    Why are Hong Kong judges keeping a distance from international law, and with what consequences? Reflections on the CFA decision in DRC v FG Hemisphere

    In DRC v FG Hemisphere both the majority and minority opinions in the Court of Final Appeal treated international law as irrelevant for the decision which was supposed to be taken on the basis of constitutional principle alone. This was a mistaken course with potentially very negative consequences for the rule of law in Hong Kong. The minority treated decisions taken on sovereign immunity by HK courts in the past as frozen into precedents in common law and therefore deriving their strength only from the common law of Hong Kong. On the other hand the majority effectively decided that any issue coming before it which involves international law is automatically a matter of foreign affairs and that it is up to the PRC to tell the HK courts what is the interpretation of international law. The article argues that in future HK courts should treat the law of sovereign immunity as sui generis having no implications for their approach to other international law questions.published_or_final_versio

    A polarimetric study of ETA carinae and the carina nebula

    This thesis contains an account of some of the work undertaken by the author while a member of the Astronomy Group at the University of Durham. The work of the group involves the measurement and interpretation of the linear polarization in nebular astronomical objects. The initial chapters briefly describe the theory of polarized light and the. method of observing linear polarization, along with an indication of the techniques involved when analyzing the data. Chapter three is a review of recent work on interstellar grains with a summary of the present ideas on the nature of the grains. The next chapter summarizes the observations of the peculiar object Carinae and in the following chapter, a polarization map of the nebulosity around Carinae is presented and a model determined to account for the observed linear polarization. The model involves the assumption of a bipolar type geometry for η Carinae with a size distribution of silicate grains of the form and it is found that grains of .15” contribute most to the scattering at optical wavelengths. Using the same distribution it is found that maximum emission at l0” can be expected from grains of size .l” .The final chapter contains observations of the linear polarization in the Carina Nebula in the region of n Carinae, and the results are interpreted in the light of present ideas concerning n Carinae and its relationship with the Carinae Nebula. It seems that the light from η Carinae is being reflected by clouds in the Carina Nebula

    Multidisciplinary Design Optimization of an Extreme Aspect Ration HALE UAV

    Development of High Altitude Long Endurance (HALE) aircraft systems is part of a vision for a low cost communications/surveillance capability. Applications of a multi payload aircraft operating for extended periods at stratospheric altitudes span military and civil genres and support battlefield operations, communications, atmospheric or agricultural monitoring, surveillance, and other disciplines that may currently require satellite-based infrastructure. The central goal of this research was the development of a multidisciplinary tool for analysis, design, and optimization of HALE UAVs, facilitating the study of a novel configuration concept. Applying design ideas stemming from a unique WWII-era project, a pinned wing HALE aircraft would employ self-supporting wing segments assembled into one overall flying wing. When wrapped in an optimization routine, the integrated design environment shows potential for a 17.3% reduction in weight when wing thickness to chord ratio, aspect ratio, wing loading, and power to weight ratio are included as optimizer-controlled design variables. Investigation of applying the sustained day/night mission requirement and improved technology factors to the design shows that there are potential benefits associated with a segmented or pinned wing. As expected, wing structural weight is reduced, but benefits diminish as higher numbers of wing segments are considered. For an aircraft consisting of six wing segments, a maximum of 14.2% reduction in gross weight over an advanced technology optimal baseline is predicted

    Proteomics as a quality control tool of pharmaceutical probiotic bacterial lysate products

    Probiotic bacteria have a wide range of applications in veterinary and human therapeutics. Inactivated probiotics are complex samples and quality control (QC) should measure as many molecular features as possible. Capillary electrophoresis coupled to mass spectrometry (CE/MS) has been used as a multidimensional and high throughput method for the identification and validation of biomarkers of disease in complex biological samples such as biofluids. In this study we evaluate the suitability of CE/MS to measure the consistency of different lots of the probiotic formulation Pro-Symbioflor which is a bacterial lysate of heat-inactivated Escherichia coli and Enterococcus faecalis. Over 5000 peptides were detected by CE/MS in 5 different lots of the bacterial lysate and in a sample of culture medium. 71 to 75% of the total peptide content was identical in all lots. This percentage increased to 87–89% when allowing the absence of a peptide in one of the 5 samples. These results, based on over 2000 peptides, suggest high similarity of the 5 different lots. Sequence analysis identified peptides of both E. coli and E. faecalis and peptides originating from the culture medium, thus confirming the presence of the strains in the formulation. Ontology analysis suggested that the majority of the peptides identified for E. coli originated from the cell membrane or the fimbrium, while peptides identified for E. faecalis were enriched for peptides originating from the cytoplasm. The bacterial lysate peptides as a whole are recognised as highly conserved molecular patterns by the innate immune system as microbe associated molecular pattern (MAMP). Sequence analysis also identified the presence of soybean, yeast and casein protein fragments that are part of the formulation of the culture medium. In conclusion CE/MS seems an appropriate QC tool to analyze complex biological products such as inactivated probiotic formulations and allows determining the similarity between lots

