Kesadaran hukum pelaku usaha Home Industry makanan terhadap sertifikasi halal perspektif Maqashid Syariah: Studi di Desa Sumberejo Batu

ABSTRAK Pelaku usaha dituntut untuk mengetahui aturan dalam menjalankan kegiatan usahanya. Hal ini agar tercipta keamanan, kenyamanan, dan ketentraman konsumen dalam mengkonsumsi suatu produk. Dalam hal ini pemerintah telah mengatur dan mengawasi adanya peraturan yang mengatur terkait dengan Jaminan Produk Halal. Urgensi Jaminan Produk Halal adalah untuk mendorong pelaku usaha agar proaktif untuk melakukan sertifikasi halal ke lembaga yang berwenang agar terciptanya perlindungan bagi konsumen muslim. Karena pelanggaran pada produk yang berkaitan dengan kehalalan dapat merugikan konsumsen terutama konsumen muslim di Indonesia. Rumusan masalah dalam penelitian ini adalah 1) Bagaimana kesadaran hukum pelaku usaha home industry makanan terhadap sertifikasi halal di Desa Sumberejo Batu tentang Jaminan Produk Halal? 2) Bagaimana kesadaran hukum pelaku usaha home industry makanan terhadap sertifikasi halal di Desa Sumberejo Batu perspektif Maqashid Syariah? Penelitian ini merupakan penelitian yuridis-empiris, pendekatan yang digunakan adalah pendekatan yuridis-sosiologis, metode pengumpulan data yang digunakan adalah wawancara dan dokumentasi, kemudian metode pengolahan data dengan tahap edit, klasifikasi, verifikasi, analisis, dan kesimpulan. Berdasarkan hasil pembahasan menunjukkan bahwa pertama, kesadaran hukum pelaku usaha home industry di Desa Sumberejo Batu masih rendah. Pada realitanya JPH masih belum mendapat perhatian dan pemahaman oleh pelaku usaha home industry di Desa Sumberejo Batu. Karena pelaku usaha belum mendaftarkan sertifikasi halal sesuai dalam aturan UU JPH. Kedua, dalam pandangan maqashid syariah ketika pelaku usaha home industry di Desa Sumberejo Batu tidak mematuhi UU JPH, mereka belum adanya jaminan pemeliharaan terhadap jiwa (Hifzh al-Nafs). Hal ini berkaitan dengan tidak adanya labelisasi halal yang tercantum diproduk, karena kehalalan suatu produk menjadi prioritas pilihan konsumen. Karena untuk memberikan keamanan, kenyamanan, dan keselamatan kepada konsumen. ABSTRACT Business actors are required to know the rules in carrying out their business activities. This is to create security, comfort, and peace of consumers in consuming a product. In this case the government has regulated and supervised the existence of regulations related to Halal Product Assurance. The urgency of Halal Product Assurance is to encourage business actors to be proactive in obtaining halal certification from authorized institutions in order to create protection for Muslim consumers. Because violations of products related to halal can be detrimental to consumers, especially Muslim consumers in Indonesia. The formulation of the problems in this research are 1) What is the legal awareness of food home industry entrepreneurs regarding halal certification in Sumberejo Batu Village regarding Halal Product Assurance? 2) What is the legal awareness of food home industry actors regarding halal certification in Sumberejo Batu Village from the perspective of Maqasid Syariah? This research is a juridical-empirical research, the approach used is a juridical-sociological approach, the data collection method used is interviews and documentation, then the data processing method is with the stages of editing, classification, verification, analysis, and conclusions. Based on the results of the discussion, it shows that first, the legal awareness of home industry entrepreneurs in Sumberejo Batu Village is still low. In reality, JPH still has not received the attention and understanding of home industry entrepreneurs in Sumberejo Batu Village. Because business actors have not registered halal certification according to the rules of the JPH Law. Second, in the view of maqasid sharia, when home industry entrepreneurs in Sumberejo Batu Village do not comply with the JPH Law, they have no guarantee of maintenance of their lives (Hifzh al-Nafs). This is related to the absence of halal labeling listed on the product, because the halalness of a product is a priority for consumer choice. Future study on CDIO programs in social informatics education has the potential to augment the technical proficiency and social consciousness of graduates, thereby rendering them significant contributors to the field
