    The Object and Purpose of a Treaty: Three Interpretive Methods

    This Article examines the three most prominent uses of the term object and purpose within the Vienna Convention on the Law of Treaties and, in each instance, offers a new method for applying the term. First, the rule that a treaty be interpreted in light of its object and purpose requires a process of interpretation that oscillates between a treaty\u27s individual provisions and the logic of all its provisions as a whole. Second, for reservations, the term exists to preserve rule coherence[,] as that term has been developed by Professor Thomas Franck. Lastly, states are required upon signature not to defeat the object and purpose of a treaty, and this rule is best understood as a means of facilitating domestic legislative review of new treaties by preserving the status quo at the time of signature. In sum, this Article examines a term of art that has perplexed scholars and practitioners for decades, and, in three specific contexts, it offers an understanding of the term refined beyond what other writers have offered

    Genetic islands of Streptococcus agalactiae strains NEM316 and 2603VR and their presence in other Group B Streptococcal strains

    BACKGROUND: Streptococcus agalactiae (Group B Streptococcus; GBS) is a major contributor to obstetric and neonatal bacterial sepsis. Serotype III strains cause the majority of late-onset sepsis and meningitis in babies, and thus appear to have an enhanced invasive capacity compared with the other serotypes that cause disease predominantly in immunocompromised pregnant women. We compared the serotype III and V whole genome sequences, strains NEM316 and 2603VR respectively, in an attempt to identify genetic attributes of strain NEM316 that might explain the propensity of strain NEM316 to cause late-onset disease in babies. Fourteen putative pathogenicity islands were described in the strain NEM316 whole genome sequence. Using PCR- and targeted microarray- strategies, the presence of these islands were assessed in a diverse strain collection including 18 colonizing isolates from healthy pregnant women, and 13 and 8 invasive isolates from infants with early- and late-onset sepsis, respectively. RESULTS: Side-by-side comparison of the strain NEM316 and strain 2603VR genomes revealed that they are extremely similar, with the only major difference being the capsulation loci and mobile genetic elements. PCR and Comparative Genome Hybridization (CGH) were used to define the presence of each island in 39 GBS isolates. Only islands I, VI, XII, and possibly X, met criteria of a true pathogenicity island, but no significant correlation was found between the presence of any of the fourteen islands and whether the strains were invasive or colonizing. Possible associations were seen between the presence of island VI and late-onset sepsis, and island X and early-onset sepsis, which warrant further investigation. CONCLUSION: The NEM316 and 2603VR strains are remarkable in that their whole genome sequences are so similar, suggesting that the capsulation loci or other genetic differences, such as pathogenicity islands, are the main determinants of the propensity of serotype III strains to cause late-onset disease. This study supports the notion that GBS strain NEM316 has four putative pathogenicity islands, but none is absolutely necessary for disease causation, whether early- or late-onset sepsis. Mobile genetic elements are a common feature of GBS isolates, with each strain having its own peculiar burden of transposons, phages, integrases and integrated plasmids. The majority of these are unlikely to influence the disease capacity of an isolate. Serotype associated disease phenotypes may thus be solely related to differences in the capsulation loci

    InSight Aerothermal Environment Assessment

    The Mars Interior Exploration using Seismic Investigations, Geodesy and Heat Transport (InSight) spacecraft, which successfully touched down on the planet surface on November 26, 2018, was proposed as a near build-to-print copy of the Mars Phoenix vehicle to reduce the overall cost and risk of the mission. Since the lander payload and the atmospheric entry trajectory were similar enough to those of the Phoenix mission, it was expected that the Phoenix thermal protection material thickness would be sufficient to withstand the entry heat load. However, allowances were made for increasing the heatshield thickness because the planned spacecraft arrival date coincided with the Mars dust storm season. The aftbody Thermal Protection System (TPS) components were not expected to change. In a first for a US Mars mission, the aerothermal environments for InSight included estimates of radiative heat flux to the aftbody from the wake. The combined convective and radiative heat fluxes were used to determine if the as-flown Phoenix thermal protection system (TPS) design would be sufficient for InSight. Although the radiative heat fluxes on the aftbody were predicted to be comparable to, or even higher than the local convective heat fluxes, all analyses of the aftbody TPS showed that the design would still be adequate. Aerothermal environments were computed for the vehicle from post-flight reconstruction of the atmosphere and trajectory and compared with the design environments. These comparisons showed that the predicted as-flown conditions were less severe than the design conditions

