The Practitioner’s Guide to Properly Responding to Requests for Disclosure Under the Texas Discovery Rules
Discovery, a pretrial procedure used to obtain information relating to the litigation, generally is the largest cost of civil litigation. By its very nature, discovery also is intrusive and invasive. Many practitioners are quick to dispute discovery requests, slow to produce information requested, and all too-eager to object at every stage of the discovery process.
This article relates to one of the most common types of written discovery—Texas Rule of Civil Procedure 194 disclosure requests, the responses to which are often incomplete and inadequate. Disclosure requests provide inexpensive, basic discovery without the delay relating to objections or work-product assertions. This article discusses (1) the differences between disclosure requests under the federal and Texas discovery rules, (2) the procedure for making disclosure requests under Texas Rule 194, (3) the contents of such requests, (4) proper responses to such requests, and (5) the proper use of responses to such requests.
Because complete and full responses to Texas Rule 194 disclosure requests can greatly lessen the cost and delay inherent in civil litigation and foster the cooperation often absent from it generally and discovery specifically, it is imperative that Texas practitioners understand what information and documents must be disclosed and make such disclosures fully and completely
Investigating the Effect of Stratospheric Radiation on Seed Germination and Growth
Three seed types: bean (Phaseolus vulgaris), corn (Zea mays) and radish (Raphanus sativus) were flown in a high altitude weather balloon into the mid-stratosphere to investigate the effects of high altitude radiation on germination success and seedling growth. After recovering and planting the seeds, the bean seeds showed lower germination success with exposure to high altitude radiation, and consequently stunted seedling growth. Cord and radish seeds experienced a statistically significant positive effect on germination success form radiation exposure compared to control seeds, but negative effect on seedling growth. Overall, the field experiments presented here support laboratory studies that show radiation exposure on vegetable seeds has a mixed effect on the germination success and negative effect on seedling growth on investigated seed types
Becoming Happier Takes Both a Will and a Proper Way: An Experimental Longitudinal Intervention to Boost Well-Being
An 8-month-long experimental study examined the immediate and longer term effects of regularly practicing two assigned positive activities (expressing optimism and gratitude) on well-being. More important, this intervention allowed us to explore the impact of two metafactors that are likely to influence the success of any positive activity: whether one self-selects into the study knowing that it is about increasing happiness and whether one invests effort into the activity over time. Our results indicate that initial self-selection makes a difference, but only in the two positive activity conditions, not the control, and that continued effort also makes a difference, but, again, only in the treatment conditions. We conclude that happiness interventions are more than just placebos, but that they are most successful when participants know about, endorse, and commit to the intervention

Deactivation of electrically supersaturated Te-doped InGaAs grown by MOCVD
Achieving and sustaining the highest doping level possible in InGaAs is critical for the reduction of contact resistance in future microelectronic applications. Tellurium (Te) is a very promising n-type dopant with high reported n-type doping densities. However, the stability of this dopant during post-growth thermal processing is unknown. Supersaturated Te-doped InGaAs layers were grown by MOCVD at 500 °C. The electrically active concentration of Te doping was 4.4 × 1019 cm−3 as grown. The thermal stability of the Te was investigated by studying the effect of post-growth annealing between 550 and 700 °C on the electrical activation. At all temperatures, the electrical activation decreased from its starting electron concentration of 4.4 × 1019 cm−3 down to 6–7 × 1018 cm−3. The rate of deactivation was measured at each temperature, and the activation energy for the deactivation process was determined to be 2.6 eV. The deactivation could be caused by either Te–Te clustering or a Te-point defect reaction. HAADF-STEM images showed no visible clustering or precipitation after deactivation. Based on previous ab initio calculations that suggest the VIII population increases as the Fermi level moves toward the conduction band, it is proposed that formation of isolated point defect complexes, possibly a Te–VIII complex, is associated with the deactivation process
Advantages of block copolymer synthesis by RAFT-controlled dispersion polymerization in supercritical carbon dioxide
Reversible addition-fragmentation chain transfer (RAFT)-controlled block copolymer synthesis using dispersion polymerization in supercritical carbon dioxide (scCO2) shows unprecedented control over blocking efficiency. For PMMA-b-PBzMA and PMMA-b-PSt the blocking efficiency was quantified by measuring homopolymer contaminants using the techniques of GPC deconvolution, gradient polymer elution chromatography (GPEC), and GPC dual RI/UV detection. A new, promising method was also developed which combined GPC deconvolution and GPEC. All techniques showed that blocking efficiency was significantly improved by reducing the radical concentration and target molecular weight. Estimated values agreed well with (and occasionally exceeded) theory for PMMA-b-PBzMA. The heterogeneous process in scCO2 appeared to cause little or no further hindrance to the block copolymerization procedure when reaction conditions were optimized. High blocking efficiencies were achieved (up to 82%) even at high conversion of MMA (>95%) and high molecular weight. These data compare favorably to numerous published reports of heterogeneous syntheses of block copolymers
Factors influencing quality of life following lower limb amputation for peripheral arterial occlusive disease: a systematic review of the literature
Background: The majority of lower limb amputations are undertaken in people with peripheral arterial occlusive disease,\ud
and approximately 50% have diabetes. Quality of life is an important outcome in lower limb amputations; little is known\ud
about what influences it, and therefore how to improve it.\ud
Objectives: The aim of this systematic review was to identify the factors that influence quality of life after lower limb\ud
amputation for peripheral arterial occlusive disease.\ud
Methods: MEDLINE, EMBASE, CINAHL, PsycINFO, Web of Science and Cochrane databases were searched to identify\ud
articles that quantitatively measured quality of life in those with a lower limb amputation for peripheral arterial occlusive\ud
disease. Articles were quality assessed by two assessors, evidence tables summarised each article and a narrative\ud
synthesis was performed.\ud
Study design: Systematic review.\ud
Results: Twelve articles were included. Study designs and outcome measures used varied. Quality assessment scores\ud
ranged from 36% to 92%. The ability to walk successfully with a prosthesis had the greatest positive impact on quality\ud
of life. A trans-femoral amputation was negatively associated with quality of life due to increased difficulty in walking\ud
with a prosthesis. Other factors such as older age, being male, longer time since amputation, level of social support and\ud
presence of diabetes also negatively affected quality of life.\ud
Conclusion: Being able to walk with a prosthesis is of primary importance to improve quality of life for people with lower\ud
limb amputation due to peripheral arterial occlusive disease. To further understand and improve the quality of life of this\ud
population, there is a need for more prospective longitudinal studies, with a standardised outcome measure
