Modernity and Contemporaneity

Modernity and Contemporaneity is the 3rd volume in the Hellenic-Serbian Philosophical Dialogue Series, a project that was initiated as an emphatic token of the will and commitment to establish permanent and fruitful collaboration between two strongly bonded Departments of Philosophy, this of the National and Kapodistrian University of Athens, and that of the University of Novi Sad respectively. This collaboration was founded from the very beginning upon friendship, mutual respect and strong engagement, as well us upon our firm resolution to establish a solid continuity in the editing project. The publication of this volume allows us to entertain feelings of contentment and confidence that this objective of the project has been accomplished.Publishe

Η Ηθική της Τιμωρίας: Συγκριτική Ανάλυση της Καντιανής και Εγελιανής Θεώρησης της έννοιας της Τιμωρίας

Στο πλαίσιο της εκπόνησης της διπλωματικής εργασίας για την ολοκλήρωση του Μεταπτυχιακού Προγράμματος «Εφαρμοσμένη Ηθική», το ανά χείρας δοκίμιο επιδιώκει να συζητήσει ομοιότητες και διαφορές στη σκέψη δύο εξεχόντων Γερμανών στοχαστών, ήτοι του Ιμμάνουελ Καντ και του Γκέοργκ Βίλχελμ Φρίντριχ Χέγκελ, αναφορικά με το θεμελιώδες ζήτημα της τιμωρίας στη σχέση πολίτη και κράτους. Το κεντρικό ερώτημα που φιλοδοξεί να απαντήσει η εργασία είναι εάν η τιμωρία έχει ηθική υφή και διάσταση κατά την κρατική εφαρμογή με τη μορφή της ποινής, ήτοι εάν υφίσταται η ηθική της τιμωρίας ή εάν αυτή η ορολογία αποτελεί ένα γλωσσικό σχήμα το οποίο στην πρακτική του εφαρμογή πολλώ απέχει από την ηθική διάσταση. Το δοκίμιο ακολουθεί το δεοντοκρατικό πρίσμα, δηλαδή βασίζεται στους κανόνες του ηθικού πράττειν ερευνώντας τις συνθήκες δυνατότητας της ηθικής πράξης και το θεμέλιο του τι δέον πρακτέον. Τα βασικά ερωτήματα που θα καθοδηγήσουν την ανάλυση είναι τα εξής: 1. Τι διακρίνει την τιμωρία από τα άλλα είδη καταναγκαστικής επιβολής, 2. Πώς μπορεί να δικαιολογηθεί η εφαρμογή της πρακτικής της τιμωρίας και σε ποιους νομιμοποιείται να χρησιμοποιηθεί, και, 3. Τι δικαιολογεί ένα κράτος να επιβάλει την τιμωρία σε ορισμένους πολίτες του δια μέσου του νόμου και του δικαίου, επιφέροντας εκ προθέσεως επιβαρυντική μεταχείριση σε αυτούς του πολίτες και παράλληλα την κοινωνική κατακραυγή τους.As part of the final dissertation of the Master's Program in "Applied Ethics", this essay intends to discuss pivotal similarities and differences between two prominent German thinkers, namely Immanuel Kant and Georg Wilhelm Friedrich Hegel, regarding the fundamental question of punishment ethics in the relationship between citizen and the state. The central question that the paper aspires to address is, whether punishment has a moral texture and dimension when applied by the state in the form of punishment, i.e. whether punishment ethics notion exists or whether this terminology consists of a linguistic schema, which it is a long way off the moral dimension, when applied. The essay embraces the deontological ethics theory, namely the normative theories of moral action investigating the foundations of what the subject of the moral action ought to do. The main research questions that will guide the desktop analysis focus on: 1. What distinguishes punishment from other types of coercive enforcement; 2. How can the application of the practice of punishment be justified and on whom is it justified to be used; and, 3. What justifies a state to impose punishment on some of its’ citizens through law and justice, by intentionally inflicting burdensome treatment on these citizens or their social outcry
