Sztuczna inteligencja w arbitrażu – AI w roli arbitra?
Artykuł jest drugim z cyklu dwóch opracowań analizujących problematykę wykorzystania
sztucznej inteligencji w arbitrażu w procesie podejmowania decyzji merytorycznych
w świetle obowiązujących regulacji prawnych. Artykuł porusza kontrowersyjne
zagadnienie możliwości zastąpienia człowieka przez sztuczną inteligencję w roli arbitra.
Punktem odniesienia jest polski porządek prawny ujęty w konwencjach międzynarodowych,
których Polska jest stroną, oraz zgodnie z Kodeksem postępowania cywilnego,
zestawiony z rozwiązaniami funkcjonującymi w wybranych państwach.The article is the first one in a series of two studies analyzing the use of artificial
intelligence in the arbitral decision-making process in the light of applicable legal
regulations. It deals with the controversial issue of replacement of human by artificial
intelligence. This issue will be analysed from a perspective of Polish legal order, included
in international conventions in force in Poland and in the Code of Civil Procedure,
juxstaposed with solutions functioning in selected countries

Artykuł recenzowany / peer-reviewed articleThe concept of liability of public authority based on the principle of equity was introduced into the Polish law under the article 5 of the Act of 15 November 1956, “On the Liability of the State for Damage Caused by State Agents”. The regulation of article 5 of the Act was transposed into the Civil Code of 1964 without major modifi cations. It covered liability of the state and local self-government units for damage infl icted by a tort of a functionary (article 419 of the Civil Code). By the amendment to the Civil Code of 2004, article 419 of the Civil Code was abolished and the new article 4172 of the Civil Code, which provides liability for lawful exercise of public authority based on considerations of equity, was introduced. Article 4172 of the Civil Code provides that if by lawful exercise of public authority an injury to the person was caused, the injured person is entitled to obtain a full or partial compensation as well as monetary compensation for moral losses, when it is evident from the circumstances of the case, especially from victim’s incapacity to work or his/her poor fi nancial situation that compensation is required by the
considerations of equity. The amendment to the Civil Code of 2004 has brought about essential changes in the regime of state liability. Under the present law, the decisive
factor of liability is the character of the conduct that results in the damage. The domain of special state liability is limited to torts committed in the exercise of public powers. For its private economic activities the state is liable according to the general rules of civil law. This change – in comparison to the former regulations of liability of public authority
based on principle of equity – is unfavourable for the injured party,
especially as regards damage sustained in medical practice, as medical
care of patients, in general, is not considered to belong to the sphere of
public administration

The article addresses the issues concerning the periods for making a claim or exercising
a right under the statutory warranty for legal defects following the Civil Code amendment
introduced under the Consumer Rights Act of 30 th May 2014. Prior to the Act’s
entry into force the respective provisions were set out in Art. 576 of the Civil Code
and Art. 10 of the Act on Detailed Conditions for Consumer Sales of 27th Jul, 2002
(which applied to business-to-consumer contracts). After the entry into force of the
Consumer Rights Act, the related issues are comprehensively regulated under unified
rules (with some distinctions in the case of consumer contracts) in the Civil Code, under
the amended Art. 576. The article points out the differences between the previous
and the new regulations
Sztuczna inteligencja w arbitrażu – wsparcie dla arbitrów w procesie podejmowania decyzji
The article is the first one in a series of two studies analyzing the use of artificial intelligence
in the arbitral decision-making process in the light of applicable legal regulations.
In terms of the use of AI in arbitral decision-making process, two possibilities
can be distinguished: supporting arbitrator by artificial intelligence and replacement
of human by artificial intelligence. The paper deals with the first one of these issues.
The Polish legal order does not contain provisions that would directly specify the scope of tasks that can be delegated to other persons or technologies. Certain restrictions in
this respect are set forth in the provisions on setting aside an arbitral award. Article
1206 § 1 of the Polish Code of Civil Procedure lists among grounds for setting aside an
award the circumstances of depriving a party of the possibility of defending his rights
in proceedings before an arbitral tribunal and failure to comply with the requirements
regarding the composition of the arbitral tribunal or the basic principles of proceedings
before that court, arising from the Act or determined by parties (Article 1206 § 1
points 2 and 4 of the Code of Civil Procedure).Artykuł jest pierwszym z cyklu dwóch opracowań analizujących problematykę wykorzystania
sztucznej inteligencji w arbitrażu w procesie podejmowania decyzji merytorycznych
w świetle obowiązujących regulacji prawnych. W aspekcie zastosowania AI
przy rozstrzyganiu sporu wyodrębnić można dwie możliwości: wsparcie arbitrów przez
sztuczną inteligencję przy podejmowaniu decyzji merytorycznych oraz zastąpienie człowieka
przez sztuczną inteligencję w roli arbitra. Artykuł podejmuje pierwsze z wymienionych
zagadnień. Polski porządek prawny nie zawiera przepisów, które bezpośrednio
określałyby zakres zadań, przy wykonywaniu których arbiter może wspierać się pomocą
innych osób bądź technologii. Pewne ograniczenia w tym względzie ustanawiają
przepisy dotyczące uchylenia wyroku arbitrażowego, które jako podstawy uchylenia
wymieniają pozbawienie strony możliwości obrony swoich praw w postępowaniu przed
sądem polubownym oraz niezachowanie wymagań co do składu sądu polubownego
lub podstawowych zasad postępowania przed tym sądem, wynikających z ustawy lub
określonych przez strony (art. 1206 § 1 pkt. 2 i 4 k.p.c.)

