    Raskolnikov: Not the Typical Criminal Man

    Criminologists in the nineteenth century gave much effort to identify, classify, and understand the physical, social, and psychological characteristics of the world’s criminals. Using the lens of these early criminological theories and the scholarly interpretations of Dostoevsky’s Raskolnikov, this paper explores the dimensions of Raskolnikov as a criminal character. Ultimately, these developing psychological and criminal anthropological theories are not successful in explaining the character of Raskolnikov. This exploration sheds light on a fundamental characteristic of human nature that Dostoevsky understands. Just as Raskolnikov is unable to be fully characterized by his utilitarian social theories, and by the theories of early criminologists, humanity is fundamentally unable to be reduced to a theory

    Judicial Review of Antitrust Consent Decrees: Reconciling Judicial Responsibility with Executive Discretion

    For nearly eighty years the Department of Justice has disposed of civil antitrust suits through settlement negotiations followed by entry of a consent decree. Though not expressly authorized by statute, the Supreme Court has affirmed the use of this powerful enforcement tool. In 1974, Congress enacted the Antitrust Procedures and Penalties Act (APPA), which includes a provision that district court judges must determine if a proposed consent decree is in the public interest before entering it. This Note analyzes the standards applied by the courts in their review of consent decrees before the enactment of the APPA. the congressional intent in passing the legislation, and the standards that courts have applied since its enactment-focusing on the unclear staidard for making the public interest determination. The Note explores the implications of the new and ill-advised standard applied by the district court in United States v. American Telephone & Telegraph Co. In concluding that the cases have not yet established a satisfactory analytical formula for reviewing consent decrees, the Note proposes a workable standard of review that will allow the courts to simultaneously make an independent determination that the proposed decree is in the public interest, preserve the consent decree as a viable enforcement tool, and accord the Department of Justice the discretion it needs to enforce the antitrust laws

    A translator writing system for microcomputer high-level languages and assemblers

    In order to implement high level languages whenever possible, a translator writing system of advanced design was developed. It is intended for routine production use by many programmers working on different projects. As well as a fairly conventional parser generator, it includes a system for the rapid generation of table driven code generators. The parser generator was developed from a prototype version. The translator writing system includes various tools for the management of the source text of a compiler under construction. In addition, it supplies various default source code sections so that its output is always compilable and executable. The system thereby encourages iterative enhancement as a development methodology by ensuring an executable program from the earliest stages of a compiler development project.     Medical humanities as expressive of Western culture

    In this paper we articulate a growing awareness within the field of the ways in which medical humanities could be deemed expressive of Western cultural values. The authors suggest that medical humanities is culturally limited by a pedagogical and scholarly emphasis on Western cultural artefacts, as well as a tendency to enact an uncritical reliance upon foundational concepts (such as ‘patient’ and ‘experience’) within Western medicine. Both these tendencies within the field, we suggest, are underpinned by a humanistic emphasis on appreciative or receptive encounters with ‘difference’ among patients that may unwittingly contribute to the marginalisation of some patients and healthcare workers. While cultural difference should be acknowledged as a central preoccupation of medical humanities, we argue that the discipline must continue to expand its scholarly and critical engagements with processes of Othering in biomedicine. We suggest that such improvements are necessary in order to reflect the cultural diversification of medical humanities students, and the geographical expansion of the discipline within non-Western and/or non-Anglophone locations

    Factors Affecting Teachers’ Grading and Assessment Practices

    Teachers’ classroom grading and assessment practices are important elements of assessment reform. The purpose of this study was to examine the effect of classroom learning factors such as class size, subject area, and school size on teachers’ classroom assessment practices. The results of a survey of 513 high school teachers showed evidence that teachers had implemented some aspects of assessment reform and that one classroom learning factor (i.e., subject) had a modest effect on teachers’ practices. The results also indicate a need for more research on factors that affect teachers’ assessment decisions and the effect of these decisions on implementing assessment reform.Les pratiques d’évaluation et de classement des enseignants constituent des éléments importants de la réforme de l’évaluation. Cette étude porte sur l’influence qu’ont les facteurs d’apprentissage tels l’effectif d’une classe, le domaine d’études et la taille de l’école sur les pratiques d’évaluation des enseignants. Les résultats d’un sondage auprès de 513 enseignants du secondaire révèlent, d’une part, que les enseignants avaient mis en application quelques aspects de la réforme de l’évaluation et, d’autre part, qu’un facteur d’apprentissage (le domaine d’études) avait un léger effet sur les pratiques des enseignants. Les résultats indiquent également qu’il faut faire davantage de recherche sur les facteurs qui jouent un rôle dans les décisions que prennent les enseignants quant à l’évaluation et sur l’effet de ces facteurs sur la mise en pratique d’une réforme de l’évaluation. @H1 = Introductio
