Comparison between the divorce law of the British Commonwealth, U.S.A., and certain continental systems of law, with particular regard to the execution of foreign judgments
The purpose of this thesis is to-treat of the general
principles and doctrines of the law on divorce which
prevail in the Anglo- American common law units and in
certain continental systems of law, the French, Austrian , German, Swiss and Italian., with particular regard to the
fundamentals and applications of the rules as to conflict
of laws governing this subject matter. In contrasting these laws and rules the diversity or
similarity of the views on these problems in the different
systems of laws will be set out:In Part I some important preliminary matters, such as
sources of law,interpretation and characterization,
further the doctrine of renvoi, the law on domicil and
nationality as the principal tests of jurisdiction and
of choice of law, and the law on hasband and wife will be
discussed; the doctrine of renvoi and the law on domicil
and nationality will be analysed,' more fully in respect
of their important bearing on the topic of conflict of
laws; the fuller treatment of the latter subject, namely law
on domicil and nationality is the more necessary because
domicil is the test of jurisdiction and of choice of law in
the Anglo- American systems of law and nationality principally is used as such test in the Continental systems of law.
The internal law on divorce of the countries concerned
will be stated and the rules as to choice of law which
relate to them will be attached thereto in Part II.
'An outline .of the rules governing procedure in causes of
divorce will be given in art III where only the most
striking features of these rules will be shown insofar
as they contrast with those relating to ordinary proceedings in civil matters.Since international jurisdiction of the court rendering
a, judgment of divorce is the most important requirement
its recognition, the subject matter of recognition of
foreign judgments of divorce will be discussed in
connection. with that of jurisdiction in Bart IV.
Finally, Bart V will cover enforcement .of foriegn orders
and judgments concerning matters ancillary to divorce.
In the following pages the word "domicil", written
thus, is used in the Anglo-American sense of the term,
whereas the word " domicile" will be used in the
Continental connotation, as far as possible; for the
distinction between these terms reference is made to
page 62Further, the word "divorce" used without any
qualification will mean divorce "a vinculo matrimonii"
(from bond of matrimony)
Using LibreOffice Base to Teach Relational Database Management
Choosing a relational database management system to support teaching database management is a frequent decision for IS instructors. However, scarce attention has been brought to LibreOffice Base. LibreOffice is a popular open-source software alternative to office management products such as Microsoft Office. This paper evaluates Base as an option to support teaching database management. Base was used to support teaching database management at McGill University during the winter 2021 semester. Overall, Base stood out as a practical choice for teaching database management concepts and SQL. It has low costs, high compatibility, easy installation, and is easy to use. Features allowing to easily share database files facilitated communications between the instructor and students and the management of material submitted to the instructor. Base, hence, appears well suited to teach database management concepts and standard SQL. However, it has lower market appeal than competitors such as Access and MySQL
Influence of Parents’ Involvement on Children’s Education: A Study of Tertiary Education in European Countries
This Master Thesis analyzes how beneficial parental involvement is for third level education of an individual. Effects derived from parental behavior are measured based on new data on a larger scale compared to previous research, and by exploiting so far unused involvement variables. For the measurement a logit regression is applied to European Value Study data, for a selection of thirteen countries across Europe. Through this approach with micro level data, evidence for different effects regarding magnitude and direction, in various countries and between the parents, has been found. It can be concluded that while involvement of the parents has a positive impact on the attainment of third level education, the effect varies between countries due to country specific differences
IT SELF-CONCEPT CLARITY: DEFINITION AND MEASURE
Due to their constant interactions with IT, users accumulate beliefs they hold toward their selves as IT users. Given the ambivalent nature of IT, individuals tend to develop ambiguous and incoherent beliefs toward their selves as IT users. This can lead users to limit the efficacy of their interactions with IT and negatively affect their overall perception of themselves. This paper conceptualizes the IT Self-Concept Clarity (ITSCC) construct to improve the predictive power of models interested in the users\u27 daily interaction with IT. We also develop a measurement scale for ITSCC. We validate the scale by performing three studies. We perform a pre-test, a cross-sectional survey study and an experimental manipulation study. We outline the positive relationship between ITSCC and computer self-efficacy and self-esteem. We also validate the effect of the experimental manipulation on our scale, which will allow assessing the causal impact of ITSCC in future studies
For Better and Worst: IT Identity and Subjective Well-being
The constant interactions of individuals with IT lead individuals to integrate IT within their sense of self, thus developing an IT identity. Research on this topic has highlighted the positive impact of IT identity on exploratory use and performance. However, there are limited studies regarding IT identity\u27s impact on users\u27 subjective well-being. Using the self-change model, we expand the IT identity theory. We assert that generating an IT identity leads to integrating positive and negative attributes afforded by the IT within the users’ self-concept. The integration of positive attributes will have a positive effect on the users\u27 subjective well-being, while negative attributes will have a negative effect. We propose testing our model using a longitudinal study. This study will make a theoretical contribution by expanding the IT identity theory and providing insights into the ambivalence of the users\u27 change when generating an IT identity