dostatecznie chętnie. Niektórych odstrasza sama ich objętość. Zespół pracowników
Katedry Prawa Cywilnego Krakowskiej Akademii im. Andrzeja Frycza
Modrzewskiego przystąpił więc do przygotowania programu z tego przedmiotu
i wypróbował go w ciągu paru lat."(...

ADR-accredited entities in Poland: a review of institutions listed in the UOKiK register (part II)
The article is a second part of a review of the ADR-accredited entities in Poland (and procedures they offer), listed with accordance with Art 20 (2) of the Directive 2013/11/ EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes, by the competent authority, The President of the Office of Competition and Consumer Protection (UOKiK). There are currently nine ADR entities in the register maintained by President of the UOKiK, six public and three private ones. The public entities with sectoral competence are: President of the Office of Electronic Communications, Financial Ombudsman, Rail Passenger Ombudsman under the President of the Office of Rail Transport, Arbitration Court at the Polish Financial Supervision Authority, Negotiations Coordinator with the President of the Energy Regulatory Office. Trade Inspection, a public entity with horizontal dimension, covers disputes for which a relevant sectoral ADR has not been established. The private entities, as at 1 March 2018, are: Polish Bank Association – Banking Ombudsman Scheme, Chamber of Digital Economy and “Friendly Flying” Air Passenger Watchdog.Artykuł stanowi drugą część opracowania przedstawiającego przegląd podmiotów uprawnionych do pozasądowego rozwiązywania sporów konsumenckich – wraz z opisem prowadzonych przez nie postępowań – wpisanych do rejestru podmiotów uprawnionych prowadzonego przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów (UOKiK), przekazywanego Komisji Europejskiej zgodnie z art. 20 ust. 2 zd. 3 dyrektywy Parlamentu Europejskiego i Rady 2013/11/UE w sprawie alternatywnych metod rozstrzygania sporów konsumenckich. Obecnie (stan na 1 marca 2018 r.) do rejestru zostało wpisanych dziewięć podmiotów. Sześć podmiotów publicznych – tj. podmioty o charakterze sektorowym: Prezes Urzędu Komunikacji Elektronicznej, Rzecznik Finansowy, Rzecznik Praw Pasażera Kolei przy Prezesie Urzędu Transportu Kolejowego, Sąd Polubowny przy Komisji Nadzoru Finansowego, Koordynator do spraw negocjacji przy Prezesie Urzędu Regulacji Energetyki oraz podmiot o charakterze horyzontalnym (Inspekcja Handlowa), którego zakres działania obejmuje spory, dla których nie został utworzony właściwy sektorowy podmiot ADR – i trzy podmioty niepubliczne: Bankowy Arbitraż Konsumencki przy Związku Banków Polskich i Izba Gospodarki Elektronicznej (będące organizacją przedsiębiorców) oraz Stowarzyszenie Praw Pasażerów „Przyjazne Latanie” (będące organizacją konsumentów)
