    Williams v. Gaye: Further Blurring the Lines Between Inspiration and Infringement

    Part I of this Note outlines the factual and procedural history of Williams and discusses the Ninth Circuit’s analysis in its first and second opinions. Part II discusses the historical background of copyright law in the United States, namely the Copyright Act of 1909 and the Copyright Act of 1976. Additionally, this section explains the structure of a music copyright infringement suit, including the elements required to make a successful infringement claim. Part III argues why courts should presume access in music copyright infringement cases, and subsequently, abandon the inverse-ratio rule. The inverse-ratio rule should be abandoned because people’s access to music has never been easier in today’s digital world. A plaintiff’s burden to prove substantial similarity between the plaintiff’s song and the defendant’s song, should not be diminished as a result of the defendant’s access to the plaintiff’s song. Instead, a defendant’s access to a particular song should be presumed in copyright infringement cases. This Note does not argue that the access requirement is unnecessary in such cases. Access is still necessary for copying because one cannot copy what one has never seen. However, it does not necessarily follow that more access increases the likelihood of copying

    Brain Waste Among Highly Skilled Immigrants in the United States

    The issue of brain waste and underemployment among highly skilled immigrants is a key issue facing the United States today. This problem of equity has turned into an issue of economic stability in a country with a waning population whose workforce will soon depend on immigrant and international workers. Multiple agencies, including government programs and nonprofits, are attempting to address this issue from a language learning perspective. Using the theoretical framework of Cultural Capital and Community Cultural Wealth, this research project suggests that the key to reducing brain waste and underemployment among highly skilled immigrants is to take the focus off language acquisition before reclaiming one’s previous occupational status, and instead focus on workforce development with on the job language training, all of which is provided by employers. The resulting product is a website that targets employers and provides essential information on the vitality of immigrant and international workers and why investing in the current language learning workforce is an equitable, economical, and sustainable decision

    NASAs Human Landing System: The Strategy for the 2024 Mission and Future Sustainability

    In response to the 2018 White House Space Policy Directive- sustainable lunar exploration, and to the Vice Presidents March 2019 direction to do so by 2024, NASA is working to establish humanity's presence on and around the Moon by: 1) sending payloads to its surface, 2) assembling the Gateway outpost in orbit and 3) demonstrating the first human lunar landings since 1972. NASAs Artemis program is implementing a multi-faceted and coordinated agency-wide approach with a focus on the lunar South Pole. The Artemis missions will demonstrate new technologies, capabilities and business approaches needed for future exploration, including Mars. Assessing options to accelerate development of required systems, NASA is utilizing public-private engagements through the Human Exploration and Operations (HEO) Mission Directorates NextSTEP Broad Agency Announcements. The design, development and demonstration of the Human Landing System (HLS) is expected to be led by commercial partners. Utilizing efforts across mission directorates, the Artemis effort will benefit from programs from the Science Mission Directorate (SMD) and Space Technology Mission Directorate (STMD). SMDs Commercial Lunar Payload Services (CLPS) initiative will procure commercial robotic lunar delivery services and the development of science instruments and technology demonstration payloads. The Space Technology Mission Directorate (STMD) portfolio of technology advancements relative to HLS include lunar lander components and technologies for pointing, navigation and tracking, fuel storage and transfer, autonomy and mobility, communications, propulsion and power. In addition to describing the objectives and requirements of the 2024 Artemis mission, this paper will present NASAs approach to accessing the lunar surface with an affordable human-rated landing system, current status and the role o a sustainable lunar presence

    Operational Considerations and Comparisons of the Saturn, Space Shuttle and Ares Launch Vehicles

    The United States (U.S.) space exploration policy has directed the National Aeronautics and Space Administration (NASA) to retire the Space Shuttle and to replace it with a new generation of space transportation systems for crew and cargo travel to the International Space Station, the Moon, Mars, and beyond. As part of the Constellation Program, engineers at NASA's Marshall Space Flight Center in Huntsville, Alabama are working to design and build the Ares I, the first of two large launch vehicles to return humans to the Moon. A deliberate effort is being made to ensure a high level of operability in order to significantly increase safety and availability as well as reduce recurring costs of this new launch vehicle. It is the Ares Project's goal to instill operability as part of the requirements development, design and operations of the vehicle. This paper will identify important factors in launch vehicle design that affect the operability and availability of the system. Similarities and differences in operational constraints will also be compared between the Saturn V, Space Shuttle and current Ares I design. Finally, potential improvements in operations and operability for large launch vehicles will be addressed. From the examples presented, the paper will discuss potential improvements for operability for future launch vehicles
