Learning to think as a researcher-teacher-historian through local heritage. An experience in the Bachelor’s Degree in Primary Education

Aquest article analitza una experiència docent innovadora realitzada amb els estudiants del grau en educació primària de la Universitat de Lleida, centrada en l’àrea de coneixement del medi natural, social i cultural, i basada en les directrius del Decret 175/2022, sobre el currículum de primària. Les noves orientacions educatives exigeixen que els mestres superin la reproducció de coneixements i ensenyin a pensar històricament, qüestionant les narratives establertes, utilitzant fonts locals i situant nous protagonistes al centre del relat. No obstant això, es detecta una carència en la formació de competències investigadores entre els futurs mestres. Per abordar aquesta mancança, s’ha dut a terme una experiència educativa amb un objectiu doble. D’una banda, fer conscients els futurs mestres de la importància d’aprendre històricament per comprendre contextos actuals. D’altra banda, formar docents que apliquin a la seva pràctica professional la metodologia de l’historiador, fomentant la reflexió crítica i la consciència ciutadana. Aquesta iniciativa no només cobreix la formació en competències investigadores, sinó que també fomenta una reflexió crítica sobre el paper de l’alfabetització històrica en l’educació, promovent la creació de noves narratives històriques i contribuint a la formació d’una ciutadania compromesa i crítica.This article analyzes an innovative teaching experience carried out with the students of Bachelor’s Degree in Primary Education at the University of Lleida, focused on the Natural, Social and Cultural Environment Knowledge Area in accordance with the guidelines of Decree 175/2022 on the primary school syllabus. The new educational orientations demand that teachers should go beyond the reproduction of knowledge and teach pupils to think historically, questioning established narratives, using local sources and placing new protagonists at the center of the narrative. However, a deficiency is detected in the training of research skills among future teachers. To address this deficiency, an educational experience has been carried out with a twofold objective. On the one hand, future teachers should be aware of the importance of learning historically in order to understand current contexts. On the other hand, teachers should be trained to apply the historian’s methodology to their professional practice, encouraging critical reflection and civic awareness. This initiative not only ensures training in research skills, but also encourages critical reflection on the role of historical literacy in education, promoting the creation of new historical narratives while contributing to the formation of committed critical citizens

Las medidas civiles de protección de hijos e hijas de mujeres víctimas de violencia machista

La reforma del Codi civil de Catalunya del 2021 ha reduït el catàleg de mesures que es poden adoptar en relació amb els fills i filles de dones víctimes de violència masclista. La prohibició de la guarda compartida en aquests casos no és una novetat, però sí que ho és la introducció del criteri, amb caràcter general, de la no atribució d’un règim d’estades, comunicació i relació entre els menors i el progenitor maltractador de la mare, que només es podrà acordar de manera excepcional. Aquest treball examina el recorregut normatiu de les mesures civils en relació amb els menors quan hi ha violència masclista contra la seva mare, i la seva aplicació pels tribunals. Finalment, s’analitza la Sentència del Tribunal Constitucional (STC) 106/2022, ja que, encara que afecta el dret espanyol, i no el català, posa de manifest que la interpretació de les normes pot desfer els esforços legislatius tendents a protegir els menors quan hi ha violència masclista contra la mare.The 2021 reform of the Catalan Civil Code has reduced the catalog of measures that can be adopted in relation to the children of victims of gender violence. The prohibition of shared custody in these cases is not a novelty; the novelty lies in the introduction of a general rule that prevents contact between the children and the father who commits gender-based violence against their mother; contact will only be possible in exceptional cases. This paper examines the regulatory pathway of civil measures in relation to minors when there is gender-based violence against their mother, and their application by the courts. Finally, the judgement by the Spanish Constitutional Court 106/2022 will be analyzed because, even though it affects Spanish law and not Catalan law, it shows that the way certain provisions are interpreted may undo all legislative efforts aimed at the protection of minors in the field of gender-based violence against their mother.La reforma del Código civil de Cataluña de 2021 ha reducido el catálogo de medidas que se pueden adoptar en relación con los hijos e hijas de mujeres víctimas de violencia machista. La prohibición de la guarda compartida en estos casos no es una novedad, pero sí lo es la introducción del criterio, con carácter general, de no atribución de un régimen de estancias, comunicación y relación entre los menores y el progenitor maltratador de la madre, que solo se podrá acordar de manera excepcional. Este trabajo examina el recorrido normativo de las medidas civiles en relación con los menores cuando hay violencia machista contra su madre, y su aplicación por los tribunales. Finalmente, se analiza la STC 106/2022, ya que, aunque afecta al derecho español, y no al catalán, pone de manifiesto que la interpretación de las normas puede deshacer los esfuerzos legislativos tendentes a la protección de los menores cuando hay violencia machista contra la madre
