    Revisiting Maine’s lobster commons: rescaling political subjects

    Calls for cross-scalar theoretical and methodological approaches are not new to commons scholarship. Such efforts might be hastened by channelling poststructuralist and critical theory perspectives through the geographic subfield of political ecology, including attention to political scales and subjects. Toward this end, this paper reconsiders Maine’s lobster fishery. This case has provided rich material for watershed commons scholarship, demonstrating the ability of social groups to conserve resources independent of government or markets, and it continues to offer new findings. Recent fieldwork shows that as lobster boat captains advance collective interests through state-supported co-management governance arrangements, concerns of crew and non-fishing community members may be marginalized. Regulatory exclusion prevents broader distribution of resource benefits at a time when employment alternatives are scarce. More pluralistic approaches to commons theory and its policy application have utility well beyond the lobster case

    Apprenticeship and Conservation Incentives

    Apprentice programs offer a method to encourage responsible individual behavior by laying the foundation for successful collective property rights. Apprenticeship has three purposes: to restrict the rate of entry, to affect the quality of the participant, and to create the conditions for collective action for sustainability. Apprenticeship could be an important fishery management tool, particularly in decentralized, adaptive management regimes that require ongoing, multi-party negotiation for success. It is not vocational training; instead it serves a public purpose: to create the conditions for stewardship and participation in management. This perception of collective property right mimics customary practice in some successful traditional fisheries such as the Maine lobster fishery where customary practice has been demonstrated both to have conservation benefits and to lower enforcement costs. Case information from Maine’s new, statutory lobster apprentice program is discussed. Apprenticeship creates conditions for responsible behavior by creating a stable population that can develop long term assurances about expected behavior and can develop credible internal monitoring and sanctions. In addition to requiring a personal investment of time, it provides information about fishing ethics and non-fishing information about basic biology, ecology, and participation in the management system. This, because it changes the frame of reference, should affect individual behavior both fishing and as participants in management. Apprenticeship focuses on the individual fishing as the principal actor in conservation.     Catch-per-unit-effort and biological parameters from the Massachusetts coastal lobster (Homarus americanus) resource: Description and trends

    Acomprehensive description of the Massachusetts coastal lobster (Homarus americanus) resou,rce was obtained by sampling commercial catches coastwide at sea and at dealerships between 1981 and 1986. Acommercial lobster sea-sampling program, wherein six coastal regions were sampled monthly, with an areal and temporal data weighting design, was the primary source of data. An improved index of catch per trap haul/set-over-day was generated by modeling the relationship between catch and immersion time and standardizing effort. This 6-year time-series of mean annual catch rates tracked closely the landings trend for territorial waters. During the study period there was a gradual increase in indices of exploitation and total annual mortality which corresponded to a gradual decline in mean carapace length of marketable lobster. The frequency of culls escalated from 10.0% in 1981 to 20.9% in 1986, while the percentage of lobster found dead in traps was consistently less than 1%. The sex ratio (%F:%M) was significantly different from 50:50 and approximated a 60:40 relationship during the study period. Male and female weight-length relationships were significantly different. Females weighed more than males at smaller sizes and less than males at larger sizes. A north-south clinal trend was evident wherein lobster north of Cape Cod weighed less at length than those from regions south of Cape Cod. Functional size-maturity relationships were developed for female lobster by staging cement gland development. Proportions mature at size represent more realistic values than those obtained by analyses of percent of females ovigerous. Regional variation occurred in most of the parameters studied.     Polycentrism and Flux in Spatialized Management: Evidence from Maine\u27s Lobster (Homarus americanus) Fishery

    Spatial approaches to fisheries management hold great promise but require continued conceptual and policy development. Polycentrism and flux emerge as useful concepts, drawing lessons from more customary, informal resourceuse patterns to produce more innovative “spatialized” policies within existing governance architectures. Empirical evidence from Maine shows that pioneering efforts have been limited by the single-species focus of conventional management hierarchies. As entry limits have consolidated the fishing fleet and eliminated flexible, diversified, and adaptive business strategies, cross-species and habitat externalities have become problematic. State lobster (Homarus americanus Milne- Edwards, 1837) comanagement zones have achieved some successes, including trap limits and improved industry-management communications, but incur significant transaction costs and raise equity and stewardship concerns. Kindred proposals for spatial refinement of groundfish management and locally based area-management councils lack support from the state Department of Marine Resources, Atlantic States Marine Fisheries Commission, New England Fishery Management Council, and National Marine Fisheries Service. Broader and more transparent deliberation of explicitly spatial and ecosystem approaches might be advanced by citizen panels convened to foster polycentric decision structures and accommodate more integrative management strategies

    Why Coastal Maine Needs a Wrap Around Drug Court

    Opioid use and abuse is a national crisis that has taken its toll on small Maine communities. Among those hardest hit, are the small coastal communities that are the heart of Maines lobster and fishing industries. These areas are remote, and do not have the resources to deal with the opioid crisis as it continues to grow, which could have detrimental effects on an industry that makes up a large part of Maine’s economy. Further, while many lobstermen and fishermen suffer from opioid addiction, very few seek help or treatment for the disease. This comment suggests that the Maine judicial system can help ease the burden of the opioid crisis on these small communities through wrap-around drug courts that would comprehensively address all of the factors that lead to drug use and addiction. This comment concludes that a wrap-around drug court is the best way to address the opioid problem in lobstering communities for the following reasons: first, drug addiction increases the likelihood that someone will commit a crime and therefore come into contact with the court system; second, lobstering communities are remote, and access to treatment centers are limited; third, because of lobstering culture, it is unlikely that a lobsterman suffering from opioid addiction will seek treatment or help; and lastly there is support from the judiciary to implement wrap-around drug courts in secluded and hard hit areas of Maine

This document includes all material available through the website on June 2, 2023, regarding the September 2021 lawsuit filed by the Maine Lobstermen\u27s Association (MLA) challenging the 10-year whale plan. The primary argument of the lobster fishers is that federal regulations are not science-based and will terminate a traditional lifeway and natural resource industry disproportionately impacting self-employed, white residents of Maine\u27s coastal regions.
