This thesis used primary data and secondary data. Primary data consist positive
legal norms. Secondary data consist literalure, , legal facts from interviewees ,
and documents. The writer used literature study and interview for collecting data
methods. Positive legal norms as a primary data analytics consist description ,
systematization the positive legal norms, legal norm interpretation, and evaluate
the positive legal norms. For the secondary data analytical, writer used
compairing between arguments to know the different and equaiton arguments for
study the primary data. This thesis use deductive method to make a conclution.

Friedman and Machlup on the Significance of Testing Economic Assumptions
This article questions Milton Friedman’s methodological position in a famous essay dating to 1948 where he questions the validity of tests of the assumptions of economic theory. Valid tests, he maintains, by and large, concern the empirical implications of hypotheses derived from the theory. The truth or falsehood of assumptions is “largely irrelevant.” In response, this article argues that Friedman’s position is questionable but for different reasons depending on the nature of the assumptions. “Auxiliary assumptions” concern the environment in which the test is supposed to take place. “Generative assumptions” concern the postulates or theorems from which the hypothesis is derived. If auxiliary assumptions are false, all test results bear less weight, whether are confirmatory or disconfirmatory. If generative assumptions are false, positive results confer less confirmation on the hypothesis. The article further questions Friedman’s famous proposal to treat the assumptions of economic theory as “as if” statements, which are not really supposed true but simply taken for granted. The article goes on to question a related one by Fritz Machlup agreeing with Friedman about the irrelevance of tests of “generative assumptions.” Unlike Friedman, however, Machlup stands on the authority of philosophers of science, who, he claims, maintain that theoretical postulates in science should be regarded as “rules” that must be followed
Contextos e condicionantes para o uso e reutilização de recursos educacionais abertos
Na globalidade do mundo em que vivemos, fala-se de sociedade da informação, de redes sociais e de partilha generalizada.
Nas universidades, as solicitações para uso e reutilização de Recursos Educacionais pertencem a um mundo onde se fala cada vez mais de abertura. A abertura deve ser entendida como mais hipóteses para todos acederem a mais oportunidades de aprender e partilhar. Para aproveitar esta potencialidade, precisamos de apreender o contexto e as condicionantes em que se inscrevem os Recursos Educacionais Abertos (REAs), em particular no Ensino Superior Português.
A presente investigação procurou estudar as perceções de um grupo de estudantes do Ensino Superior Português sobre os Recursos Educacionais Abertos (REAs) e as suas condicionantes no momento de transformar produções escritas por outros em REAs.
A investigação incidiu sobre um grupo de estudantes de uma unidade curricular de um mestrado completamente online mais especificamente na unidade curricular de Psicologia da Comunicação Online do Mestrado em Pedagogia do E-learning da Universidade Aberta de Portugal.
A metodologia escolhida para desenvolver o trabalho foi a Design-Based Research (DBR) porque se adequa às fases de design, implementação e análise que integram um processo em construção. Foram consideradas iterações da unidade curricular de enquadramento, o processo de aplicação da DBR contemplou dois grupos de investigadores nos quais cada um desenvolveu a sua pesquisa, situação que representa um desafio aceite e apresentou os seus benefícios. O objeto do nosso estudo situa-se na iteração da unidade curricular onde foram aplicados dois questionários e uma grelha da análise que permitiram recolher dados sobre a perceção dos estudantes ao trabalhar no contexto dos REAs.
Os 5 Rs de Wiley foram pautando o ritmo do estudo, ficando convicta a investigadora da necessidade de mais aplicações e de mais estudos que permitam consolidar o objetivo de mais REAs para a educação aberta.Nowadays we speak about society of information, social networks and generalized share all over the world.
In the universities, the solicitations for use and reuse of Educational Resources belong to an environment where opening is more and more referred. This opening must be interpreted as more chances for all the people to achieve more opportunities to learn and share. In order to take advantage of this possibility, we need to seize the context and the conditioning where the Opening Educational Resources are to be found especially in the Portuguese Higher Education.
This investigation tried to study the perceptions of a group of students on OER and their environment to transfer written works by others in OER.
It was taken from a group of students of a master’s course unit completely on line more specifically Psychology of Communication online – Master course in pedagogy of E-learning of the Universidade Aberta de Portugal.
The methodology chosen to develop this investigation was the Design-Based Research (DBR) because it is suitable to the phases of design, implementation and analysis that integrate a process under construction. We considered iterations of the course unity of framework, the process of application of the DBR was composed by two groups of investigators each one developing his search which was a challenge accepted and with proved advantages. The object of our study focuses on the iteration where we used two inquiries and an analysis grid which permitted to make a data collection about the perception the students had working, on the OER’s context.
The 5 Rs of Wiley were pacing the study. The investigator is certain that more applications and study are absolutely needed which will allow to consolidate the aim of more OER for open education
A new species of Alpaida (Araneae, Araneidae) from Southeastern Brazil
ABSTRACT Alpaida venger sp. nov. is described based on males and females from Pedra Branca State Park, Rio de Janeiro, Brazil. This species seems to be related to Alpaida scriba (Mello-Leitão, 1940) and Alpaida alticeps (Keyserling, 1879) due to similar body shape and color, but is easily distinguished by the very elongated median apophysis, the massive lobe of tegulum and the hooked paracymbium of male palp. Females have elongated epigyne as A. scriba, but can be distinguished by the wider lips and shorter scape
Genetic relationships and evolution in Cucurbita pepo (pumpkin, squash, gourd) as revealed by simple sequence repeat polymorphisms
Genetic relationships among 104 accessions of Cucurbita pepo were assessed from polymorphisms in 134 SSR (microsatellite) and four SCAR loci, yielding a total of 418 alleles, distributed among all 20 linkage groups. Genetic distance values were calculated, a dendrogram constructed, and principal coordinate analyses conducted. The results showed 100 of the accessions as distributed among three clusters representing each of the recognized subspecies, pepo, texana, and fraterna. The remaining four accessions, all having very small, round, striped fruits, assumed central positions between the two cultivated subspecies, pepo and texana, suggesting that they are relicts of undescribed wild ancestors of the two domesticated subspecies. In both, subsp. texana and subsp. pepo, accessions belonging to the same cultivar-group (fruit shape) associated with one another. Within subsp. pepo, accessions grown for their seeds or that are generalists, used for both seed and fruit consumption, assumed central positions. Specialized accessions, grown exclusively for consumption of their young fruits, or their mature fruit flesh, or seed oil extraction, tended to assume outlying positions, and the different specializations radiated outward from the center in different directions. Accessions of the longest-fruited cultivar-group, Cocozelle, radiated bidirectionally, indicating independent selection events for long fruits in subsp. pepo probably driven by a common desire to consume the young fruits. Among the accessions tested, there was no evidence for crossing between subspecies after domestication
