Position Paper on the Envisaged Reform of the German Patent Act
Das Max-Planck-Institut fĂŒr Innovation und Wettbewerb nimmt hiermit zum Diskussionsentwurf eines Zweiten Gesetzes zur Vereinfachung und Modernisierung des Patentrechts Stellung, der vom Bundesministerium der Justiz und fĂŒr Verbraucherschutz im Januar 2020 vorgelegt wurde. Das Institut begrĂŒĂt die Initiative des Ministeriums, empfiehlt im Hinblick auf die BeschrĂ€nkung des patentrechtlichen Unterlassungsanspruchs und die StĂ€rkung des Schutzes von GeschĂ€ftsgeheimnissen in Patentstreitsachen jedoch gewisse PrĂ€zisierungen. Mit Blick auf die BeschrĂ€nkung des Unterlassungsanspruchs nach MaĂgabe des Grundsatzes der VerhĂ€ltnismĂ€Ăigkeit wird vorgeschlagen, die VerhĂ€ltnismĂ€ĂigkeitspruÌfung nicht auf einen Anwendungsfall der Gebote von Treu und Glauben zu reduzieren, sondern im Sinne der ratio legis des Patentrechts zu verstehen; insoweit als MaĂnahme zur Verhinderung dysfunktionaler Effekte des AusschlieĂlichkeitsrecht bzw. des damit verbundenen Unterlassungsanspruchs. Zur Veranschaulichung des Ansatzes wird auf die Fallgruppen der komplexen Produkte, der Patentverwerter und der standardessenziellen Patente Bezug genommen, ohne sie jedoch im Detail durchzuprĂŒfen. Mit Blick auf die im Rahmen der VerhĂ€ltnismĂ€ĂigkeitsprĂŒfung vorzunehmende InteressenabwĂ€gung wird darauf hingewiesen, dass die Interessen des Patentinhabers gegenĂŒber jenen des Verletzers keinen grundsĂ€tzlichen Vorrang genieĂen. DarĂŒber hinaus sind bei der AbwĂ€gung nicht nur die Interessen der Streitparteien, sondern auch jene Dritter, insbesondere das öffentliche Interesse, zu berĂŒcksichtigen. Mit Blick auf den Schutz von GeschĂ€ftsgeheimnissen in Patentstreitsachen verweist die Stellungnahme auf UnzulĂ€nglichkeiten des Verfahrens in GeschĂ€ftsgeheimnisstreitsachen, die durch die angedachte Anwendung der entsprechenden Vorschriften auf das Patentstreitverfahren ĂŒbertragen werden. Hingewiesen wird auch auf eine mögliche RegelungslĂŒcke in Bezug auf das "DĂŒsseldorfer Verfahren", die von Patentinhabern fĂŒr sog. "fishing expeditions" ausgenutzt werden könnte
Artificial Intelligence and Intellectual Property Law - Position Statement of the Max Planck Institute for Innovation and Competition of 9 April 2021 on the Current Debate
This Position Statement presents a broad overview of issues arising at the intersection of AI and IP law based on the work of the Max Planck Institute for Innovation and Competition research group on Regulation of the Digital Economy. While the analysis is approached mainly from a perspective de lege lata, it also identifies questions which require further reflection de lege ferenda supported by in-depth interdisciplinary research. The scope is confined to substantive European IP law, in particular, as regards copyright, patents, designs, databases and trade secrets. Specific AI-related issues are mapped out around the core questions of IP law, namely, the eligibility for protection under the respective IP regimes, allocation of rights and the scope of protection. The structure of the analysis reflects three key components of AI: inputs required for the development of AI systems, AI as a process and the output of AI applications. Overall, it is emphasised that, while recent legal and policy discussions have mostly focused on AI-aided and AI-generated output, a more holistic view that accounts for the role of IP law across the AI innovation cycle is indispensable

The Revitalisation of the Object and Purpose of the TRIPS Agreement: The Plain Packaging Reports and the Awakening of the TRIPS Flexibility Clauses
The limited role the objectives and principles of the TRIPS Agreement (Articles 7 and 8) have played so far in the interpretation and implementation of its substantive provisions has often been criticised. The WTO Panel and Appellate Body Reports in the âAustralia - Plain Packagingâ dispute are likely to change this situation for the future, as for the first time the WTO dispute settlement bodies fully engage with Articles 7 and 8 of TRIPS to interpret Article 20 relative to the use of trademarks. It is indeed the reliance on these two provisions that allows the Panel and the Appellate Body to conclude that there are legitimate reasons for which Members may encumber trademark use. The awakening of these two provisions that have long remained dormant in the Agreement could have a fundamental impact in offering the possibility of a more flexible reading of TRIPS. It could indeed secure the adaptability of intellectual property rights to the evolution of economic, technological and social circumstances by guaranteeing a more balanced interpretation of the limitations and exceptions included in the Agreement, as advocated for example several years ago by a group of international IP scholars in the âDeclaration on a balanced interpretation of the three-step testâ. Furthermore, the use of these two provisions could serve as a gateway for the taking into account ethical imperatives supported by international human rights in the interpretation of the TRIPS norms. If such a reading has been advocated in the past, the âPlain Packagingâ- Reports might lead in the future to a more frequent and welcomed raising of human rights arguments in the context of international trade law
