The Unstoppable Force, the Immovable Object: Challenges for Structuring a Cosmopolitan Legal Education in Brazil
This Article discusses the challenges for structuring a more
cosmopolitan legal education in the global South without falling in the
traps of legal colonialism, academic solipsism and social elitism. It does so
by examining the experience of FGV Direito SP, an attempt to create a
global Law school in Brazil. The Article suggests that understanding the
broad implications of a project for radically changing legal teaching in
Brazil requires a nuanced reading of the encounter between the purportedly
unstoppable force of globalization and the supposedly immovable object of
traditional legal institutions.
This Article is organized in four sections. The first discusses how
globalization and the return to democratic rule of law have created the need
for a new model of legal education in Brazil. The second discusses the legal
culture framework within which the new school appeared. The third
overviews the main lines of FGV Direito SP global-oriented legal
education. The fourth section presents the hurdles to offering a globaloriented
legal education in an emerging country overwhelmed by deep and
persistent social inequality and frames FGV’s experience within the
context of the ethical and political challenges for legal education in the
global South
É possível contribuir para a formação ética de nossos juristas? Desafios para o ensino jurídico no Brasil
This paper discusses the impact law schools can be expected to have on the ethical formation of their students, and puts forward a new proposal for teaching ethics. The f irst section e xamines traditional ways through which ethical education has been delivered in law schools; the second analy zes the interplay between interests, ethics and worldviews; and the third advocates a new pedagogy for teaching ethics in law schools, and suggests class debates on real cases are more likely to effectively contribute to the ethical formation of students than traditional lecture classes which still prevail in BrazilEste artigo discute a contribuição que os cursos de direito podem oferecer para a formação ética de seus alunos e apresenta uma nova proposta para o ensino de ética. A primeira seção analisa a forma tradicional de se conceber o ensino dessa disciplina em cursos jurídicos; a segunda reflete sobre a relação entre interesses, ética e visões de mundo; a terceira apresenta propostas para o ensino da ética nos cursos jurídicos, sugerindo que o debate em sala de aula sobre casos concretos tem maior potencial de contribuição efetiva para a formação ética dos alunos do que o método expositivo tradicionalmente utilizado no Brasi
A constituição como reserva de justiça The constituition as a reserve of justice
Examina-se a questão das cláusulas que impõem restrições à mudança constitucional. Discutem-se as principais interpretações dos problemas e paradoxos que emergem quando a questão é vista da perspectiva de exigências democráticas. Argumenta-se que clásulas super-constitucionais são aceitaveis desta perspectiva quando protegem os princípios democráticos da Constituição. Isto signfica que uma teoria coerente das cláusulas super-constitucionais deve basear-se na defesa das condições que permitam o auto-governo por indivíduos livres e iguais com base em procedimentos justos. Aplica-se isso ao caso da Constituição brasileira de 1988.<br>The question of the clauses imposing restrictions on constitutional change is examined. The main interpretations concerning the problems and paradoxes raised when the question is viewed from the standpoint of the democratic demands are discussed. It is argued that those clauses area reasonable from this perspective whenever they protect the democratic principles of the Constitution. This means that a coherent theory of the supra-constitutional clauses ought to have at its foundations the defence of the conditions which allow the self-government of free and equal individuals on the basis of just procedures. This is applied to the case of the Brazilian Constitution of 1988
