CIVIL PROCEDURE-RIGHT OF IMPLEADER UNDER MICHIGAN CONTRIBUTION STATUTE
Plaintiff, a resident of Michigan, brought a negligence action against defendant, an Illinois corporation, for personal injury in the Federal District Court for the Eastern District of Michigan. The defendant moved to implead a citizen of Michigan and a Michigan corporation as third party defendants on the theory that under the Michigan Contribution Statute as concurrent tortfeasors they would be liable to him for part of the judgment in the event that plaintiff recovered in the suit. The court granted the motion and the defendant filed its third party complaint. Plaintiff then moved to dismiss the third party complaint. Held: motion granted. The court reasoned that since the Michigan Contribution Statute was almost identical with that of New York and since the Michigan Supreme Court has never passed upon the right of impleader under it, the New York court\u27s interpretation of their statute denying impleader should govern. Differences in both prevalence and titre of specific immunoglobulin E among children with asthma in affluent and poor communities within a large town in Ghana.
Background Reports from several African countries have noted an increasing prevalence of asthma in areas of extensive urbanization. Objective To investigate the relevance of allergen-specific sensitization and body mass index (BMI) to asthma/wheezing and exercise-induced bronchospasm (EIB) among children from affluent and poorer communities within a large town in Ghana. Methods Children with physician-diagnosed asthma and/or current wheezing aged 9-16 years (n=99; cases) from three schools with differing socio-economic backgrounds [urban affluent (UA), urban poor (UP) or suburban/rural (SR)] were recruited from a cross-sectional study (n=1848) in Kumasi, Ghana, and matched according to age, sex and area of residence with non-asthmatic/non-wheezy controls. We assayed sera for IgE antibodies to mite, cat, dog, cockroach, Ascaris and galactose-α-1,3-galactose. Results Children from the UA school had the lowest total serum IgE. However, cases from the UA school had a higher prevalence and mean titre of sIgE to mite (71.4%, 21.2IU/mL) when compared with controls (14.3%, 0.8IU/mL) or cases from UP (30%, 0.8IU/mL) and SR community (47.8%, 1.6IU/mL). While similar findings were observed with EIB in the whole population, among cases there was no difference in IgE antibody prevalence or titre between children with or without EIB. BMI was higher among UA children with and without asthma; in UP and SR communities, children with EIB (n=14) had a significantly higher BMI compared with children with asthma/wheezing without EIB (n=38) (18.2 vs. 16.4, respectively, P<0.01). Conclusions and Clinical Relevance In the relatively affluent school, asthma/wheezing and EIB were associated with high titre IgE antibodies to mite, decreased total IgE, and increased BMI. This contrasted with children in the urban poor school and suggests that changes relevant to a Western model of childhood asthma can occur within a short geographical distance within a large city in Africa. © 2011 Blackwell Publishing Ltd
Surfactant-free purification of membrane protein complexes from bacteria: application to the staphylococcal penicillin-binding protein complex PBP2/PBP2a
Surfactant-mediated removal of proteins from biomembranes invariably results in partial or complete loss of function and disassembly of multi-protein complexes. We determined the capacity of styrene-co-maleic acid (SMA) co-polymer to remove components of the cell division machinery from the membrane of drug-resistant staphylococcal cells. SMA-lipid nanoparticles solubilized FtsZ-PBP2-PBP2a complexes from intact cells, demonstrating the close physical proximity of these proteins within the lipid bilayer. Exposure of bacteria to (-)-epicatechin gallate, a polyphenolic agent that abolishes β-lactam resistance in staphylococci, disrupted the association between PBP2 and PBP2a. Thus, SMA purification provides a means to remove native integral membrane protein assemblages with minimal physical disruption and shows promise as a tool for the interrogation of molecular aspects of bacterial membrane protein structure and function
Neutron-proton analyzing power at 12 MeV and inconsistencies in parametrizations of nucleon-nucleon data
We present the most accurate and complete data set for the analyzing power
Ay(theta) in neutron-proton scattering. The experimental data were corrected
for the effects of multiple scattering, both in the center detector and in the
neutron detectors. The final data at En = 12.0 MeV deviate considerably from
the predictions of nucleon-nucleon phase-shift analyses and potential models.
The impact of the new data on the value of the charged pion-nucleon coupling

EPOCHS VI: The Size and Shape Evolution of Galaxies since z ~ 8 with JWST Observations
We present the results of a size and structural analysis of 1395 galaxies at
with stellar masses
9.5 within the JWST Public CEERS field that overlaps with the HST CANDELS
EGS observations. We use GALFIT to fit single S\'ersic models to the rest-frame
optical profile of our galaxies, which is a mass-selected sample complete to
our redshift and mass limit. Our primary result is that at fixed rest-frame
wavelength and stellar mass, galaxies get progressively smaller, evolving as
up to . We discover that the vast
majority of massive galaxies at high redshifts have low S\'ersic indices, thus
do not contain steep, concentrated light profiles. Additionally, we explore the
evolution of the size-stellar mass relationship, finding a correlation such
that more massive systems are larger up to . This relationship breaks
down at , where we find that galaxies are of similar sizes, regardless
of their star formation rates and S\'ersic index, varying little with mass. We
show that galaxies are more compact at redder wavelengths, independent of sSFR
or stellar mass up to . We demonstrate the size evolution of galaxies
continues up to , showing that the process or causes for this
evolution is active at early times. We discuss these results in terms of ideas
behind galaxy formation and evolution at early epochs, such as their importance
in tracing processes driving size evolution, including minor mergers and AGN