    Where is the best site on Earth? Domes A, B, C and F, and Ridges A and B

    The Antarctic plateau contains the best sites on earth for many forms of astronomy, but none of the existing bases was selected with astronomy as the primary motivation. In this article, we try to systematically compare the merits of potential observatory sites.We include South Pole, Domes A, C, and F, and also Ridge B (running northeast from Dome A), and what we call "Ridge A" (running southwest from Dome A). Our analysis combines satellite data, published results, and atmospheric models, to compare the boundary layer, weather, aurorae, airglow, precipitable water vapor, thermal sky emission, surface temperature, and the free atmosphere, at each site. We find that all Antarctic sites are likely to be compromised for optical work by airglow and aurorae. Of the sites with existing bases, Dome A is easily the best overall; but we find that Ridge A offers an even better site. We also find that Dome F is a remarkably good site. Dome C is less good as a thermal infrared or terahertz site, but would be able to take advantage of a predicted "OH hole" over Antarctica during spring.Comment: Revised version. 16 pages, 21 figures (22 in first version).     Trauma and Trichotillomania: A Tenuous Relationship

    Some have argued that hair pulling in trichotillomania (TTM) is triggered by traumatic events, but reliable evidence linking trauma to TTM is limited. However, research has shown that hair pulling is associated with emotion regulation, suggesting a connection between negative affect and TTM. We investigated the associations between trauma, negative affect, and hair pulling in a cross-sectional sample of treatment seeking adults with TTM (N=85). In the current study, participants’ self-reported traumatic experiences were assessed during a structured clinical interview, and participants completed several measures of hair pulling severity, global TTM severity, depression, anxiety, experiential avoidance, and quality of life. Those who experienced trauma had more depressive symptoms, increased experiential avoidance, and greater global TTM severity. Although the presence of a trauma history was not related to the severity of hair pulling symptoms in the past week, depressive symptoms mediated the relationship between traumatic experiences and global TTM severity. These findings cast doubt on the notion that TTM is directly linked to trauma, but suggest that trauma leads to negative affect that individuals cope with through hair pulling. Implications for the conceptualization and treatment of TTM are discussed

    Implementation of a national HIV pre-exposure prophylaxis service is associated with changes in characteristics of people with newly diagnosed HIV: a retrospective cohort study

    OBJECTIVES: To review characteristics of individuals newly diagnosed with HIV following implementation of a national pre-exposure prophylaxis (PrEP) programme (comprehensive PrEP services, delivered in sexual health clinics) to inform future delivery and broader HIV prevention strategies. METHODS: We extracted data from national HIV databases (July 2015–June 2018). We compared sociodemographic characteristics of individuals diagnosed in the period before and after PrEP implementation, and determined the proportion of ‘potentially preventable’ infections with the sexual health clinic–based PrEP delivery model used. RESULTS: Those diagnosed with HIV before PrEP implementation were more likely to be male (342/418, 81.8% vs 142/197, 72.1%, p=0.005), be white indigenous (327/418, 78.2% vs 126/197, 64.0%, p<0.001), report transmission route as sex between men (219/418, 52.4% vs 81/197, 41.1%, p=0.014), and have acquired HIV in the country of the programme (302/418, 72.2% vs 114/197, 57.9% p<0.001) and less likely to report transmission through heterosexual sex (114/418, 27.3% vs 77/197, 39.1%, p=0.002) than after implementation. Pre-implementation, 8.6% (36/418) diagnoses were ‘potentially preventable’ with the PrEP model used. Post-implementation, this was 6.6% (13/197), but higher among those with recently acquired HIV (49/170, 28.8%). Overall, individuals with ‘potentially preventable’ infections were more likely to be male (49/49, 100% vs 435/566, 76.9%, p<0.001), aged <40 years (37/49, 75.5% vs 307/566, 54.2%, p=0.004), report transmission route as sex between men (49/49, 100% vs 251/566, 44.3%, p<0.001), have previously received post-exposure prophylaxis (12/49, 24.5% vs 7/566, 1.2%, p<0.001) and less likely to be black African (0/49, 0% vs 67/566, 11.8%, p=0.010) than those not meeting this definition. CONCLUSIONS: The sexual health clinic–based national PrEP delivery model appeared to best suit men who have sex with men and white indigenous individuals but had limited reach into other key vulnerable groups. Enhanced models of delivery and HIV combination prevention are required to widen access to individuals not benefiting from PrEP at present
