Hardly a Clean Sweep:An Analysis of the Supreme Court of Virginia\u27sTreatment of Statutory Employee Litigation

The decision in Clean Sweep Prof\u27l Parking Lot Maint., Inc., v. Talley reveals the Supreme Court of Virginia\u27s challenging task of applying the Commonwealth\u27s workers\u27 compensation scheme to industrial accident cases. Fraught with fine-line distinctions, which in many instances nullify a plaintiff s common law negligence claim, case law in this area deserves close attention. Verdicts in such statutory employee cases turn on the facts and offer counsel on both sides the opportunity to creatively argue their client\u27s position. Part II of this note explores the legal background of Virginia\u27s statutory employee scheme, first with an overview of two relevant statutes, followed by a thorough review of case law which interprets the statutes and fleshes out the scheme. Part III provides the facts surrounding the Clean Sweep case. Part IV analyzes the court\u27s holding in Clean Sweep and assesses the implications of that decision for future statutory employee litigation

The application of the 2D/3D electrical resistivity tomography (ERT) method in investigating the carbonate karst of the Zakrzówek Horst

A characteristic features of the geological structure of the Krakow area are tectonic horsts and grabens. The Zakrzówek Horst is one of the seven horst structures within the Krakow area, located in the south-western part of the area. It is built of Upper Jurassic limestones, where numerous karst caves have been developed. The caves of the Zakrzówek Horst probably form a system of interconnected caves. This hypothesis has been tested in the western region of the Zakrzówek Horst using the electrical resistivity tomography (ERT) method. The investigations were conducted in the parallel profile configuration as well as with the data processing procedure based on the 2D and 3D inversion. The results of these studies are an attempt to locate additional voids as well as fractured zones in the carbonate rock mass. The studies confirmed the hypothesis that the Jasna Cave is probably only a fragment of a vast cave system developed within the Zakrzówek Horst. As a result of the research carried out with the ERT method, the most prospective directions for future speleological research have been determined

The Role of Histidine-Rich Proteins in the Biomineralization of Hemozoin

    Get PDF
Hemozoin formation, the consequential end product of the proteolysis of hemoglobin by Plasmodium falciparum, is essentially a biomineralization process whereby toxic free heme is aggregated into an inert crystalline solid, also known as malaria pigment or ß-hematin. The histidine-rich protein II (HPR II), isolated from the digestive vacuole of the parasite, has been implicated in the mediation of this biomineral through the protein\u27s ability to bind heme, aggregate the biomineral, and be effectively inhibited by known antimalarials, including chloroquine. The HRP II sequence, which is comprised of 76% of histidine and alanine residues, has a specific amino acid repeat motif which is reminiscent of nucleating scaffold proteins utilized by other biological systems in biomineralization processes. Using a peptide dendrimer previously developed in our laboratory as a functional HRP II mimic, we examined two domain repeats, Ala-His-His-Ala-His-His-Ala-Ala-Asp and Ala-His-His-Ala-Ala-Asp-Ala-His-His, as putative hemozoin nucleating sequences. Results indicated the Ala-His-His-Ala-His-His-Ala-Ala-Asp repeat of peptide dendrimer BNT II was the most probable nucleating domain within the HRP II sequence. Site-directed mutagenesis studies were then utilized to elucidate the role of the nucleating domain per active site amino acids

How Affect Rhetoric And A Changing Digital Landscape Shape Youth Digital Social Movements Of The Twenty-First Century

    Get PDF
This dissertation explores three youth digital social movements, which have taken place throughout the twenty-first century: the Invisible Children movement of Uganda, the Bring Back Our Girls movement of Nigeria, and the Never Again movement of the United States. Using rhetorical analysis of each movement, I explore the relationship each has with youth, digital, social movement, and activism. Specifically, I seek to answer the following research questions: (1) with youth in the forefront of each movement, how have the movements utilized affective rhetoric to promote and gain support, and (2) how have youth digital social movements evolved throughout the twenty-first century?I argue that key components of youth digital social activism include the ability to get movement followers to connect on an emotional level with the cause of the movement in order to get them to move offline and act outside of the digital realm and providing specific, detailed steps for movement followers to avoid getting stuck in the online vortex that can lead to a version of slacktivism. Ultimately, this research provides insight for future social activists and movement leaders to learn from and adapt accordingly, and important areas for future scholars to focus their attention

The article presents a method of electrical resisitivity tomography which allows to identify the geological structure of the basement. Resistivity tomography was also used to detection of anthropogenic objects in Brzozówka and Zabierzów areas. A total of six profiles were done, on the basis of which it also describes applications of the electrical resistivity tomography for the near surface prospecting as well as its ability to detect and localize antropogenic objects
