    Poland’s rule of law breakdown: a five-year assessment of EU’s (in)action

    To reinstate what amounts to a “Soviet-style justice system”, Polish authorities have repeatedly and deliberately violated the Polish Constitution and EU law. Rather than comprehensively detailing these repeated violations, this article focuses on the EU dimension of Poland’s rule of law breakdown. Using the activation of the Rule of Law Framework by the European Commission on 13 January 2016 as a starting point, this article offers a critical five-year assessment of EU’s (in)action starting with an overview of the extent to which virtually all of the multiple problematical issues identified early on by the Commission have yet to be addressed by Polish authorities by January 2021. Regarding the Commission and the Council’s (in)action, this article argues that the Commission has systematically acted in a too little too late fashion while the Council has systematically failed to meaningfully act, with the inaction of these two EU institutions amounting, at times, to dereliction of duties. By contrast, the Court of Justice has forcefully defended judicial independence whenever an infringement case was lodged with it by the Commission. The Court of Justice’s record in preliminary ruling cases is more mixed due, in part, to the Court’s apprehension to undermine the principle of mutual trust. The article ends with a list of key lessons and recommendations which reflect the EU’s few successes and many failures highlighted in this article. It is submitted inter alia that more statements, dialogue and reports are not going to help contain, let alone solve Poland’s rule of law crisis. It is indeed no longer a crisis the EU is facing but a total breakdown in the rule of law in Poland which, in turn, represents a threat to the interconnected legal order that underpins the EU

    SUE: A Special Purpose Computer for Spin Glass Models

    The use of last generation Programmable Electronic Components makes possible the construction of very powerful and competitive special purpose computers. We have designed, constructed and tested a three-dimensional Spin Glass model dedicated machine, which consists of 12 identical boards. Each single board can simulate 8 different systems, updating all the systems at every clock cycle. The update speed of the whole machine is 217ps/spin with 48 MHz clock frequency. A device devoted to fast random number generation has been developed and included in every board. The on-board reprogrammability permits us to change easily the lattice size, or even the update algorithm or the action.     Differential response of communities of plants, snails, ants and spiders to long-term mowing in a small-scale experiment

    We examined the response of communities of four groups of organisms (plants, snails, ants and spiders) in a small scale mosaic of 8-years mown and unmown plots in a wet meadow in Central Europe. The experimental setup consisted of 7 unmown and 8 regularly mown 4 m2 plots in checkerboard arrangement. Eight years after the start of the experiment, the plant community structure diverged in response to mowing/nonmowing, both in species composition and structure. Both bryophyte and vascular plant species numbers were significantly higher in the mown plots. In unmown plots, bryophytes nearly disappeared and plots were dominated by the tall tussock grass Molinia caerulea. Both diversity and abundance of snails were higher in unmown plots than in mown ones. Ant nests were more abundant in mown plots and species composition differed between mown and unmown plots. We captured significantly more individuals of spiders in mown plots but we did not find any difference in species composition. We conclude that the 8-years duration of different management of 4 m2 plots was sufficient to establish different communities in low movable organisms, whereas these plots are probably too small to host different assemblages of organisms with good active dispersal abilities

    Detection of ultra-high energy cosmic ray showers with a single-pixel fluorescence telescope

    We present a concept for large-area, low-cost detection of ultra-high energy cosmic rays (UHECRs) with a Fluorescence detector Array of Single-pixel Telescopes (FAST), addressing the requirements for the next generation of UHECR experiments. In the FAST design, a large field of view is covered by a few pixels at the focal plane of a mirror or Fresnel lens. We report first results of a FAST prototype installed at the Telescope Array site, consisting of a single 200 mm photomultiplier tube at the focal plane of a 1 m2^2 Fresnel lens system taken from the prototype of the JEM-EUSO experiment. The FAST prototype took data for 19 nights, demonstrating remarkable operational stability. We detected laser shots at distances of several kilometres as well as 16 highly significant UHECR shower candidates.Comment: Accepted for publication in Astroparticle Physic

    Percutaneous management of thoracolumbar burst fractures: Evolution of techniques and strategy

    SummaryIntroductionA number of techniques have been described in the management of thoracolumbar spinal fractures, testimony to the absence of consensus on their treatment. For the past few years, minimally invasive techniques have been developed to limit surgery-related iatrogenic injury. The objective of this study was to report the results of percutaneous management of these lesions and the technical progress made based on our experience.Patients and methodsTwenty-nine patients presenting an A3 fracture, with a mean age of 51 years, were included in this study. All had a balloon kyphoplasty and percutaneous osteosynthesis. Of the first 22 cases, kyphoplasty was the initial procedure performed associated with reduction maneuvers using distraction. Assessment was clinical (neurological status and pain intensity) and radiological (implant positioning, cement leakage, restoration of local kyphosis and any loss of correction).ResultsIn the overall series, the mean local kyphosis correction was 11° with a 2° angle loss at the last follow-up. Pain assessment showed significant improvement, decreasing from 6/10 to 1/10 on discharge. The mean hospital stay lasted 4 days. On the follow-up radiological exams, no cases of extrapedicular screw migration were noted; in two cases, lateral cement leakage was found. The results were equivalent in terms of correction no matter which procedure was performed first, although for the second part of the series the technology was available to bend the spinal fixation rod to the desired curve.DiscussionThe results of this study support the growing interest in minimally invasive techniques in the management of spinal injuries with no neurological deficit. In addition, the evolving material makes it possible to come close to conventional techniques, including reduction maneuvers, while limiting muscle injury by using a purely percutaneous approach. Rigorous patient selection is necessary and the time to learn the procedure must be taken into account. Studies with a longer follow-up are required to confirm the stability of the correction over time.Level of evidenceLevel IV. Retrospective observational study
