ADR-accredited entities in Poland: a review of institutions listed in the UOKiK register (part II)

Abstract

The article is a second part of a review of the ADR-accredited entities in Poland (and procedures they offer), listed with accordance with Art 20 (2) of the Directive 2013/11/ EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes, by the competent authority, The President of the Office of Competition and Consumer Protection (UOKiK). There are currently nine ADR entities in the register maintained by President of the UOKiK, six public and three private ones. The public entities with sectoral competence are: President of the Office of Electronic Communications, Financial Ombudsman, Rail Passenger Ombudsman under the President of the Office of Rail Transport, Arbitration Court at the Polish Financial Supervision Authority, Negotiations Coordinator with the President of the Energy Regulatory Office. Trade Inspection, a public entity with horizontal dimension, covers disputes for which a relevant sectoral ADR has not been established. The private entities, as at 1 March 2018, are: Polish Bank Association – Banking Ombudsman Scheme, Chamber of Digital Economy and “Friendly Flying” Air Passenger Watchdog.Artykuł stanowi drugą część opracowania przedstawiającego przegląd podmiotów uprawnionych do pozasądowego rozwiązywania sporów konsumenckich – wraz z opisem prowadzonych przez nie postępowań – wpisanych do rejestru podmiotów uprawnionych prowadzonego przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów (UOKiK), przekazywanego Komisji Europejskiej zgodnie z art. 20 ust. 2 zd. 3 dyrektywy Parlamentu Europejskiego i Rady 2013/11/UE w sprawie alternatywnych metod rozstrzygania sporów konsumenckich. Obecnie (stan na 1 marca 2018 r.) do rejestru zostało wpisanych dziewięć podmiotów. Sześć podmiotów publicznych – tj. podmioty o charakterze sektorowym: Prezes Urzędu Komunikacji Elektronicznej, Rzecznik Finansowy, Rzecznik Praw Pasażera Kolei przy Prezesie Urzędu Transportu Kolejowego, Sąd Polubowny przy Komisji Nadzoru Finansowego, Koordynator do spraw negocjacji przy Prezesie Urzędu Regulacji Energetyki oraz podmiot o charakterze horyzontalnym (Inspekcja Handlowa), którego zakres działania obejmuje spory, dla których nie został utworzony właściwy sektorowy podmiot ADR – i trzy podmioty niepubliczne: Bankowy Arbitraż Konsumencki przy Związku Banków Polskich i Izba Gospodarki Elektronicznej (będące organizacją przedsiębiorców) oraz Stowarzyszenie Praw Pasażerów „Przyjazne Latanie” (będące organizacją konsumentów)
