Współczesna wojna powietrzna w świetle międzynarodowego prawa humanitarnego konfliktów zbrojnych
Od czasów utworzenia pierwszej jednostki sił powietrznych w 1794 lotnictwo wojskowe stopniowo uzyskiwało status znaczącego narzędzia prowadzenia działań wojennych. Pierwsze bombardowanie z powietrza mające miejsce w 1911 roku, a także doświadczenia I wojny światowej uświadomiły kołom wojskowo-politycznym strategiczne znaczenie uderzeń lotniczych. Równolegle, postępy techniki lotniczej, zasięgu oraz udźwigu maszyn bojowych niosły obok korzyści wojskowych także wielkie zagrożenie dla ludności cywilnej. II wojna światowa i zjawisko masowych bombardowań ośrodków miejskich wykreowało obraz kolizji płaszczyzn wojskowych i humanitarnych. "Rozwiązywanie" tych punktów tarcia jest szczególnym zadaniem norm międzynarodowego prawa humanitarnego. Celem niniejszej rozprawy jest przedstawienie prawnego aspektu zjawiska wojny powietrznej od czasów Pierwszej Konferencji Pokojowej w Hadze do teraźniejszości
Wojna powietrzna a międzynarodowe prawo humanitarne
Znaczenie siły powietrznej dla prowadzenia operacji wojskowych jest współcześnie niepodważalne. Lotnictwo było jednym z kluczowych elementów sukcesu polityczno-militarnego w niemal wszystkich konfliktach XX wieku. Niestety, pomimo wielkiego znaczenia tego rodzaju sił zbrojnych, niewspółmiernie skąpe są rozważania na temat aspektów prawnych operacji lotniczych, zwłaszcza w świetle międzynarodowego prawa humanitarnego. Okoliczność ta była często wykorzystywana przez walczących, którzy, operując w „szarej strefie” prawa wojny, dokonywali co najmniej kontrowersyjnych ataków na ośrodki miejskie, gdzie ginęli niewalczący. Książka ta nie jest ograniczona wyłącznie do najbardziej dyskutowanego aspektu bombardowania, lecz dotyczy także innych zagadnień związanych z wojną powietrzną, nieopisywanych szerzej w literaturze przedmiotu

The Definition of the Armed Conflict in the Conditions of Cyber Warfare
The paper is presenting the examination of the cyberwarfare phenomenon in its legal context. The cyberattacks are increasingly effective measures of modern combat and would probably become the most crucial dimension of forthcoming armed conflict. The role of the international humanitarian law is to determine whenever the cyberattack is reaching the threshold of an armed conflict. The aim of the article is to present the existing framework of ius in bello in terms of its temporal scope of applicability, especially in the light of the Tallinn Manual on the International Law Applicable to Cyber Warfare. It supported conclusion that the international law requires an revision of the armed conflict definition to sufficiently addressed the challenges arising from growing cyber activity
The use of the incendiary weapons in the light of the international humanitarian law

zdrowotne jej stosowania rodzą obawy z punktu widzenia humanitarnego. Dewastujące
efekty tzw. burz ogniowych w czasie II wojny światowej, doświadczenia wojny powietrznej
nad Wietnamem w latach 60. i 70. XX w. tworzą pytania o rolę międzynarodowego
prawa humanitarnego w tej mierze. Normy prawa konfliktów zbrojnych muszą
uwzględniać dwie przeciwstawne perspektywy: humanitarną oraz wojskową. Od dekad
brak woli państw uniemożliwia kompleksowe uregulowanie materii związanej z użyciem
broni zapalającej i znalezienie wyraźnych odpowiedzi na najbardziej kontrowersyjne
zagadnienia – chociażby dotyczące ostatnich wydarzeń w Aleppo. Współczesna
technika wojskowa, tworząca nowe systemy uzbrojenia, utrudnia objęcie tego typu
broni jednoznaczną definicją. Celem artykułu jest przedstawienie i przeanalizowanie
relewantnych regulacji międzynarodowego prawa humanitarnego odnoszącego się do
broni zapalającej.The incendiary weapons are one of the most effective tools of the modern combat. Their
extensive use is dated at least two thousand years ago when the ‚Greek fire’ was concerning
a decisive weapon of antiquity. From the humanitarian viewpoint, the deployment
of the flammable armament created a grave medical and legal concern. The devastating
power of the incendiary aerial bombs during the World War Two appealed for the
urged response. However, during the decades, the states were highly reluctant to welcome
new restriction, limiting their choice of combat. In this difficult political and technical
landscape, the international humanitarian law (IHL) is required to constantly adopt
both the military and humanitarian perspective. Contemporary challenges arise both
from unsettled state practice on the battlefield and the constant progress in weapons development that simply outruns the existing framework of the international humanitarian
law. The aim of this article is to examine relevant laws and customs of war addressing the
issue of incendiary weapons
Бомбардировки с воздуха во время Второй мировой войны в свете международного права: проблема нападения на Велюнь 1 сентября 1939 г.
