Aspek Hukum Perjanjian Kredit dengan Agunan Kapal

This studyhas the objective toanalyze the data and information regarding the arrangement of credit agreement with collateral vessels in Indonesia. This research is a normative juridical that focus on the legal norms in force which are both contained in the legislation and literature. The method of data analysis was applied by using the model or method qualitative text analysis of the legislation and expert opinions relating to thelegal aspects ofthe loan agreement with collateral vessels. The results showed that, the vessel is possible as collateral in a bank credit agreement. Normatively, there are two ways to do binding guarantee with a form of collateral vessels. The first is the size of mortgagesto 20 m3 vessel with gross tonnage or more, the second is the fiduciary for vessels of under 20 m3 gross tonnage. Peran Negara dalam Penyelesaian Konflik Agraria (Studi Kasus Kampung Tua/Nelayan di Atas Hak Pengelolaan Badan Pengusahaan Batam)

Indonesian Constitution contained in the 1945 Constitution mandates that the Earth, Water, and Natural Wealth contained in it controlled the state and used for the greatest prosperity of the people. In the field, the mandate has not gone properly. For example in the city of Batam, agrarian conflicts, especially on land and land in Kampung Tua / Nelayan become one of the main problems. This study aim to analyze the role of the state in the settlement of agrarian conflicts (Case Study of Kampung Tua/Fisherman on Right of Management of Badan Pengusahaan Batam). The method used in this paper is the empirical juridical approach method. This legal research uses data from literature and interviews the community. The result show that various state institutions have sought with various meetings and activities to resolve agrarian conflicts, but up to now have not been able to solve the problem completely. Keywords: Agrarian Conflict, Kampung Tua/Nelayan, Right of Management.   Konstitusi Indonesia yang termuat dalam UUD 1945 mengamanatkan agar Bumi, Air, dan Kekayaan Alam yang terkandung di dalamnya dikuasai negara dan dipergunakan bagi sebesar-besar kemakmuran rakyat. Di lapangan, amanat tersebut belum berjalan sebagaimana mestinya. Misalnya di Kota Batam, konflik agraria khususnya atas tanah dan lahan di Kampung Tua/Nelayan menjadi salah satu permasalahan utama. Penelitian ini bertujuan untuk menganalisis peran negara dalam penyelesaian konflik agraria (Studi Kasus Kampung Tua/Nelayan di Atas Hak Pengelolaan Badan Pengusahaan Batam). Metode yang digunakan dalam penulisan ini adalah metode pendekatan yuridis empiris. Penelitian hukum ini menggunakan data dari bahan pustaka dan wawancara dengan masyarakat. Hasil penelitian menunjukkan bahwa berbagai institusi negara telah berupaya dengan berbagai pertemuan dan kegiatan untuk menyelesaikan konflik agraria, akan tetapi sampai dengan sekarang belum bisa menyelesaikan permasalahan secara tuntas. Pengawasan Kepala Desa terhadap Kinerja Rt 06/rw 03 Desa Rambah Jaya Kecamatan Bangun Purba Kabupaten Rokan Hulu Tahun 2015-2016

The Rokan Hulu District Government seeks to recreate a participatory RT and RW organization that is mobilized by the community itself. With this regional regulation, the Rokan Hulu government tries to create democracy in the smallest scope of neighborhoods of RT and RW while providing legitimacy to the elected head of RT and RW. This research intends to examine the issues of Performance RT 06 / RW 03 Desa Rambah Jaya from the point of view, the implementation of supervision and evaluation.This study aims to determine the implementation of Village Head supervision on the performance of RT 06 / RW 03 Village Rambah Jaya District Bangun Purba Rokan Hulu District. In addition, this study aims to determine the factors that affect the implementation of supervision of Village Head on Performance RT 06 / RW 03 Village Rambah Jaya District Bangun Purba Rokan Hulu District. This research uses the supervision theory by Dharma Setiawan Salam. The type of research used is descriptive research with qualitative approach. Methods of data collection is done by interview, observation and documentation.The results of this study showed that the Head of Rambah Jaya Village conducted Intensive Communication, Head of Rambah Jaya Village conducted supervision in the form of accountability and Head of Rambah Jaya Village conducted supervision in Democratic Participatory Creation and Head of Rambah Jaya Village to conduct transparency supervision. The factors influencing the implementation of Village Head supervision on the performance of RT 06 / RW 03 Rambah Jaya Village is the Resource Factor, the absence of regulations / regulation from the Village Government related to the Village Head's supervision on RT / RW Performance and Member Errors /deviations RT 06 / RW 03 requires supervision from Rambah Jaya Village Head

Eksistensi Delik Adat di Lingkungan Masyarakat Sentolo, Kabupaten Kulonprogo YOGYAKARTA

