A RETÓRICA DO ARGUMENTO DA OBJETIVIDADE DECISÓRIA NO STF NAS ADPF’S 701, 810 E 811

Abstract

Abstract It deals with the rhetorical analysis of arguments in the legal decision-making process. Research problem: what are the persuasive limitations of the decision-making objectivity argument in the STF? General objective: to deconstruct the argumentative chains that justified the judicial decisions in ADPF\u27s 701, 810 and 811 in order to describe the strategic mechanisms of concealment of the limitations of control of the judging subjectivity proposed both by the legal doctrine and by the current legislation. Specific objectives: compare the votes (winner and loser) and describe how one of them achieved greater degrees of effectiveness and legitimacy. Methodological approach: destructuring methodical. Research technique: bibliographic. Presentation of results: quali-quantitative. Result: The discursive mechanisms of concealment of judging subjectivity do not go unnoticed by the de-structuring method, however, they have significant practical effects when they are part of a strategically more effective discourse.. Problema de pesquisa: quais são as limitações persuasivas do argumento da objetividade decisória no STF? Objetivo geral: desconstruir as cadeias argumentativas que justificaram as decisões judiciais nas ADPF’s 701, 810 e 811 a fim de descrever os mecanismos estratégicos de ocultação das limitações de controle da subjetividade judicante proposta tanto pela doutrina jurídica, quanto pela legislação vigente. Objetivos específicos: contrapor os votos (vencedor e vencido) e descrever como um deles angariou maiores graus de eficácia e legitimidade. Abordagem metodológica: metódica desestruturante. Técnica de pesquisa: bibliográfica. Apresentação dos resultados: quali-quantitativa. Resultado:  Os mecanismos discursivos de ocultação da subjetividade judicante não passam despercebidos à metódica desestruturante, contudo, surtem efeitos práticos significativos quando fazem parte de um discurso estrategicamente mais eficaz.
