Imperial Justice, Ecclesiastical Justice : Issues of Jurisdiction in Byzantium, TenthâFifteenth Centuries
Cette thĂšse traite de lâĂ©volution des relations entre le pouvoir impĂ©rial byzantin et lâĂglise entre le Xe et le XVe siĂšcle au prisme du droit et de la pratique judiciaire. Elle interroge le motif ancien de lâĂglise tardobyzantine imposant son autoritĂ© sur les Byzantins, contrĂŽlant lâadministration de la justice au dĂ©triment du pouvoir impĂ©rial supposĂ©ment affaibli. Plus gĂ©nĂ©ralement cette Ă©tude sâinsĂšre dans lâhistoriographie rĂ©cente qui nuance ce dĂ©sĂ©quilibre des pouvoirs au sein de lâappareil dâĂtat byzantin dans les derniers siĂšcles de lâempire. Elle rĂ©pond Ă trois questions principales. LâĂglise obtient-elle plus de compĂ©tences judiciaires Ă lâĂ©poque tardobyzantine ? Les clercs participent-ils plus Ă lâexercice de la justice ? Est-ce que le prestige moral et la stabilitĂ© de lâĂglise en pĂ©riode de trouble influent sur le recours aux tribunaux ecclĂ©siastiques et aux clercs par les justiciables byzantins ? Bien quâil nây ait pas d'accroissement des compĂ©tences judiciaires de lâĂglise Ă lâĂ©poque tardobyzantine, force est de constater quâil y a une plus grande participation des clercs au monde judiciaire byzantin, par la collaboration dans lâexercice de la justice de prĂ©lats et de dignitaire laĂŻcs, mais aussi un accroissement de son activitĂ© notariale. Cette plus grande participation sâexplique en partie par le rĂŽle de l'Ăglise comme protectrice des plus faibles et contre les abus de lâadministration. En outre, cette Ă©tude traite du rapport entre la pratique judiciaire et la loi Ă©crite. Elle atteste de lâapplication Ă Byzance des dispositions lĂ©gales relatives Ă lâassignation en justice devant le tribunal compĂ©tent et lâapparition dâinnovations procĂ©durales au sein du cadre lĂ©gal fixĂ© par le droit byzantin.My thesis deals with the evolution of the division of power in terms of judicial competences between the imperial authority and the Church in Byzantium, from the tenth to the fifteenth century. I analyse the long-discussed pattern of the Late Byzantine Church imposing itself as an authoritative power over the Byzantines, controlling the judiciary, to the detriment of the imperial power, supposedly weakened. More generally this study integrates the recent historiography, nuancing the powersâ disequilibrium within the late Byzantine state apparatus. It answers three main questions. Does the Church obtain more judicial competences during the late Byzantine period ? Do the clerics participate more to the exertion of justice ? Do the moral prestige and the stability of the Church in a chaotic period influence the Byzantine litigants to have more recourse to ecclesiastical courts ? Even if there is no increase of the judicial competences of the late Byzantine Church, the clerics appear to be more involved in the judicial world. It is attested by the increased collaboration of prelates and lay dignitaries in the exertion of justice but also by the growth of notarial activities of the Church. This greater involvement of the Church can be explained partly by its role as protector of the weak, especially against the exactions of the administration. Furthermore, this thesis analyses the relationship between the written law and the judicial practice. It shows the practical application of legal dispositions pertaining to the summons before the competent court and the development of procedural innovations within the legal framework of the Byzantine Law
