Management of agricultural genetic resources : an institutional analysis of trends in the Netherlands

This report analyses the developments in the institutional environment of the statutory research tasks for conservation and use of agricultural genetic resources (WOT-GB ) in the Netherlands. Attention focuses on the period since 2002, when the Netherlands Ministry of Agriculture, Nature Management and Food Quality (LNV) adopted its policy document, Sources of Existence, and likely future developments are described. A number of key stakeholders in the sector were interviewed in order to identify the relevant developments and their implications for the agreement on statutory research tasks between LNV and the Centre for Genetic Resources, the Netherlands (CGN) of Wageningen University and Research Centre

Intellectual property rights, international trade and plant breeding

Seed is the physical embodiment of the invention of the plant breeder. Plant varieties thus constitute a special form of innovation, and an assessment of intellectual property right (IPR) systems needs to take this into account. This thesis concentrates on IPRs but breeders do have a number of means by which they can capture part of the benefits from the cultivation of their new variety, rather than these falling into to public domain

Conservering van genetische bronnen voor de landbouw in Nederland : organisatie en in-stitutionele inbedding

Diversiteit in genetische bronnen is van groot belang voor een duurzame landbouw. Ont-wikkelingen in de moderne landbouw leiden echter vaak tot verlies aan diversiteit. Een deel van de oplossing is het aanhouden van genetische bronnen in genenbanken, maar ook op andere manieren kunnen genetische bronnen geconserveerd worden. Dit rapport presen-teert een overzicht van de Nederlandse gebruikers en beheerders van genetische bronnen voor de landbouw. Daarbij is een eenvoudig model uit de institutionele economie gebruikt: elk maatschappelijk proces kent actoren, transacties en een omgeving. De nadruk in dit rapport ligt op actoren en omgeving. De vele actoren betrokken bij conservering van gene-tische bronnen worden beschreven, evenals hun belangrijkste doelstellingen. Daarnaast wordt de maatschappelijke context beschreven waarbinnen deze actoren opereren. Twee belangrijke aspecten van die context zijn de markt voor landbouwproducten en het wette-lijk kader

Product differentiation under the WTO; An analysis of labelling and tariff or tax measures concerning farm animal welfare

This report examines the possibility of giving preferential treatment to imports of meat products that meet improved standards in terms of animal welfare in production. Three specific forms of preferential treatment are considered here as possible measures for increasing levels of animal welfare in meat production in the EU and its exporting partners: labelling of products (either voluntary or compulsory), differentiated import tariffs and differentiated consumer taxes. The likely admissibility of such measures under WTO rules is assessed by means of an analysis of previous decisions by WTO dispute settlement panels. It is concluded that all of the measures analysed have a possibility of being upheld, based on a defence relying on Article XX of the GATT and perhaps also the TBT Agreement. While the incentives offered by labelling could be reinforced with differentiated tariffs or taxes, these financial instruments involve various additional complications. They could best be considered after the possibilities of regulated labelling schemes have been exhausted

Dit artikel vergelijkt de situatie in Engeland, Noordrijn-Westfalen, Vlaanderen, Frankrijk en Denemarken met die van Nederland. Daarbij ligt de nadruk op de vraag in hoeverre regelingen centraal dan wel decentraal worden aangestuur

De vermaatschappelijking van het gemeenschappelijk landbouwbeleid : een inventarisatie van visies in Brussel en diverse EU-lidastaten

In dit rapport wordt voor een selectie van EU-lidstaten beschreven wat de toekomstvisies zijn voor het Gemeenschappelijk Landbouwbeleid (GLB). De visies in Nederland, Engeland, Duitsland, Frankrijk en Litouwen zijn geanalyseerd. Daarbij ligt de focus op het GLB in relatie tot maatschappelijke doelen, ofwel, in hoeverre komt in de toekomstvisies naar voren dat men het GLB (meer) wil verbinden met maatschappelijke doelen als natuur, milieu, landschap en dierenwelzijn. Er is gekeken naar de toekomstvisies zoals geformuleerd door regeringen, maar ook naar adviescommissies, wetenschappelijke instituten, natuur- en milieubeweging, belangenorganisaties vanuit de landbouw, en de publieke opinie

International agreements relating to plant genetic resources for food and agriculture and implications for Dutch policy

Policy issues related to plant genetic resources are socially, technically and scientifically complex. This report summarises the international agreements and relevant bodies con-cerning plant genetic resources for food and agriculture, including the Convention on Biological Diversity (CBD), FAO Global Plan of Action on Plant Genetic Resources (GPA), the International Treaty on Plant Genetic Resources for Food and Agriculture (IT-PGRFA), the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), the World Intellectual Property Organization (WIPO), and the International Con-vention for the Protection of New Varieties of Plants (UPOV). The various obligations arising from these conventions and treaties are reviewed. In so doing, this report concen-trates exclusively on implications for plant genetic resources for food and agriculture while most of the agreements concern other resources and/or issues. The relationship between the agreements is analysed with reference to the evolution of policy priorities from promoting use of genetic resources to supporting conservation, in part through the sharing of benefits arising from use.
