Classroom Taping Under Legal Scrutiny—A Road Map for a Law School Policy

Technological advances have made law school administrations, faculties, and students increasingly interested in recording class sessions. Administrators gain significant flexibility if class recordings are readily available to mitigate weather, transportation, medical, or other unexpected emergencies. Faculty members appreciate students\u27 enhanced comprehension of material following their subsequent study of the in-class proceedings. Students with disabilities and those who want more opportunities for content review benefit from access to recordings. Despite those acknowledged advantages, there are legal parameters for class recordings that have not previously been addressed in the literature. Existing legal constraints on class recording by any law school stakeholder include federal and state wiretapping laws, federal statutes protecting students with disabilities, privacy protections, and copyright provisions. In addition, the unique pedagogical objectives of law school education, designed to prepare professional advocates, further complicate the development of an effective taping policy. This Article reviews the significant legal issues inherent in various classroom taping scenarios and then offers law schools a framework for adoption of a cohesive class recording policy consistent with legal norms

Reading the Pink Locker Room: On Football Culture and Title IX

This article examines the public controversy that erupted after local media reported on a comment I made about the University of Iowa\u27s decision to renovate the football stadium\u27s visiting team locker room entirely in pink. I submitted my statement in response to the University Steering Committee on NCAA Certification\u27s request for feedback on a draft report and suggested that the joke behind the pink d6cor traded in sexist and homophobic values. As such, I concluded that it belonged in the comprehensive analysis of gender equity that the committee was preparing. I immediately received hundreds of hateful e-mails and was the subject of thousands of invidious online postings. The content of these messages intrigued the national media, whose reporting fueled the controversy for several months. The controversy serves as a barometer of cultural values at the intersection of feminism and football that are both disappointing and useful to scholars and advocates of Title IX. The reaction to my statement from both within and beyond the Hawkeye Nation proves how deeply hegemonic patriarchal ideology is entrenched in football culture. Compromises involving football are often necessary to resolve gender disparities in college athletics, so this evidence suggests that cultural values must change before the guarantees of Title IX can ever be fully realized
