Europol's crime analysis system - practical determinants of its success
Threats to modern nation states from organised crime and terrorism create environments in which intelligence becomes a vital component of policing and security plans but the increasing use of personal data for law enforcement purposes can alter the normative relationships between stakeholders and law enforcement agencies and between agencies and citizens. For that reason, police intelligence practice demands critical examination. This paper presents a narrative inquiry, based on the authors’ experiential knowledge and empirical research, into Europol’s Crime Analysis System (ECAS). The study explains Europol’s efforts to develop data collection and analysis systems that meet the needs of EU Member States. Through ECAS, it has created powerful tools intended to deliver intelligence products that help Member States identify, localise and neutralize transnational threats to a degree not witnessed before in Europe. Nevertheless, Europol’s performance in this context seems sub-optimal. Shortcomings largely are attributed to a lack of trust between Europol and Member States leading to failures to share information between themselves and with the institution. The result is that the latter’s strategic intelligence products sometimes are deficient or incomplete. That should be of concern to stakeholders because Europol’s strategic intelligence efforts may be rendered ineffective. Shortcomings in Europol’s intelligence products also are significant for citizens because they may mean that the information-sharing process is less transparent and less accountable than citizens have a right to expect
The Path to Enlightenment: Limiting Costs and Maximizing Returns from Intelligence-Led Policy and Practice in Public Policing
Intelligence-led policing’s (ILP) promise to reform policing has attracted many to its cause. Based on empirical research, this paper challenges the validity of some of its claims and explains the ways that ILP may most fruitfully be employed. The research found that the success or failure of ILP depends on people and not on the ILP technologies, organizational structures, or processes that routinely receive attention. ILP may make perfect business sense in principle but human factors will always mitigate its prospects. Justifiably, ILP is the preferred strategy for combating organized crime or ‘professional’ criminals; the cost of investigations and intrusions into privacy can more readily be warranted. In the policing mainstream, an acceptable return on investment in those same methods is unlikely because the professional skills and specialist resources required to service them are in such short supply. Moreover, in liberal democracies their use is much more difficult to justify in social worlds that, properly, lie largely beyond the institutions’ control

Artykuł przedstawia zasadnicze uwarunkowania prawne, organizacyjne i techniczne
współpracy Polski w ramach Interpolu. Scharakteryzowano tu krajowe ramy
prawne wymiany informacji kryminalnych, poszukiwań osób oraz sprawdzeń zasobów
informacyjnych w ramach tej organizacji. Poruszona problematyka jest zagadnieniem
skomplikowanym z powodu specyfiki działań prowadzonych przez Interpol oraz jego
umiejscowienia w systemie instytucjonalnym społeczności międzynarodowej. W artykule
zwrócono uwagę na korzyści wynikające z metod i form międzynarodowego współdziałania
Polski w tym zakresie.The article presents the main legal, organistaional and technical problems related
to the cooperation beetwen Poland and Interpol. The article describes national legal frameworks
of exchanging criminal intelligence, police searches of persons and checks of
Interpol databases. The presented issue is extremely complex due to the specific nature
of the activities carried out by Interpol and its unique position in the institutional system
of the international community. Article draws the attention to possible benefits from such
forms of international cooperation in combating crime
Rozpracowywanie działalności terrorystycznej w ramach Europolu – uwarunkowania prawne i praktyczne
The article discusses the role of Europol in dismantling terrorist activity. Dismantling is a key step in the materializing by law enforcement forensics’ functions: reconnoitring, detecting and preventing. The legal power of Europol to detect terrorism threats arise directly from the Treaty on the Functioning of the European Union. From the forensics point of view, Europol dismantling potential on terrorist activity is based on special analytical databases called analysis working files (AWFs). In this model, information and intelligence are collected, processed and exchanged with respect to strictly defined threats (persons, criminal groups, terrorist organizations) to support operational cases or penal proceedings conducted by EU Member States national police authorities.W artykule omówiono rolę Europolu w rozpracowywaniu działalności terrorystycznej. Rozpracowanie jest najważniejszą formą działań, w której materializują się funkcje kryminalistyki: rozpoznawanie, wykrywanie i zapobieganie. Uprawnienia operacyjne Europolu dotyczące rozpoznawania, wykrywania i zapobiegania terroryzmu wynikają bezpośrednio z Traktatu o funkcjonowaniu Unii Europejskiej. Z punktu widzenia taktyki kryminalistycznej, potencjał antyterrorystyczny Europolu jest oparty na specjalnych analitycznych bazach danych (AWF). W omawianym modelu informacje i dane wywiadowcze są gromadzone, przetwarzane i wymieniane w odniesieniu do ściśle określonych zagrożeń terrorystycznych (osób, grup przestępczych, organizacji terrorystycznych) w celu wsparcia spraw operacyjnych lub postępowań karnych prowadzonych przez krajowe organy policyjne państw członkowskich UE
Europolo antiteroristinių operacijų vykdymo sąlygos
Europol is the main platform of EU Member States crime intelligence cooperation, which use the information potential and experience of EU Member States national security agencies. The cooperation is vital for the public security of the EU area - understood as a form of multilateral international connections and channels of exchanging criminal information between national police forces, special services and other state and EU institutions responsible for public security. Europol has been present in policing for over 20 years, but its power to combat terrorism is still relatively unknown. In recent years there were many changes in the legal framework of Europol.
