La circulation des normes dans le domaine du blanchiment dâargent : le rĂŽle du G7/8 dans la crĂ©ation dâun rĂ©gime global
Cet article se propose dâanalyser le rĂŽle du G7/8 dans le rĂ©gime global anti-blanchiment dâargent. Il sâattache Ă dĂ©gager les mĂ©canismes de cette instance mal connue qui ont contribuĂ© Ă la mise en place de normes au niveau international contre le blanchiment dâargent, et plus rĂ©cemment contre le financement du terrorisme. En ce sens, il sera montrĂ© comment des normes particuliĂšres ont circulĂ© sur la scĂšne internationale, entre diverses institutions, et notamment entre lâUnion europĂ©enne et le G7/8. Cette circulation a Ă©tĂ© largement facilitĂ©e par des acteurs engagĂ©s dans cette mobilisation anti-blanchiment, et plus particuliĂšrement ces « experts » des administrations publiques des pays membres de ces institutions. Une approche sociologique permettra de mettre en valeur les trajectoires professionnelles de ces experts, trajectoires qui expliquent ces lignes de convergence, mais aussi de clivage qui ont façonnĂ© le rĂ©gime global anti-blanchiment tel quâil apparaĂźt aujourdâhui.This article aims at describing the role of the G7/8 in the anti-money laundering global regime. It will provide an insight of the G7/8 mechanisms that are often not clearly understood and have contributed to the elaboration of norms against money laundering and, more recently, terrorist financing. The goal is then to give an understanding of those specific norms, which have circulated among several international institutions, in particular in the European Union and the G7/8. The diffusion of these norms has been facilitated by actors engaged in the global mobilisation against money-laundering, specifically by those âexpertsâ of Member Statesâ public administrations. A sociological approach will be used to look at these expertsâ professional background, highlighting convergences, but also divergences that have framed the existing anti-money laundering global regime

National Security and Secret Evidence in Legislation and before the Courts: Exploring the Challenges. CEPS Liberty and Security in Europe No. 78/January 2015
This study provides a comparative analysis of the national legal regimes and practices governing the use of intelligence information as evidence in the United Kingdom, France, Germany, Spain, Italy, the Netherlands and Sweden. It explores notably how national security can be invoked to determine the classification of information and evidence as 'state secrets' in court proceedings and whether such laws and practices are fundamental rights- and rule of law-compliant. The study finds that, in the majority of Member States under investigation, the judiciary is significantly hindered in effectively adjudicating justice and guaranteeing the rights of the defence in ânational securityâ cases. The research also illustrates that the very term ânational securityâ is nebulously defined across the Member States analysed, with no national definition meeting legal certainty and âin accordance with the lawâ standards and a clear risk that the executive and secret services may act arbitrarily. The study argues that national and transnational intelligence community practices and cooperation need to be subject to more independent and effective judicial accountability and be brought into line with EU 'rule of law' standards

La criminalitĂ© transnationale organisĂ©e (CTO) est devenue un Ă©lĂ©ment majeur des agendas des institutions internationales. La mobilisation de la communautĂ© internationale a donnĂ© lieu Ă un nombre impressionnant de rĂ©ponses institutionnelles Ă ce qui a Ă©tĂ© dĂ©crit comme un dĂ©fi dâenvergure mondiale. Lâagenda JAI de lâUE nâa pas fait exception, et a constamment inclus la lutte contre la CTO au rang de ses prioritĂ©s depuis le milieu des annĂ©es 1990. Afin de comprendre lâĂ©tat actuel de la stratĂ©gie de lâUE contre la criminalitĂ© organisĂ©e, et en tenant compte des derniers dĂ©veloppements en la matiĂšre, cet article examine successivement le cadre lĂ©gal de lâUE, ainsi que ses mĂ©canismes de coopĂ©ration, et notamment le rĂŽle et le mandat dâEuropol et dâEurojust.Transnational Organised Crime (TOC) has risen up on international institutionsâ agenda. The international communityâs mobilisation against organised crime has led to an impressive elaboration of institutional responses to what has been depicted as a global challenge. The EU JHA agenda has not been an exception, which has constantly addressed this issue since the middle of the 1990s. In order to understand the current state of the EU strategy against organised crime, this article examines the existing EU legislative framework, as well as the European justice and police co-operation mechanisms (specifically the role and mandate of Europol and Eurojust)