Lotnictwo wojskowe w okresie Wielkiej Wojny unaoczniło kręgom polityczno-wojskowym wielkie znaczenie sił powietrznych w przyszłych konfliktach zbrojnych. Podkreślano, że statki powietrzne są zdolne do przenoszenia ładunków wybuchowych i mogą razić cele odległe o kilkaset kilometrów od frontu, wprowadzając możliwość atakowania przeciwnika na jego dalekim zapleczu w skali nieznanej w historii wojen. Jednocześnie rozwój lotnictwa wojskowego wywoływał obawy o granice dopuszczalnego zniszczenia i skutecznej ochrony ludności cywilnej przed bombardowaniami powietrznymi. Tworzenie ograniczeń w doborze metod i środków walki jest misją międzynarodowego prawa humanitarnego (do 1949 r. nazywanego częściej prawem wojny – ius in bello). Celem niniejszego artykułu jest przedstawienie rozwoju reżimu prawnego odnoszącego się do zjawiska bombardowań powietrznych, począwszy od przepisów uchwalonych podczas konferencji pokojowych w Hadze w 1899 i 1907 r. oraz próby kompleksowego unormowania wojny powietrznej w okresie międzywojennym. Następnie artykuł ocenia adekwatność istniejącej siatki normatywnej względem rzeczywistości pola walki i dramatycznego obrazu bombardowań powietrznych w okresie II wojny światowej, ze szczególnym uwzględnieniem sprawy bombardowania Wielunia 1 września 1939 r.The use of military aviation during the Great War alerted both political and military circles to the great importance that air power would have in future armed conflicts. It emphasized that aircraft were capable of carrying explosives and could strike targets several hundred kilometers away from the front, which afforded the opportunity to attack the enemy in its distant hinterland on a scale that was hitherto unknown in the history of military conflict. At the same time, the development of military aviation raised concerns about the limits of acceptable destruction and the effective protection of civilians from air bombardments. Creating limitations concerning the methods and means of combat was the main mission of international humanitarian law (until 1949 more often called the law of war – ius in bello). The aim of this article is to present the development of legal structures relating to the phenomenon of air bombing, starting with the regulations adopted during the Peace Conferences in The Hague in 1899 and 1907 and the attempts to comprehensively regulate air war in the interwar period. The article also assesses the adequacy of the existing normative network in relation to battlefield reality and the dramatic images of air bombings during World War II, with particular emphasis being placed on the bombing of Wieluń on 1 September 1939.Военная авиация во время Великой войны заставила политические и военные круги осознать огромное значение военно-воздушных сил в будущих вооруженных конфликтах. В тот период подчеркивалось, что самолеты способны перевозить взрывчатку и могут поражать цели в нескольких сотнях километров от фронта, что дает возможность атаковать противника в его самых отдален ных внутренних районах в масштабах, неизвестных доселе в истории войн. В то же время развитие военной авиации вызвало опасения по поводу пределов допустимого разрушения и эффективной защиты гражданского населения от воздушных бомбардировок. Создание ограничений в выборе методов и средств ведения боя – это задача международного гуманитарного права (до 1949 г. чаще называлось правом войны – ius in bello). Цель данной статьи – представить развитие законодательной базы, относящейся к феномену воздушных бомбардировок (начиная с законов, принятых во время мирных конференций в Гааге в 1899 и 1907 г.) и попыток всестороннего регулирования воздушной войны в межвоенный период. Кроме того, в статье оценивается соответствие существующей нормативной сети с точки зрения действительности поля боя и драматической картины воздушных бомбардировок во время Второй мировой войны, с особым акцентом на бомбардировку Велюня 1 сентября 1939 г
Challenges Encountered during the Treatment of Acute Mesenteric Ischemia