Estimating Increased Transient Water Storage With Increases in Beaver Dam Activity
Dam building by beaver (Castor spp.) slows water movement through montane valleys, increasing transient water storage and the diversity of residence times. In some cases, water storage created by beaver dam construction is correlated to changes in streamflow magnitude and timing. However, the total amount of additional surface and groundwater storage that beaver dams may create (and, thus, their maximum potential impact on streamflow) has not been contextualized in the water balance of larger river basins. We estimate the potential transient water storage increases that could be created at 5, 25, 50, and 100% of maximum modeled beaver dam capacity in the Bear River basin, USA, by adapting the height above nearest drainage (HAND) algorithm to spatially estimate surface water storage. Surface water storage estimates were combined with the MODFLOW groundwater model to estimate potential increases in groundwater storage throughout the basin. We tested four scenarios to estimate potential transient water storage increases resulting from the construction of 1179 to 34,897 beaver dams, and estimated surface water storage to range from 57.5 to 72.8 m3 per dam and groundwater storage to range from 182.2 to 313.3 m3 per dam. Overall, we estimate that beaver dam construction could increase transient water storage by up to 10.38 million m3 in the Bear River basin. We further contextualize beaver dam-related water storage increases with streamflow, reservoir, and snowpack volumes
Dreaming of drams: Authenticity in Scottish whisky tourism as an expression of unresolved Habermasian rationalities
In this paper, the production of whisky tourism at both independently owned and corporately owned distilleries in Scotland is explored by focusing on four examples (Arran, Glengoyne, Glenturret and Bruichladdich). In particular, claims of authenticity and Scottishness of Scottish whiskies through commercial materials, case studies, website-forum discussions and 'independent' writing about such whisky are analysed. It is argued that the globalisation and commodification of whisky and whisky tourism, and the communicative backlash to these trends typified by the search for authenticity, is representative of a Habermasian struggle between two irreconcilable rationalities. This paper will demonstrate that the meaning and purpose of leisure can be understood through such explorations of the tension between the instrumentality of commodification and the freedom of individuals to locate their own leisure lives in the lifeworld that remains. © 2011 Taylor & Francis

A New Measurement of the 1S0 Neutron-Neutron Scattering Length using the Neutron-Proton Scattering Length as a Standard
The present paper reports high-accuracy cross-section data for the 2H(n,nnp)
reaction in the neutron-proton (np) and neutron-neutron (nn)
final-state-interaction (FSI) regions at an incident mean neutron energy of
13.0 MeV. These data were analyzed with rigorous three-nucleon calculations to
determine the 1S0 np and nn scattering lengths, a_np and a_nn. Our results are
a_nn = -18.7 +/- 0.6 fm and a_np = -23.5 +/- 0.8 fm. Since our value for a_np
obtained from neutron-deuteron (nd) breakup agrees with that from free np
scattering, we conclude that our investigation of the nn FSI done
simultaneously and under identical conditions gives the correct value for a_nn.
Our value for a_nn is in agreement with that obtained in pion-deuteron capture
measurements but disagrees with values obtained from earlier nd breakup

Intrauterine growth restriction increases fetal hepatic gluconeogenic capacity and reduces messenger ribonucleic acid translation initiation and nutrient sensing in fetal liver and skeletal muscle.
Expression of key metabolic genes and proteins involved in mRNA translation, energy sensing, and glucose metabolism in liver and skeletal muscle were investigated in a late-gestation fetal sheep model of placental insufficiency intrauterine growth restriction (PI-IUGR). PI-IUGR fetuses weighed 55% less; had reduced oxygen, glucose, isoleucine, insulin, and IGF-I levels; and had 40% reduction in net branched chain amino acid uptake. In PI-IUGR skeletal muscle, levels of insulin receptor were increased 80%, whereas phosphoinositide-3 kinase (p85) and protein kinase B (AKT2) were reduced by 40%. Expression of eukaryotic initiation factor-4e was reduced 45% in liver, suggesting a unique mechanism limiting translation initiation in PI-IUGR liver. There was either no change (AMP activated kinase, mammalian target of rapamycin) or a paradoxical decrease (protein phosphatase 2A, eukaryotic initiation factor-2 alpha) in activation of major energy and cell stress sensors in PI-IUGR liver and skeletal muscle. A 13- to 20-fold increase in phosphoenolpyruvate carboxykinase and glucose 6 phosphatase mRNA expression in the PI-IUGR liver was-associated with a 3-fold increase in peroxisome proliferator-activated receptor-gamma coactivator-1 alpha mRNA and increased phosphorylation of cAMP response element binding protein. Thus PI-IUGR is-associated with reduced branched chain amino acid uptake and growth factors, yet up-regulation of proximal insulin signaling and a marked increase in the gluconeogenic pathway. Lack of activation of several energy and stress sensors in fetal liver and skeletal muscle, despite hypoxia and low energy status, suggests a novel strategy for survival in the PI-IUGR fetus but with potential maladaptive consequences for reduced nutrient sensing and insulin sensitivity in postnatal life
