    Pembinaan yang dirasakan paling efektif untuk diberikan kepada narapidana dan tahanan adalah pembinaan keagamaan. Hal ini mengingat bahwa narapidana dan tahanan adalah manusia yang dirampas hak-hak kebebasannya, oleh karena itu mereka selalu dihinggapi perasaan gundah dan gelisah yang pada akhirnya melahirkan keputusasaan. Untuk menumbuhkan semangat hidup mereka perlu diberi pendalaman agama selama menjalani hukumannya. Penelitian ini dilakukan di Rumah Tahanan (Rutan) Kelas II B Banyumas dengan menggunakan metode deskriptif dimana peneliti menggambarkan secara menyeluruh model pembinaan narapidana di Rutan tersebut serta gagasan terkait penguatan atas model pembinaan narapidana dan tahanan di Rutan Kelas II B Banyumas. Pembinaan keagamaan bagi penghuni Rutan khususnya pembinaan keagamaan Islam dilakukan oleh petugas Rutan bekerja sama dengan Kementerian Agama Kabupaten Banyumas, meliputi kegiatan pengajian, latihan baca tulis Al Qur’an dan sholat berjamaah. Seiring dengan bertambahnya penghuni rutan dan kebutuhan akan kegiatan pendalaman agama maka diperlukan penguatan model pembinaan keagamaan Islam di Rutan Banyumas antara lain adalah pembentukan majelis taklim yang dikelola penghuni rutan.     Protection of Indonesian Migrant Workers (Pekerja Migran Indonesia, PMI) in Problems Abroad

    The lack of job opportunities in the country has pushed thousands of Indonesian citizens to seek work abroad. The Indonesian Migrant Workers Protection Agency (Badan Pelindungan Pekerja Migran Indonesia, BP2MI) released the placement of Indonesian Migrant Workers (Pekerja Migran Indonesia, PMI) in 2018 (April) period as many as 23,431 people and 2019 as many as 25,489 people. Meanwhile, the Central Statistics Agency (Badan Pusat Statistik, BPS) stated that 520 Indonesian Migrant Workers had problems in 2018 (April) period and 846 people in 2019. This study aims to determine the protection of Indonesian Migrant Workers who have problems abroad and the government's obstacles in protecting Indonesian Migrant Workers who have problems abroad. This study uses a normative juridical approach. That is the approach taken to legal materials, both primary, secondary, and tertiary legal materials by examining theories, concepts, legal principles, and laws and regulations related to this research. The results of this study are first, protection for Indonesian Migrant Workers who have problems abroad, namely technical protection in the form of providing shelter, juridical protection in the form of legal assistance to PMI who are in a legal process, and political protection in the form of bilateral agreements. between Indonesia and recipient countries regarding the placement and protection of PMIs. Second, the obstacles faced by the government in protecting PMIs are the lack of legal awareness of PMI candidates, the weakness of the supervisory system, the difficulty of registering PMIs in the destination country, and the difficulty of providing lawyers to assist PMIs who conflict with the law. To reduce problematic PMI cases abroad, local governments must realize the existence of a Migrant Workers Care Village (Desa Peduli Migrant Workers, DESBUMI) in every village.Keywords: Protection, Migrant Workers, Problem

    Law Enforcement on The Case Of Setting The Score in Soccer Competition (Comparative Study in Indonesia, Netherland, and Italy)

    Setting scores in football matches often occur whether coaches, players, or match officials do it. Several countries such as Italy, the Netherlands, and Indonesia already have regulations containing legal sanctions for these practices. This study used a normative juridical method obtained through a literature review, then analyzed qualitatively normative. This study aims to determine the law enforcement of scoring cases in soccer matches in Indonesia, the Netherlands, and Italy. The results showed that scoring arrangements in Indonesia could be acted upon under Law No. 20 of 2001 on amendments to Law No. 31 of 1999 concerning the Eradication of Corruption, while in the Netherlands, it used Wetboek van Strafrecht (Criminal Code) article 326, and in Italy regulated in Legge 13 dicembre 1989 n.401: truffa sportiva.Keywords: Score Setting, Football

    Perlindungan Hukum Terhadap Orang Utan Dari Perdagangan Ilegal

    Illegal trade in protected animals, including orangutans, is still rife in Indonesia, resulting in a decline in population from year to year. This study aims to analyze the legal protection of orangutans from illegal trade, based on Law Number 5 of 1990 concerning Conservation of Living Natural Resources and their Ecosystems and their inhibiting factors. The approach to the problem that will be used in this research is a normative juridical approach. The results of the study show that first, the number of orangutan populations has decreased due to illegal trade and there are several factors that hinder the protection of the orangutan population, such as logging, encroachment and road network expansion. The illegal trade in orangutans is something that must be considered because the punishment imposed on the perpetrators is still too light, with what they are doing. Therefore, the punishment and fines can be heavier so that the perpetrators are deterred. Stop forest hunting by tightening forest guarding and providing education about protected animals to the community.     LEGAL PROTECTION OF ABORTION ABUSERS IN THE PREGNANCY OF RAPE IN INDONESIA