    Plasma micronutrient status is improved after a 3-month dietary intervention with 5 daily portions of fruits and vegetables: implications for optimal antioxidant levels

    To explore the effects of increasing fruit and vegetable intake and the resulting effects on levels of circulating micronutrients in a community-dwelling population with an already high consumption of fruits and vegetables, 112 volunteers (86% women) underwent targeted dietary counseling for three months. At the beginning of the study and after 4, 8 and 12 weeks a food frequency questionnaire was filled in, and plasma levels of dietary antioxidants as well as biomarkers of oxidative lipid and protein damage were determined. Compared to baseline, especially the intake of fruits was significantly improved after 3 months of intervention, and mean plasma levels of lutein, zeaxanthin, ÎČ-cryptoxanthin, lycopene, α- and ÎČ-carotene, retinol, α-tocopherol, vitamin C and vitamin B6 were increased. Biomarkers of oxidative stress remained unchanged. Thus, a nutritional counseling program is capable of improving plasma levels of antioxidants even in a health-conscious population. A decrease in biomarkers of oxidative stress, however, does not occur

    Was Sinn FĂ©in dying? A quantitative post-mortem of the party's decline and the emergence of Fianna FĂĄil

    This article calls for a reappraisal of the consensus surrounding the split within Sinn FĂ©in in 1926 that led to the foundation of Fianna FĂĄil. It demonstrates that quantitative factors cited to demonstrate Sinn FĂ©in’s “terminal” decline – finances, cumann numbers, and election results – and to explain de Valera’s decision to leave Sinn FĂ©in and establish a rival republican organisation, Fianna FĂĄil, do not provide sufficient objective grounds to explain the republican leader’s actions. This article demonstrates that Sinn FĂ©in’s election results during the period in question (1923-1926) were encouraging and the decline in finances and cumann numbers can be explained by the fact that the base year used to compare progress was 1923, an election year. Moreover, this article compares the performance of Sinn FĂ©in to the first five years of Fianna FĂĄil (1926-1931) to show that what has been interpreted as terminal decline can also be attributed to normal inter-election lulls in party activity. Correspondingly, subjective factors – e.g. personal rivalries, differences in ideology, organisational style and levels of patience in terms of achieving political power – were most likely the determining factors rather than organisational decline

    The archaeal RNA polymerase (RNAP) is a double-psi ÎČ-barrel enzyme closely related to eukaryotic RNAPII in terms of subunit composition and architecture, promoter elements and basal transcription factors required for the initiation and elongation phase of transcription. Understanding archaeal transcription is, therefore, key to delineate the universally conserved fundamental mechanisms of transcription as well as the evolution of the archaeo-eukaryotic transcription machineries. The dynamic interplay between RNAP subunits, transcription factors and nucleic acids dictates the activity of RNAP and ultimately gene expression.     Consensus Statement on the Terminology and Classification of Central Neck Dissection for Thyroid Cancer

    Background: The primary goals of this interdisciplinary consensus statement are to review the relevant anatomy of the central neck compartment, to identify the nodal subgroups within the central compartment commonly involved in thyroid cancer, and to define a consistent terminology relevant to the central compartment neck dissection. Summary: The most commonly involved central lymph nodes in thyroid carcinoma are the prelaryngeal (Delphian), pretracheal, and the right and left paratracheal nodal basins. A central neck dissection includes comprehensive, compartment-oriented removal of the prelaryngeal and pretracheal nodes and at least one paratracheal lymph node basin. A designation should be made as to whether a unilateral or bilateral dissection is performed and on which side (left or right) in unilateral cases. Lymph node plucking or berry picking implies removal only of the clinically involved nodes rather than a complete nodal group within the compartment and is not recommended. A therapeutic central compartment neck dissection implies that nodal metastasis is apparent clinically (preoperatively or intraoperatively) or by imaging (clinically N1a). A prophylactic/elective central compartment dissection implies nodal metastasis is not detected clinically or by imaging (clinically N0). Conclusion: Central neck dissection at a minimum should consist of removal of the prelaryngeal, pretracheal, and paratracheal lymph nodes.
