What does it mean for a landlord to be in the business of leasing so that strict liability may be imposed for injuries caused by latent defects in residential units? What is a latent defect so that landlords may take necessary preventative steps before renting a unit? In addition, this Note will examine the policies for extending strict liability which have developed in California case law. This Note will show that the Becker decision has created a new definition of stream of commerce and in so doing has greatly increased the potential for the imposition of strict liability in other areas of the residential housing market

    SummaryThe populations of pathogens in individual hosts have many of the characteristics of multicellular organisms, or individuals. These populations go through a life cycle within a host and they reproduce by founding daughter populations in new hosts. Natural selection shapes the life history characteristics of pathogen populations–life expectancy, trade-offs in the allocation of resources between growth, survival, and fecundity, and aging–in ways that maximize the reproductive fitness of the pathogens. In turn, these life history characteristics shape the natural histories of infectious diseases. Transmissibility and virulence may be thought of as properties of pathogen populations rather than as properties of the constituent microorganisms within these populations. The poor correlation of virulence with pathogen fitness is a major obstacle to the development of a theory of virulence. Consideration of the life histories of pathogen populations complements the traditional epidemiological focus on host populations and provides a valuable perspective for understanding human infectious diseases

    The role of the synchrotron component in the mid infrared spectrum of M 87

    We study in detail the mid-infrared Spitzer-IRS spectrum of M 87 in the range 5 to 20 micron. Thanks to the high sensitivity of our Spitzer-IRS spectra we can disentangle the stellar and nuclear components of this active galaxy. To this end we have properly subtracted from the M 87 spectrum, the contribution of the underlying stellar continuum, derived from passive Virgo galaxies in our sample. The residual is a clear power-law, without any additional thermal component, with a zero point consistent with that obtained by high spatial resolution, ground based observations. The residual is independent of the adopted passive template. This indicates that the 10 micron silicate emission shown in spectra of M 87 can be entirely accounted for by the underlying old stellar population, leaving little room for a possible torus contribution. The MIR power-law has a slope alpha ~ 0.77-0.82 (SΜ∝Μ−α_\nu\propto\nu^{-\alpha}), consistent with optically thin synchrotron emission.Comment: 5 pages, 4 figures, accepted for publication in ApJ main journa

    Critical view of WKB decay widths

    A detailed comparison of the expressions for the decay widths obtained within the semiclassical WKB approximation using different approaches to the tunneling problem is performed. The differences between the available improved formulae for tunneling near the top and the bottom of the barrier are investigated. Though the simple WKB method gives the right order of magnitude of the decay widths, a small number of parameters are often fitted. The need to perform the fitting procedure remaining consistently within the WKB framework is emphasized in the context of the fission model based calculations. Calculations for the decay widths of some recently found super heavy nuclei using microscopic alpha-nucleus potentials are presented to demonstrate the importance of a consistent WKB calculation. The half-lives are found to be sensitive to the density dependence of the nucleon-nucleon interaction and the implementation of the Bohr-Sommerfeld quantization condition inherent in the WKB approach.Comment: 18 pages, Late

    Discovery of a very X-ray luminous galaxy cluster at z=0.89 in the WARPS survey

    We report the discovery of the galaxy cluster ClJ1226.9+3332 in the Wide Angle ROSAT Pointed Survey (WARPS). At z=0.888 and L_X=1.1e45 erg/s (0.5-2.0 keV, h_0=0.5) ClJ1226.9+3332 is the most distant X-ray luminous cluster currently known. The mere existence of this system represents a huge problem for Omega_0=1 world models. At the modest (off-axis) resolution of the ROSAT PSPC observation in which the system was detected, ClJ1226.9+3332 appears relaxed; an off-axis HRI observation confirms this impression and rules out significant contamination from point sources. However, in moderately deep optical images (R and I band) the cluster exhibits signs of substructure in its apparent galaxy distribution. A first crude estimate of the velocity dispersion of the cluster galaxies based on six redshifts yields a high value of 1650 km/s, indicative of a very massive cluster and/or the presence of substructure along the line of sight. While a more accurate assessment of the dynamical state of this system requires much better data at both optical and X-ray wavelengths, the high mass of the cluster has already been unambiguously confirmed by a very strong detection of the Sunyaev-Zel'dovich effect in its direction (Joy et al. 2001). Using ClJ1226.9+3332 and ClJ0152.7-1357 (z=0.835), the second-most distant X-ray luminous cluster currently known and also a WARPS discovery, we obtain a first estimate of the cluster X-ray luminosity function at 0.8<z<1.4 and L_X>5e44 erg/s. Using the best currently available data, we find the comoving space density of very distant, massive clusters to be in excellent agreement with the value measured locally (z<0.3), and conclude that negative evolution is not required at these luminosities out to z~1.     A Magnetohydrodynamic Model of the M87 Jet I: Superluminal Knot Ejections from HST-1 as Trails of Quad Relativistic MHD Shocks

    This is the first in a series of papers that introduces a new paradigm for understanding the jet in M87: a collimated relativistic flow in which strong magnetic fields play a dominant dynamical role. Here wefocus on the flow downstream of HST-1 - an essentially stationary flaring feature that ejects trails of superluminal components. We propose that these components are quad relativistic magnetohydrodynamic shock fronts (forward/reverse fast and slow modes) in a narrow jet with a helically twisted magnetic structure. And we demonstrate the properties of such shocks with simple one-dimensional numerical simulations. Quasi-periodic ejections of similar component trails may be responsible for the M87 jet substructures observed further downstream on 100 - 1,000 pc scales. This new paradigm requires the assimilation of some new concepts into the astrophysical jet community, particularly the behavior of slow/fast-mode waves/shocks and of current-driven helical kink instabilities.