This research is empirical law research. The collecting data were analyzed by qualitative and presented descriptively. The research can be concluded as follows: reasons for maintaining delict adat law are religious environment, maintaining norms politeness, adat executed as long as no conflict with the written law and the protection of women. Types of sanction are warning in a visit at night, asked to leave the house for interrogation, community sanctions; the reasons of sanction are near the mosque, maintaining delict adat law, neglection of verbal warning, anticipation pregnant before marriage and aruh-aruh culture must be maintained. Jenis penelitian ini adalah yuridis empiris. Data yang terkumpul dianalisis secara kualitatif dan disajikan deskriptif. Kesimpulan riset adalah: Pertama, alasan mempertahankan hukum delik adat karena lingkungan riligius, menjaga norma kesopanan, adat dijalankan asalkan tidak berbenturan dengan peraturan tertulis dan perlindungan perempuan. Kedua, proses penerapan sanksi masyarakat adalah peringatan dalam bertamu di malam hari, diminta keluar rumah untuk diinterogasi, diberi sanksi yang ditentukan musyawarah masyarakat. Ketiga, alasan penjatuhan sanksi pengusiran adalah lingkungan dekat masjid, mempertahankan hukum delik adat, tidak mengindahkan peringatan, pencegahan hamil di luar nikah, perlunya budaya aruharuh (tegur sapa) harus dipertahankan

Perancangan Model Integrasi Manajemen Kebijakan Outsourcing Dalam Perspektif Hubungan Industrial

. This research objective is to design an outsourcing policy management integration model in industrial relation perspective in order to harmonize social, cultural, economic and legal aspects. The model is expected to improve welfare for workers, profit for industrial development, and provide benefit for the government.This research was initiated by field observation to analyze empirical condition on current outsourcing practices from the view of industries, government, and the workforce themselves along with their labor union. The result of problem identification was then analyzed to obtain outsourcing policy management integration model in order to build harmonious industrial relation. The method used was Soft System Methodology (SSM). Data were collected through FGD, IDI, and expert survey. Technique analysis was conducted through analysis CATWOE (Customer, Actor, Transformation, World-view, Owner, Environment constraint ), Analytical Network Process (ANP), Strategic Assumption Surfacing and Testing (SAST), through SSM Learning Models aiming to design Purposeful Activity Models (PAM). The Integration Management of Outsourcing Policy Model to perfom comprehensive management outsourcing system involving stakeholders in planning, supervision, guidance and enforcement to minimize conflict. Analisis Fungsi Pameran Arsip Sebagai Sarana Penyampaian Informasi Kepada Publik Oleh Badan Arsip Dan Perpustakaan Provinsi Jawa Tengah Pada Pameran Arsip Keliling II Di Kota Pekalongan

Penelitian ini berjudul “Analisis Fungsi Pameran Arsip Sebagai Sarana Penyampaian Informasi Kepada Publik di Badan Arsip dan Perpustakaan Provinsi Jawa Tengah”. Tujuan penelitian mengetahui Mengetahui Fungsi Pameran Arsip Sebagai Sarana Penyampaian Informasi Kepada Publik oleh Badan Arsip dan Perpustakaan Provinsi Jawa Tengah pada Pameran Arsip Keliling II di Kota Pekalongan. Metode penelitian yang digunakan menggunakan metode kualitatif dengan pendekatan deskriptif analistik. Penelitian ini dilakukan di Kota Pekalongan pada tanggal 16-22 April 2012. Informan dalam penelitian ini berjumlah 5 orang. Khasanah yang di pamerkan berupa naskah asli, foto-foto masa lalu, film dokumenter. Hasil akhir kesesuaian Pameran Arsip Keliling II dengan fungsinya sudah terlihat karena masyarakat dapat menerima informasi dengan baik berdasarkan data hasil wawancara dengan beberapa pengunjung pameran. Selain dapat menjalankan fungsinya Pameran Arsip Keliling II juga mampu menghadirkan pameran yang sesuai dengan tujuan diadakannya pameran arsip yaitu sudah mampu menghadirkan arsip asli milik lembaga kearsipan kota dan provinsi, sudah mampu meningkatkan ketertarikan masyarakat tentang arsip, sudah mampu meningkatkan kecintaan masyarakat terhadap kota mereka melalui pameran arsip, dan sudah mampu membantu mempromosikan layanan arsip dari Badan Arsip dan Perpustakaan Provinsi Jawa Tengah

Iktiofauna Di Perairan Sekitar Gunung Kabela Taman Nasional Bogani Nani Wartabone Sulawesi Utara (Ichthyofauna of Bogani Nani Wartabone National Park Waters North Sulawesi)

Penelitian mengenai ikan di perairan kawasan Taman Nasional Bogani Nani Wartabone telah dilakukan dengan mengambil lokasi di sekitar Gunung Kabela. Penelitian bertujuan untuk mengetahui keanekaragaman jenis ikan, kelimpahan, distribusi, potensi dan aspek terkait lainnya. Hasil penelitian tercatat 25 jenis dari 21 marga dan 14 suku. Gobiidae merupakan suku yang paling dominan dengan 9 jenis. Kelimpahan jenis bervariasi antara 1 sampai 33,75 ind./st.; Barbodes gonionotus merupakan jenis yang paling melimpah (33,75 ind/st), dan Sicyopterus longifilis merupakan jenis yang tersebar paling luas, faktor ekologi dan aspek terkait lainnya akan dibahas dalam makalah
