Međunarodnopravna zaštita privatnosti radnika prema Europskoj konvenciji za zaštitu ljudskih prava i temeljnih sloboda

In the diversity of national approaches to the problem of protection of employees’ privacy at work, the jurisprudence of the European Court of Human Rights provides a priceless framework for the consideration of cases concerning employee’s privacy. Even though the term “privacy” was not used by the Strasbourg Court, its broad interpretation of the right to respect for private life significantly contributed to the protection of personal data, elaborating positive obligations of the states. The article researches how the European Convention on Human Rights is adapted to protect employees’ personal data, to restrict unauthorized video surveillance, searches, interception of telephone calls at work and takes into account the most recent case, Bărbulescu v. Romania, considered in 2016. It focuses on the Court’s approach to the lawfulness and necessity of the interference with employee’s privacy, as it has particular value for the employee’s protection on the national level in the countries of the Council of Europe.Među različitim nacionalnim pristupima problemu zaštite privatnosti radnika na radnom mjestu sudska praksa Europskog suda za ljudska prava (ESLJP) pruža neprocjenjiv okvir za razmatranje slučajeva koji se odnose na privatnost radnika. Iako ESLJP nije upotrebljavao pojam “privatnost”, njegovo široko tumačenje prava na zaštitu privatnog života znatno je pridonijelo zaštiti osobnih podataka razrađujući pozitivne obveze država. U članku se analizira kako je prilagođenom primjenom odredaba Europske konvencije za zaštitu temeljnih ljudskih prava i sloboda ostvarena zaštita osobnih podataka radnika, ograničen neovlašteni videonadzor, prisluškivanje telefonskih razgovora na radnom mjestu te je posebno obrađen recentni slučaj Bărbulescu protiv Rumunjske. Naglasak u radu stavljen je na pristup ESLJP-a pitanjima zakonitosti i nužnosti prilikom narušavanja privatnosti radnika s obzirom na posebnu važnost koju judikatura ESLJP-a ima u članicama Vijeća Europe

Proširenje okvira Europske konvencije o ljudskim pravima: povijest, filozofski korijeni i praktični rezultati

The history of the development of the European Convention on Human Rights represents a unique experience of widening the scope of protection of an international instrument from classical political and civil rights to certain social and economic rights. With a particular focus upon the protection of labour rights under the European Convention, the author researches the roots of expansion of the Convention, analyzing the process of drafting and the capabilities theory of A. Sen, and the application of Convention as a “living instrument”. The paper traces how the judgments of the European Court in social matters contribute to the development of the relevant legislation of the states and establish enforceable standards of human rights protection.Povijest razvoja Europske konvencije o ljudskim pravima predstavlja jedinstveno iskustvo širenja okvira zaštite međunarodnim pravnim instrumentom od klasičnih političkih i građanskih prava na određena društvena i ekonomska prava. S posebnim naglaskom na zaštitu radničkih prava prema Europskoj konvenciji autorica istražuje korijene širenja Europske konvencije, analizirajući proces njezine pripreme i teoriju o mogućnostima A. Sen te primjenu Konvencije kao “živog instrumenta”. Doprinosi MOR-a jurisprudenciji međunarodnih tijela za ljudska prava

The paper addresses the role of the International Labour Organization (ILO) in the consideration of cases and in the interpretation of international human rights instruments by the Committee on Economic, Social and Cultural Rights and the European Court of Human Rights. As labour rights form part of internationally recognized human rights the author attempts to evaluate the penetration of ILO standards and legal reasoning into the adjudication of human rights cases and interpretation of human rights instruments by other international bodies. The analysis of the jurisprudence of the CESCR and the ECtHR demonstrates that the ILO standards and the legal reasoning are always referred to in the cases related to labour rights and serve as a source of “substantial filling” of both the International Covenant on Economic, Social and Cultural Rights and the European Convention on Human Rights.U radu se obrađuje uloga Međunarodne organizacije rada (MOR) prilikom razmatranja slučajeva i pri tumačenju međunarodnih instrumenata za zaštitu ljudskih prava od strane Odbora za ekonomska, socijalna i kulturna prava te Europskog suda za ljudska prava. S obzirom na to da radnička prava čine dio međunarodno priznatih ljudskih prava, autorica istražuje u kojoj su mjeri standardi i argumentacija MOR-a prihvaćeni u sudskoj praksi i pri tumačenju međunarodnih instrumenata za zaštitu ljudskih prava od strane drugih međunarodnih tijela. Analiza jurisprudencije Odbora za ekonomska, socijalna i kulturna prava te Europskog suda za ljudska prava pokazuje da se u slučajevima koji se odnose na radnička prava uvijek referira na standarde i argumentaciju MOR-a, pri čemu oni služe i kao izvor “supstancijalnog nadopunjavanja” i Međunarodnog pakta o gospodarskim, socijalnim i kulturnim pravima i Europske konvencije o ljudskim pravima

Migration of People and Melodies in the Taiga Area of Southern Siberia

The article focuses on the song tradition of the Chalkans – a small Turkic-speaking population living in a taiga zone of southern Siberia. The main objectives are: analysis of archival collections; comparison of the results of this analysis with historical data; and possible reconstruction of the historical process of the spreading of melodies in the area.The introduction examines different concepts of transhumance as applied to cultural artefacts. This concept is then discussed with regard to the Chalkan culture. Natural, social, economic and historical contexts are briefly described prior to the analysis of Chalkan songs. After discussing materials and methodology, historical strata of the song tradition are described, and the category of lyric songs with modal tunes is examined in greater detail. A general description is provided of its grammar as well as the conceptualisation of the songs, followed by analysis of the distribution of two main versions of tunes (3H- or “major” and 3L- or “minor”) according to local and gender criteria.Preliminary conclusions are provided on the presence of two local traditions (Suranash, or Lebed’, and Kurmach-Baigol, or Baigol) and male and female performance styles.The article focuses on the song tradition of the Chalkans – a small Turkic-speaking population living in a taiga zone of southern Siberia. Проблемно-цільові засади стратегічного планування розвитку системи освіти регіону

У статті досліджується необхідність та особливості стратегічного планування освітнього розвитку на регіональному рівні з використанням наявних проблем у якості основи цілепокладання управлінської діяльності. На основі системного аналізу та виокремлення спільного і особливого у тенденціях освітнього розвитку на рівні країни та регіону визначаються базові проблеми стратегічного планування та управління. Здійснюється узагальнюючий аналіз розвитку регіональної системи освіти на прикладі Дніпропетровської області з виходом на постановку стратегічних цілей її реформування. Показано що основою стратегічного планування розвитку освіти є розроблення нового цілепокладання розвитку української освіти на базі цінностей демократичного суспільства, особистісного розвитку, спрямованості до європейського освітнього простору; створення каркаса нового законодавчого поля функціонування освіти;визначення засад рівного доступу кожного громадянина до якісної освіти всіх рівнів як магістральний напрям її розвитку; формування змісту освіти на основі державних стандартів як важеля управління якістю освіти в країні. Акцентуються проблеми стратегізації управління освітою на регіональному рівні та необхідність пов’язаних з цим інновацій у нормативно-організаційній царині. Показано що в основі освітньої парадигми має лежати завдання забезпечення потреб споживачів освітніх послуг, розширення можливостей доступу до якісної освіти, забезпечення ефективного соціального механізму конкурентоздатності випускників шкіл на сучасному ринку праці. На основі проведеного дослідження робляться пропозиції щодо удосконалення стратегічного планування розвитку основних складових регіональної системи освіти
