Penetapan Pengadilan Mengenai Penunjukan Wali Anak
Penelitian ini dilakukan dengan tujuan untuk mengetahui alasan apa yang menyebabkan perlu adanya penunjukan wali dari anak dan bagaimana penunjukan wali anak melalui penetapan pengadilan. Dengan menggunakan metode penelitian yuridis normatif disimpulkan: 1. Kedudukan orang tua sebagai wali dari anak, dapat digantikan seseorang atau badan hukum yang memenuhi persyaratan, apabila orang tua anak tidak cakap melakukan perbuatan hukum, atau tidak diketahui tempat tinggal atau keberadaannya. Perwalian juga dapat terjadi karena perkawinan orang tua putus baik disebabkan salah seorang meninggal, perceraian atau dicabutnya kekuasaan orang tua melalui penetapan pengadilan atau putusan pengadilan Pengadilan Agama bagi yang beragama Islam dan Pengadilan Negeri bagi yang beragama selain Islam, karena orang tua sangat melalaikan kewajibannya terhadap anaknya dan berkelakuan buruk sekali. Hakim akan mengangkat seorang wali yang disertai wali pengawas yang harus mengawasi pekerjaan wali tersebut. Meskipun orang tua dicabut kekuasaannya, mereka masih tetap berkewajiban untuk memberi biaya pemeliharaan kepada anak tersebut. 2. Penunjukan perwalian terhadap anak kepada pihak lain melalui penetapan pengadilan dengan menunjuk seseorang atau badan hukum yang memenuhi persyaratan sebagai wali dari anak yang bersangkutan. Wali yang ditunjuk agamanya harus sama dengan agama yang dianut anak. Untuk kepentingan anak, wali wajib mengelola harta milik anak yang bersangkutan. Wali yang ditunjuk berdasarkan penetapan pengadilan dapat mewakili anak untuk melakukan perbuatan hukum, baik di dalam maupun di luar pengadilan untuk kepentingan yang terbaik bagi anak. Dalam hal anak belum mendapat penetapan pengadilan mengenai wali, maka harta kekayaan anak tersebut dapat diurus oleh Balai Harta Peninggalan atau lembaga lain yang mempunyai kewenangan untuk itu. Balai Harta Peninggalan atau lembaga lain bertindak sebagai wali pengawas untuk mewakili kepentingan anak. Pengurusan harta sebagaimana dimaksud harus mendapat penetapan pengadilan. Dalam hal wali yang ditunjuk ternyata di kemudian hari tidak cakap melakukan perbuatan hukum atau menyalahgunakan kekuasaannya sebagai wali, maka status perwaliannya dicabut dan ditunjuk orang lain sebagai wali melalui penetapan pengadilan. Colloidal cluster composed of superparamagnetic nanoparticle has shown great potential for efficient hyperthermia heating. However, the relationship between cluster properties and heating efficiency is not clear. In this work, we investigate the influence of morphology anisotropy of cluster of superparamagnetic nanoparticle on magnetic hysteresis by Monte Carlo simulation. Five kinds of clusters with different shapes and structure are studied. We find that the morphology anisotropy of cluster changes the magnetic loss by affecting the tendency of cluster to remain magnetically aligned with the field orientation. A large aspect ratio of the length of cluster along the field orientation to the width perpendicular to the orientation can increase the amount of energy converted per cycle significantly. Lacking morphology anisotropy will make the magnetic hysteresis of cluster numb to the manipulation of cluster properties
Reconsideration of Second Harmonic Generation from neat Air/Water Interface: Broken of Kleinman Symmetry from Dipolar Contribution
It has been generally accepted that there are significant quadrupolar and
bulk contributions to the second harmonic generation (SHG) reflected from the
neat air/water interface, as well as common liquid interfaces. Because there
has been no general methodology to determine the quadrupolar and bulk
contributions to the SHG signal from a liquid interface, this conclusion was
reached based on the following two experimental phenomena. Namely, the broken
of the macroscopic Kleinman symmetry, and the significant temperature
dependence of the SHG signal from the neat air/water interface. However,
because sum frequency generation vibrational spectroscopy (SFG-VS) measurement
of the neat air/water interface observed no apparent temperature dependence,
the temperature dependence in the SHG measurement has been reexamined and
proven to be an experimental artifact. Here we present a complete microscopic
analysis of the susceptibility tensors of the air/water interface, and show
that dipolar contribution alone can be used to address the issue of broken of
the macroscopic Kleinman symmetry at the neat air/water interface. Using this
analysis, the orientation of the water molecules at the interface can be
obtained, and it is consistent with the measurement from SFG-VS. Therefore, the
key rationales to conclude significantly quadrupolar and bulk contributions to
the SHG signal of the neat air/water interface can no longer be considered as
valid as before. This new understanding of the air/water interface can shed
light on our understanding of the nonlinear optical responses from other
molecular interfaces as well
YBCO-buffered NdBCO film with higher thermal stability in seeding REBCO Growth
In this work, we report a strengthened superheating effect caused by a
buffering YBa2Cu3Oy (Y123 or YBCO) layer in the Nd1+xBa2-xCu3O7-y (Nd123 or
NdBCO) thin film with MgO substrate (i.e., NdBCO/YBCO/MgO thin film). In the
cold-seeding melt-textured (MT) growth, the NdBCO/YBCO/MgO film presented an
even higher superheating level, about 20 {\deg}C higher than that of
non-buffered NdBCO film (i.e., NdBCO/MgO film). Using this NdBCO/YBCO/MgO film
as seeds and undergoing a maximum processing temperature (Tmax) up to 1120
{\deg}C, we succeeded in growing various RE1+xBa2-xCu3O7-y (REBCO, RE=rare
elements) bulk superconductors, including Gd1+xBa2-xCu3O7-y (GdBCO),
Sm1+xBa2-xCu3O7-y (SmBCO) and NdBCO that have high peritectic temperatures
(Tp). The pole figure (X-Ray \phi-scan) measurement reveals that the
NdBCO/YBCO/MgO film has better in-plane alignment than the NdBCO/MgO film,
indicating that the induced intermediate layer improves the crystallinity of
the NdBCO film, which could be the main origin of the enhanced thermal
stability. In short, possessing higher thermal stability and enduring a higher
Tmax in the MT process, the NdBCO/YBCO/MgO film is beneficial to the growth of
bulk superconductors in two aspects: (1) broad application for high-Tp REBCO
materials; (2) effective suppression against heterogeneous nucleation, which is
of great assistance in growing large and high-performance REBCO crystals.Comment: 9 pages, 4 figure