    Abortion is prohibited except on the basis of indications of medical emergencies and pregnancy due to rape as regulated in Article 75 paragraph (2) of Law Number 36 the Year 2009 Concerning Health. Nevertheless, there are some cases where rape victims who abort their womb are found guilty of violating Article 346 of the Criminal Code. This study discusses the legal protection of abortionists in pregnancy due to rape. The purpose of this study was to analyze the legal protection of victims of rape who had an abortion (abortion provokes). The research method used is a normative juridical approach that is through literature studies that examine secondary data in the form of legislation and other legal documents, research results, results of studies, and other references. The results of this study are that rape victim who did an abortion were not convicted in accordance with Article 75 paragraph (2) of Law Number 36 of 2009 concerning Health and the existence of pre and post-abortion counseling in accordance with Article 37 of Government Regulation Number 61 of 2014 concerning Reproductive Health.Keywords: Legal protection, Abortion, the rape victi

    AbstractEvents that occur every year in parts of Indonesia, precisely when the dry season arrives, are forest and land fires (karhutla). In general, forest fires occur due to two factors, namely natural factors and human factors. Forest fires caused by natural factors usually occur through natural processes due to friction between dry tree organs, lightning strikes, and volcanic lava eruptions, thus triggering sparks which then gusts of wind in the forest to help forest and land fires occur. Forest fires caused by human factors occur due to unintentional and intentional processes. Humans can inadvertently do actions that cause forest and land fires such as throwing cigarette butts carelessly around the forest, leaving the rest of the fire in the forest without turning it off first. Kebakaran hutan yang disebabkan faktor alam biasanya terjadi melalui proses alami karena gesekan antara bagian organ pohon yang sudah kering, sambaran petir, dann letusan lahar gunung berapi, sehingga memicu percikan api yang kemudian hembusann angin di hutan membantu terjadinya kebakaran hutan dan lahan. Kebakaran hutan yang disebabkan faktor manusia terjadi karena proses tidak sengaja dan disengaja. Manusiaa secara tidak sengaja dapat melakukan perbuatan yang mengakibatkan kebakaran hutann dan lahan seperti membuang puntung rokok sembarangan di sekitar hutan, membiarkan sisa bakaran di hutan tanpa mematikannya terlebih dahulu.     AbstractForgery of letters/documents can be interpreted as an act that has the aim of imitating, creating an object that is no longer original or making an object lose its validity. Mixed marriages are regulated in Article 57 of Law Number 16 of 2019 concerning amendments to Law Number 1 of 1974 concerning Marriage. For the marriage to be registered, the conditions such as marriage documents must be met. If there is a forgery of mixed marriage documents, the marriage can be annulled. The cancellation of mixed marriages has an impact on the legal status of the marriage and the parties involved. Cases of falsification of mixed marriage documents that have occurred in Indonesia are those of the artist Jessica Iskandar who falsified her mixed marriage documents. The purpose of this study is to find out the legal consequences of falsifying mixed marriage documents in Indonesia (case studies of Jessica Iskandar and Ludwig Franz Willibald) and legal protection for children born.     This study aims to describe the various forms of acts that fall into the category of criminal acts of sexual violence. In addition, this research is directed to comprehensively examine what forms of legal protection for victims of sexual violence in Indonesia have been specifically regulated in Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence. Therefore, this research is designed using the normative juridical method. Where the main data comes from laws and regulations, legal concepts related to sexual violence. The approaches used are statute approach and conceptual approach. The results showed, first, there are twelve types of sexual violence criminal offenses regulated in the TPKS Law. Second, Victims are entitled to Handling, Protection, and Recovery since the occurrence of Sexual Violence Crimes.     Malaysia’s Indisputable Sovereignty Over Sabah

    On Jan 22, 1878, an agreement was signed between the Sultan of Sulu with two British agents, Alfred Dent, and Baron von Overbeck, ceding North Borneo to the British in return for the payment of cession money of 5,000 Malayan dollars annually to the Sultan. The payment was increased to 5,300 dollars per year when nearby islands from Banggi Island to Sibuku Bay were also ceded. Sabah was briefly placed under Japanese rule during World War II and later reverted back to British rule upon Japanese surrender in 1945. Sabah remained a British crown colony until it gained independence within Malaysia in 1963. As a component state of the Federation, Malaysia has invested billions of Ringgit to develop Sabah, establishing a working government to administer this territory. The heirs of the forgone Sulu Sultanate have not done much to display that they are in fact the sovereign rulers of Sabah. This article discusses on the recent issue pertaining to the ‘Sulu state arbitration’ requesting Malaysia to pay compensation to the heirs of the Sulu Sultanate for exercising sovereignty over Sabah from the purview of international law and state sovereignty.  The heirs of the defunct Sulu Sultanate are adamant that Sabah is still ‘part of their territory’. This article concludes that Sabah is recognized globally as part of Malaysia, in no way Malaysia is obliged to entertain claims of descendants of a long-lost sovereign.