Introduction. Acute mesenteric ischemia, although rare, is associated with numerous complications and death. This work presents acute mesenteric ischemia treatment based on an analysis of various management strategies and identifies prognostic factors that influence therapy effectiveness. Material and Methods. We conducted a retrospective analysis of all patients who were diagnosed with acute mesenteric ischemia due to occlusion and hospitalized between January 1, 2002, and December 31, 2018. Results. Acute ischemia of the bowel mesentery was diagnosed in 41 patients (27 women and 14 men; mean age, 65.4 years). All patients underwent laparotomy. For 13 (31.71%) patients, surgery was performed within the first 24 hours of the clinical symptom onset. Mesenteric artery embolectomy without intestine resection was performed for 7 (17.07%) patients. Partial intestine resection due to necrosis was performed for 21 (51.22%) patients. Exploratory laparotomy without a therapeutic procedure was performed for 13 (31.71%) patients. Fifteen (36.59%) patients were discharged home in good general condition. Twenty-six (63.41%) patients died. The time from the clinical symptom onset until intervention exceeded 24 hours for all patients who died. Surgery within the first 24 hours reduced mortality associated with acute mesenteric ischemia (P=0.001). Female sex, age older than 65 years, obesity (body mass index>30), diabetes, chronic kidney disease, and smoking were adverse prognostic factors for increased mortality for patients with acute bowel ischemia. Conclusion. The time from clinical symptoms to acute mesenteric ischemia treatment was the main prognostic factor and helped determine appropriate management. Early diagnosis and rapid intervention improved treatment outcomes and survival
Percutaneous Endoscopic Necrosectomy—A Review of the Literature
In this article, an attempt was made to clarify the role of percutaneous endoscopic necrosectomy (PEN) in the interventional treatment of pancreatic necrosis. A comprehensive review of the current literature was performed to identify publications on the role of PEN in patients with consequences of acute necrotizng pancreatitis. The aim of the study was to review the literature on minimal invasive necrosectomy, with emphasis on PEN using esophageal self-expanding metal stents (SEMS). The described results come from 15 studies after a review of the current literature. The study group comprised 52 patients (36 men and 16 women; mean age, 50.87 (13–75) years) with walled-off pancreatic necrosis, in whom PEN using a self-expandable esophageal stent had been performed. PEN was successfully completed in all 52 patients (100%). PEN complications were observed in 18/52 (34.62%) patients. Clinical success was achieved in 42/52 (80.77%) patients, with follow-up continuing for an average of 136 (14–557) days. In conclusion, the PEN technique is potentially effective, with an acceptable rate of complications and may be implemented with good clinical results in patients with pancreatic necrosis
Transanal total mesorectal excision (TaTME) in rectal cancer treatment within an expert center
Abstract The objective of this study was to evaluate treatment outcomes in patients who underwent the TaTME procedure for cancer of the middle and low rectum in an expert center. Prospective analysis of the outcomes of all consecutive patients treated using the TaTME technique for cancer of the middle and distal rectum at the our medical center between March 1, 2015, and March 31, 2022. A total of 128 patients (34 women, 94 men; mean age 66.01 [38–85] years) with cancer of the middle and distal rectum qualified for TaTME. TaTME procedures were performed in 127/128 (99.22%) patients. Complications of surgery were observed in 22/127 (17.32%) patients. Negative proximal and distal margins were confirmed in all 127 patients. Complete (R0) resection of the mesorectum was confirmed in 125/127 (98.43%) and nearly complete (R1) resection was confirmed in 2/127 (1.57%) patients. The average follow-up period was 795 days (296–1522) days. Local recurrence was detected during the follow-up period in 2/127 (1.57%) patients. This study showed that the TaTME procedure is an effective and safe method for the minimally invasive treatment of middle and low rectal cancers, particularly within an expert center setting
