    Sirius XM Radio, Inc., Defendant: The Case for a Unified Federal Copyright System for Sound Recordings

    This article observes the surviving gap between state and federal protection of music recordings through the lens of the current litigation against Sirius XM. Part II sets out a history of copyright protection in the music industry. Part III outlines the relevant provisions of the federal Copyright Act and the Digital Millennium Copyright Act and the role played in the federal system by the Copyright Royalty Board. Part IV examines the pertinent statutory property protection of music recordings in the state of California. Part V then discusses the merits of the current lawsuits against Sirius XM. After considering the potential legal and economic ramifications of the current lawsuits, Part VI then concludes by advocating for a unified federal system of copyright protection for all sound recordings regardless of the date on which they were originally fixed

    Trade Centrality and the Process of Economic Sanctions

    Some scholars have suggested that sanctions are doing more than meets the eye (Drezner 2003). Sanctions may indeed be a signaling mechanism that states use to indicate where they stand on an issue or the foreign policy of another state. We agree with this analysis, but find current explanations of sanctions episodes inadequate. In order to make the argument that states use sanctions as a signaling mechanism it is necessary to know something about the states and their position in the international community. We employ network analysis to understand what international trade networks look like and to determine which actors in the network are utilizing sanctions and who they are sanctioning. This helps us to get a better handle on what exactly it is that states are trying to do when they impose sanctions. We argue that sanctions more than simply signals of states\u27 policy preferences. Indeed, sanctions are a tool that central states use to promote regimes and enforce norms within those regimes. A sanction against a partner state within a trade regime, for example, flags a violation of norms and thereby strengthens the norm and the regime. We test our explanation using a logistic regression on thirty years of sanctions episodes. In support of our theory, we find that the most economically central states are threatening and imposing as well as receiving sanctions at an exponential rate compared to non-central states

    The Ransom and Sarah Williams Farmstead: Post-Emancipation Transitions of an African American Family in Central Texas Vol. 1

    In conjunction with the proposed construction of the southwest segment of State Highway 45 in southern Travis County, the Texas Department of Transportation sponsored archeological testing and data recovery efforts at the Ransom Williams farmstead. Prewitt and Associates, Inc., conducted an interdisciplinary community-based historic archeological study of the farmstead from 2005 through 2011. Extensive archival research reveals that the 45-acre farm was owned and occupied by Ransom Williams and his wife Sarah, both former slaves, from about 1871 to ca. 1905. The Williams family lived in the predominantly white rural community of Bear Creek, but they had connections to the nearby freedmen communities of Antioch Colony in northern Hays County and Manchaca in southern Travis County. The stories of the Ransom Williams family and their connections to these communities are enhanced by extensive oral history research, with over 46 hours of taped and transcribed interviews with 27 descendant community members. Data recovery investigations focused on a landscape archeological study to define the layout and design of the entire farmstead, including a stock pond and a network of dry-laid rock walls that facilitated water drainage, demarcated property boundaries, and formed livestock pens. Intensive hand excavations were used to examine features associated with the Williams house, outbuildings and activity areas, and a large trash midden. This work recovered more than 26,000 artifacts. They constitute an impressive material culture assemblage that is associated, with few exceptions, with the Williams family tenure on the land. The combined archival data, oral history interviews, and archeological evidence tell the fascinating story of how one African American farm family lived and thrived in central Texas during Reconstruction and into the Jim Crow era

    Crossâ Sectional Psychological and Demographic Associations of Zika Knowledge and Conspiracy Beliefs Before and After Local Zika Transmission

    Perceptions of infectious diseases are important predictors of whether people engage in diseaseâ specific preventive behaviors. Having accurate beliefs about a given infectious disease has been found to be a necessary condition for engaging in appropriate preventive behaviors during an infectious disease outbreak, while endorsing conspiracy beliefs can inhibit preventive behaviors. Despite their seemingly opposing natures, knowledge and conspiracy beliefs may share some of the same psychological motivations, including a relationship with perceived risk and selfâ efficacy (i.e., control). The 2015â 2016 Zika epidemic provided an opportunity to explore this. The current research provides some exploratory tests of this topic derived from two studies with similar measures, but different primary outcomes: one study that included knowledge of Zika as a key outcome and one that included conspiracy beliefs about Zika as a key outcome. Both studies involved crossâ sectional data collections that occurred during the same two periods of the Zika outbreak: one data collection prior to the first cases of local Zika transmission in the United States (Marchâ May 2016) and one just after the first cases of local transmission (Julyâ August). Using ordinal logistic and linear regression analyses of data from two time points in both studies, the authors show an increase in relationship strength between greater perceived risk and selfâ efficacy with both increased knowledge and increased conspiracy beliefs after local Zika transmission in the United States.     A Single Dose of the DENV-1 Candidate Vaccine rDEN1Δ30 Is Strongly Immunogenic and Induces Resistance to a Second Dose in a Randomized Trial

    Dengue is an emerging infectious disease that has become the most important arboviral infection worldwide. There are four serotypes of dengue virus, DENV-1, DENV-2, DENV-3, and DENV-4, each capable of causing the full spectrum of disease. rDEN1Δ30 is a live attenuated investigational vaccine for the prevention of DENV-1 illness and is also a component of an investigational tetravalent DENV vaccine currently in Phase I evaluation. A single subcutaneous dose of rDEN1Δ30 was previously shown to be safe and immunogenic in healthy adults. In the current randomized placebo-controlled trial, 60 healthy flavivirus-naive adults were randomized to receive 2 doses of rDEN1Δ30 (N = 50) or placebo (N = 10), either on study days 0 and 120 (cohort 1) or 0 and 180 (cohort 2). We sought to evaluate the safety and immunogenicity of this candidate vaccine in 50 additional vaccinees and to test whether the humoral immune response could be boosted by a second dose administered 4 or 6 months after the first dose. The first dose of vaccine was well tolerated, infected 47/50 vaccinees and induced seroconversion in 46/50 vaccinees. Irrespective of dosing interval, the second dose of vaccine was also well tolerated but did not induce any detectable viremia or ≥4-fold rise in serum neutralizing antibody titer.Only five subjects had an anamnestic antibody response detectable by ELISA following a second dose of vaccine, demonstrating that the vaccine induced sterilizing humoral immunity in most vaccinees for at least six months following primary vaccination.The promising safety and immunogenicity profile of this vaccine confirms its suitability for inclusion in a tetravalent dengue vaccine
