    From the analytical point of view of Hegel\u27s philosophical anthropology, in Kojùve\u27s interpretation, work is an existential structure through which the dual process of subjectification and socialization unfolds. For Hegel, however, this process is not taken for granted: its possibility is understood in terms of the culmination of man\u27s conquest of humanity, taking as a point of departure the relation of mastery to servitude and the undertaking to transform this relation precisely from within the perspective of servitude. The goal of this article is to reconstruct the conceptual framework of this philosophical moment, to our mind an indispensible precondition for the apperception of our modern societies\u27 functioning at the most fundamental level, to the extent that they consider themselves to be ‘work based societies

    Troubles with Hiibel: How the Court Inverted the Relationship between Citizens and the State

    This essay shows why the Supreme Court’s decision in Hiibel v. Sixth Judicial District of Nevada violates precedent, the Constitution, and the very basis for the relationship between government and the governed. First, the Court has violated the clear limits Terry v. Ohio set on the restricted searches based on reasonable suspicion within the restrictions of the Fourth and Fifth Amendments. By using the power of the state to compel citizens to produce identification, it also violates the First, Fourth, and Fifth Amendments as well as the unenumerated rights that conceptually link the enumerated rights in the Court’s jurisprudence. Finally, this country was founded on the belief that government has to justify itself to the citizens, and the Hiibel decision inverts this relationship. To rectify these transgressions, we argue that the Court should return to the bright-line rule articulated in Terry: The officer may ask; the suspect may remain silent

    International audienceThe present study aims at providing an analysis of Jean-François Lyotard’s criticism of Marx theory of the wage-capital conflict, as it is presented in The Differend: Phrases in Dispute (1983). We uphold that Lyotard’s analysis is important and original in many respects. First, it introduces into philosophical criticisms of Marx some considerations on the theory of language. Second, it deals with the wage-capital conflict as a Kantian Idea, made of some irreducible part—“an intractable wrong” done by one party (the Capital) to another (the Workers—, which cannot be expressed within a common language. The article reflects on the nature and consequences of Lyotard’s criticism for Marxist studies.Dans cet article, nous revenons sur la critique de la thĂ©orie marxiste du salariat par Jean-François Lyotard dans Le DiffĂ©rend(1983). Nous y soutenons que l’analyse de Lyotard est importante Ă  plusieurs titres. D’abord parce que Lyotard introduit dans la critique philosophique du marxisme des considĂ©rations sur le langage. Ensuite parce que Lyotard thĂ©orise le rapport salarial comme «tort intraitable» infligĂ© par une partie (le capital) sur une autre (le travail), identifiant donc le «diffĂ©rend» salarial Ă  une IdĂ©e au sens kantien.     Randomized Controlled Trial of Ondansetron vs. Prochlorperazine in Adults in the Emergency Department

    Objective: To compare the effectiveness of ondansetron and prochlorperazine to treat vomiting. Secondary objectives were the effectiveness of ondansetron and prochlorperazine to treat nausea and their tolerability.Methods: This was a prospective, randomized, active controlled, double-blinded study. Using a convenience sample, patients were randomized to either intravenous ondansetron 4mg (n=32) or prochlorperazine 10mg (n=32). The primary outcome was the percentage of patients with vomiting at 0-30, 31-60, and 61-120 minutes after the administration of ondansetron or prochlorperazine. Secondary outcomes were nausea assessed by a visual analog scale (VAS) at baseline, 0-30, 31-60, and 61-120 minutes after the administration of ondansetron or prochlorperazine and the percentage of patients with adverse effects (sedation, headache, akathisia, dystonia) to either drug. We performed statistical analyses on the VAS scales at each time point and did a subgroup analysis to examine if nausea scores were affected if the patient had vomited at baseline.Results: The primary identified cause for nausea and vomiting was flu-like illness or gastroenteritis (19%). The number of patients experiencing breakthrough vomiting at 0-30, 31-60, and 61-120 minutes was similar between groups for these time periods; however, more patients receiving ondansetron experienced vomiting overall (7 [22%] vs. 2[3.2%] patients, p=not significant). Nausea scores at baseline and 0-30 minutes were severe and similar between groups; however, at 31-60 and 61-120 minutes, patients receiving prochlorperazine had better control of nausea (24.9 vs. 43.7 mm, p=0.03; 16.8 vs. 34.3 mm, p=0.05). Sedation scores were similar between groups. There were no cases of extrapyramidal symptoms as assessed by the treating physician and there were four cases of akathisia (prochlorperazine=3 [9%], ondansetron=1[3%]).Conclusion: Prochlorperazine and ondansetron appear to be equally effective at treating vomiting in the emergency department.     La RSE : nouvelle forme de dé-marchandisation du monde ?

    Le mouvement dit de « RSE » entend concilier l’actuel mode d’accumulation Ă  dominante financiĂšre avec certaines exigences sociales et environnementales. Or, ce mouvement s’inscrit assez bien dans l’analyse historique et institutionnaliste que Karl Polanyi a faite des limites de la marchandisation du monde. En effet, ce mouvement consiste Ă  revenir sur la trop forte marchandisation du rapport Ă  la nature et au travail qu’aurait entraĂźnĂ© le dĂ©veloppement d’un capitalisme financiarisĂ©. En rĂ©action, ce mouvement mobilise l’engagement volontaire des entreprises pour bĂątir une nouvelle « grande transformation », c’est-Ă -dire une forme inĂ©dite d’articulation entre le juste et l’efficace visant Ă  assurer la viabilitĂ© du capitalisme. Cela revient Ă  Ă©largir l’engagement Ă©conomique Ă  autre chose que la simple maximisation des intĂ©rĂȘts individuels de court terme. Cet article vise Ă  exploiter cette proximitĂ© entre le mouvement de la RSE et l’analyse polanyienne de la marchandisation, proximitĂ© selon nous fructueuse et qui n’a jamais fait l’objet d’une analyse systĂ©matique. L’enjeu est de dĂ©terminer dans quelle mesure la RSE constitue aujourd’hui une rĂ©ponse pertinente Ă  la nĂ©cessaire gestion collective de la fiction que constitue la marchandisation apparente de la monnaie, de la terre et du travail.The movement says about “CSR” tries to reconcile the current financial mode of accumulation with certain social and environmental requirements. This movement joins well enough in the historic and institutionnalist analysis which Karl Polanyi made of the limits of marchandisation of the world. Indeed, this movement consists in returning on excess strong marchandisation of the relationship with the nature and with the work which would have pulled the new capitalism. In reaction, this movement mobilizes the individual commitment to build a new “great transformation”, that is new articulation between social justice and efficacity to assure the viability of the capitalism. It means extending economic comportment in the other thing than the simple maximization of the short-term individual interests. This article aims at exploiting this nearness between the movement of the CSR and the analysis. The stake is to determine in which measure the CSR constitutes a relevant answer to the necessary collective management of the fiction which establishes the apparent marchandisation of money, labour and nature
