury constituted reversible error. New trial ordered. Three judges dissented. Wycoff v. Mutual Life Insurance Co. of New York, (Oregon 1944) 144 P. (2d) 227

precipitation change in southern italy linked to global scale oscillation indexes

Abstract. This study investigates precipitation variability in five regions of Southern Italy (Campania, Apulia, Basilicata, Calabria and Sicily) using a homogeneous database of about 70 rain gauges with more than 50 years of observation. First, a statistical analysis was performed through the Mann-Kendall non-parametric test in order to determine rainfall the trend on both yearly and seasonal scales. Then, the relationship between the rainfall and some teleconnection pattern indexes was investigated using Spearman's test. The results show remarkable statistically significant negative trends for annual and winter aggregations in most part of the series. Moreover, a strong correlation has emerged between the teleconnection patterns and precipitation in Southern Italy, particularly in winter and on the Tyrrhenian side of the study area

    Mottling in the Meagher Limestone

    Get PDF
The middle Cambrian Meagher limestone of southwest Montana is characterized by mottled members that are finely crystalline in the tan part and microcrystalline in the dark matrix. As seen in the literature, similar mottled limestones are thought to be an arrested stage in the dolomitization, or alteration of limestones
