    Victims’ rights are human rights: The importance of recognizing victims as persons

    In this paper the author argues that victims’ rights are human rights. Criminal law typically views victims as witnesses to a crime against the state, thus shutting them out of the criminal justice process and only allowing them in when they are needed to testify. This is a major source of dissatisfaction for victims who seek validation in the criminal justice system. Victims are persons with rights and privileges. Crimes constitute violations of their rights as well as acts against society or the state. While human rights instruments, such as the Universal Declaration of Human Rights, do not mention crime victims specifically, a number of rights are identified, which can be viewed from the victim’s perspective. As individuals with dignity, victims have the right to recognition as persons before the law. However, such rights are only meaningful if they can be enforced

    Experimental results and model calculations of a hybrid adsorption-compression heat pump based on a roots compressor and silica gel-water sorption

The driving temperature for operation of such systems limits the operating window and can be a barrier for market-introduction. By adding a compressor, the sorption cycle can be run using lower waste heat temperatures. ECN has recently started the development of such a hybrid heat pump. The final goal is to develop a hybrid heat pump for upgrading lower (<100⁰C) temperature industrial waste heat to above pinch temperatures. The paper presents the first measurements and model calculations of a hybrid heat pump system using a water-silica gel system combined with a Roots type compressor. From the measurements can be seen that the effect of the compressor is dependent on where in the cycle it is placed. When placed between the evaporator and the sorption reactor, it has a considerable larger effect compared to the compressor placed between the sorption reactor and the condenser. The latter hardly improves the performance compared to purely heat-driven operation. This shows the importance of studying the interaction between all components of the system. The model, which shows reasonable correlation with the measurements, could proof to be a valuable tool to determine the optimal hybrid heat pump configuration

    Criminal redress in cases of environmental victimisation: a defence

    In recent years growing concern has been voiced in the environmental justice literature regarding the ability of criminal justice mechanisms to adequately address environmental harms, especially when such harms are perpetrated by large corporations. Commentators argue that criminal justice processes are often ill-suited to the particular features of environmental cases, where the chain of causation between wrongful actions/omissions and environmentally harmful consequence can be very complex and extend over the course of many years. As an alternative, many such commentators now favour the adoption of more administrative resolutions when corporate bodies breach their environmental obligations (which may or may not amount to ‘crimes’). Others favour the use of civil sanction regimes, which is now the preferred approach of the UK Environment Agency. In this paper I will argue that the debate on how best to respond to environmental harm has so far neglected to factor in the perspective of the victims of those harms and, in particular, their need for redress. I will argue that by incorporating such a perspective, as opposed to focusing largely on questions of efficiency and cost-effectiveness, the criminal justice route still has much to recommended it, especially in relation to the provision of meaningful redress and/or compensation to the victims of environmental harm. Consequently, this paper will provide a victimological defence of the criminal justice process, and of criminal penalties, in their application to cases of environmental harms
