    The Doctrine In The Shadows: Reverse-Erie, Its Cases, Its Theories, And Its Future With Plausibility Pleading In Alaska

    In 2007 and 2009, respectively, the United States Supreme Court decided Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal, abrogated Conley v. Gibson’s notice pleading standard, and imposed a new plausibility pleading standard upon the federal court system. Alaska, along with a majority of states however, still retains Conley’s “no set of facts” notice pleading standard. This Note asks, in light of the difference between the federal and Alaska pleading standards, whether Alaska—or any state—could be forced to apply the federal pleading standard when it adjudicates federal substantive claims. Prior to Iqbal, a plaintiff in Alaska would have faced the same pleading obligations in state and federal court regardless of whether he pleaded a state or federal claim. As this Note describes, now, a plaintiff could face different pleading standards depending on not only where he brings his claim, but also, if he’s in state court, whether he brings a state or federal claim. The reason for this is the Reverse-Erie doctrine: an little-developed judicial choice of law theory that broadly asks which procedure, federal or state, applies in a state court proceeding. Using the differences between federal and state pleading standards as an opportunity to flesh out Reverse-Erie, this Note concludes that while it is unlikely that the Supreme Court would force a state to adopt the federal pleading standard, the jurisprudential framework for such a move exists

    Static coefficient test method and apparatus

    The static coefficient of friction between contacting surfaces of a plurality of bodies is determined by applying a load to the bodies in a direction normal to the contacting surfaces. Opposite ends of a flexible filament are connected to a load cell and the first of the bodies. A motor continuously moves the second of the bodies away from the load cell at constant velocity at right angles to the force of the normal load so that the first body moves intermittently relative to the second body across a contact surface between them. The load on the surfaces, the nature of the surfaces, and the speed of the first body relative to the load cell are such that the filament is alternately and cyclically tensioned and relaxed as the movement occurs. The maximum tension occurs at the incipient stages of movement of the first body relative to the second body. The load cell derives a series of measurements which are coupled to an x-y recorder, from which the maximum forces of the filament are determined to enable the static coefficient of friction to be determined. From the maximum forces and the normal force, the coefficient is determined. For determining coefficients of friction where there are large compression loads, the normal load is applied with a calibrated compression spring that is deflected by a predetermined amount determined by a spring load vs. deflection calibration curve

    Investigation of electrical noise in selenium-immersed thermistor bolometers

    The selenium immersed, thermistor bolometer, IR detector failed due to spurious and escalating electrical noise outburst as a function of time at elevated temperatures during routine ground based testing in a space simulated environment. Spectrographic analysis of failed bolometers revealed selenium pure zones in the insulating selenium arsenic (Se-As) glass film which surrounds the active sintered Mn, Ni, Co oxide flake. The selenium pure film was identified as a potentially serious failure mechanism. Significant changes were instituted in the manufacturing techniques along with more stringent process controls which eliminated the selenium pure film and successfully produced 22study bolometers

    Incubator-Induced Business Clusters: A Case Study

    Incubator-induced business clusters are a new tool for governments wishing to economically revitalize geographic areas. However, this case study argues that the successful formation of a cluster through the use of a business incubator requires the presence of three important “cluster factors”: 1) resource dependence and integration of the four key players of a cluster 2) human capital aspects and 3) external intervention mechanisms aimed toward the creation of a cluster. The historical founding of Hollywood will be examined for these factors as well as the DUMBO incubator located in NYC. This case study will examine whether the situation in DUMBO will lend itself toward the successful formation of a technology cluster in that area