To enhance Europol's mandate as the EU's central law enforcement agency and enable it to respond more rapidly to emerging international terrorist threats and serious and organised crime, the European Commission proposed a new regulation being line with the Lisbon Treaty. The proposal aimed to place the Agency under a new legislative framework and enhance its role as the central hub for information exchange. The new Regulation entered into force on 13 June 2016 and is being aplicated since 1 May 2017.
The author presents the analyses of conditions influencing on Europol‘s force in combating terrorist threats. The issue is extremly complex due to Europol specific legal status, scope of operations and its location within the institutional system.Straipsnio tikslas yra susisteminti žinias apie Europolo slaptą veiklą siekiant kovoti su tarptautiniu terorizmu. Straipsnyje pateikiama keletas Europolo veiklos pavyzdžių, kuriomis Europolas remia ES valstybių narių atitinkamų tarnybų pastangas kovoje su terorizmu ir jo prevencijos srityje. Taip pat autorius įvertina šias veiklas, ką nėra lengva padaryti, atsižvelgiant į ypatingą Europolo slaptų veiklų prigimtį ir svarbą, ir jo vietą ES institucinėje sistemoje
Effectiveness of Europol’s covert activities in combating international terrorism – an attempt of assessment
Artykuł jest próbą usystematyzowania wiedzy na temat roli Europolu w zwalczaniu
terroryzmu międzynarodowego. Przedstawiono tu uwarunkowania wewnętrzne
i zewnętrzne działań agencji, która wspiera pracę służb państw członkowskich ukierunkowaną
na przeciwdziałanie zagrożeniom terrorystycznym. Podjęto też próbę oceny
efektywności tych działań, co jest zadaniem nadzwyczaj skomplikowanym z powodu
specyfiki działania Europolu, zakresu działań prowadzonych przez tę agencje oraz jej
umiejscowienia w systemie instytucjonalnym UE.The aim of the article is an attempt at systematizing the knowledge about the role
of Europol’s covert activities in combating international terrorism. The article contains
a few examples of the Agency’s activities supporting the tasks of services of EU Member
States aiming at preventing terrorist threats. Moreover, the author has made an attempt
to evaluate those activities which is a rather complicated task, taking into consideration
the special role of the Europol’s covert activities and its placement in the institutional
system of the EU
Interpol’s operational activities – an attempt to systemize and assess the effectiveness
The article is an attempt to systematize operational activities of Interpol and to assess its effectiveness in combating cross-border crime. There is no doubt that the effectiveness of the Interpol is strictly related to its legal status. In fact, legal framework of Interpol activity cannot be considered optimal as far as international public law is concerned. Furthermore, secondary legislation of Interpol does not have a direct impact on the national law of individual Member States. The topic of the mutual interactions of operational activities forms in the course of the exchange of criminal information and the access to databases has been omitted in the article due to the extent of the issue

Integrated combating of organized crime in the Baltic Sea region (BALTCOM) – origins, main aspects and development perspectives
Artykuł przedstawia genezę, główne aspekty działania oraz perspektywy rozwoju
współpracy w ramach formuły BALTCOM, której celem jest zwalczanie przestępczości
transgranicznej w regionie Morza Bałtyckiego. W 2016 r. przypada 20. rocznica nawiązania
operacyjnej współpracy w zakresie zwalczania przestępczości zorganizowanej
przez państwa tego regionu. Problematyka omawiana w artykule jest bardzo skomplikowana
z powodu specyfiki działań kontrprzestępczych prowadzonych w ramach BALTCOM-
u oraz jego umiejscowienia w systemie współpracy międzynarodowej. W artykule
zwrócono uwagę na korzyści wynikające z metod i form międzynarodowego współdziałania
Polski w BALTCOM.The article presents the origins, the main aspects of activity and development prospects
of the cooperation in the framework of BALTCOM, which is aimed at combating
cross-border crime in the Baltic Sea Region. In 2016 it is the 20th anniversary of the establishment
of operational cooperation in combating organized crime in the Baltic Sea Region.
The presented issue is extremely complex due to the specific nature of the activities
carried out on BALTCOM platform and its unique position in the international system of
cooperation. Article draws the attention to possible benefits for Poland from such form of
international cooperation in combating organized crime as BALTCOM
