    The discussion on tadlis has been quite complicated since Muslim jurists are in dispute over its meaning. Some tend to interchange it with taghrir and ghabn. While others suggest that the doctrine of tadlis and misrepresentation are so closely interrelated. This article suggests that the doctrine of tadlis is so akin to taghrir and ghabn which mean fraud. It also suggests that the effect of fraud in Islamic transactions is that the defrauded party may rescind the contract by exercising the option of fraud (khiyar al-tadlis)

    The legal framework of the Islamic financial system in Malaysia is subjected to civil law. This is because the Federal Constitution which divides the jurisdiction of the civil and shari’ah matters is silent on whether the Shari’ah Court has the power to hear cases or disputes relating to Islamic finance. As such, numerous interpretations of the Civil Court in contractual and financial applications are given. Some of them conflict with the Shari’ah law and rather emphasise on the usage of the civil law. Henceforth, this study will be focusing on the results and interpretations of the Civil Court in cases of Islamic finance and banking. Furthermore, the authors recommend some amendments to the Constitution and relevant Acts, to strengthen the laws relating to Islamic finance and to enhance the role of the Shari’ah Court

    Temporary food handlers’ compliance with effective food-hygiene practices

    Success in food handling depends, in part, on a self-regulation practice factor that accounts for better results in food safety. A self-report study conducted on 318 food handlers reveal that temporary workers were able to comply with the overall hygiene practices outlined in the 1983 Malaysian Food Act and the 2009 Food Hygiene Regulations. This study also shows that proper training of these workers could result in high-level hygiene practices at public food service institutions that would satisfy the community’s appetite for safe and healthy food

    A revisit to the practice of late payment charges by Islamic Banks in Malaysia

    Islamic banking in Malaysia have been experiencing late payment and default issues because customers are not allowed to be charged with interest (riba) as opposed to the practices in the conventional banking. To mitigate these issues, the Shariah Advisory Council of Bank Negara Malaysia has enforced ta’widh and gharamah as regulatory alternatives. Practically, ta’widh and gharamah were imposed on the defaulting customers who fail to meet their obligation to pay their financing based on several conditions. Given the significance of its imposition, this paper aims to analyse the current practice in Islamic banks and examine the views of contemporary Muslim scholars on ta’widh and gharamah and its suitability as alternatives for avoidance of riba

    This study suggests an effort through a Holistic View of spiritual intelligence to address low-quality food problem at public institutions in East Malaysia. It explored the causal relationship of this value to Food Performance, Leadership Effectiveness, and Food-Hygiene Practice through 210 food handlers. The Partial Least Square Structural Equation Modeling (PLS-SEM) was used to test the relationship. Holistic View was found to have a positively significant relationship with the performance but, not Leadership Effectiveness. Holistic View among food handlers was found unaffected by Food hygiene practices

    Archimedes Optimization Algorithm Based Selective Harmonic Elimination in a Cascaded H-Bridge Multilevel Inverter

    This paper presents the Archimedes optimization algorithm to eliminate selective harmonics in a cascaded H-bridge (CHB) multilevel inverter (MLI). The foremost objective of the selective harmonic elimination (SHE) is to eliminate lower order harmonics by finding the optimal switching angle combination which minimizes the objective function containing Total Harmonic Distortion (THD) and other specific harmonic terms. Consequently, the THD is also reduced. In this study, a recently proposed metaheuristic technique named the Archimedes optimization algorithm (AOA) is used to determine the optimal angles corresponding to the 5, 7 and 9 level CHB-MLI. AOA involves equations related to a physical law, the Archimedes Principle. It is based on the idea of a buoyant force acting upward on a body or object that is partially or completely submerged in a fluid, and the upward force is related to the weight of the fluid displaced. This optimization technique has been implemented on CHB-MLI to generate various level outputs, simulated on MATLAB™ R2021a version environment software. The simulation results reveal that AOA is a high-performance optimization technique in terms of convergence speed and exploitation-exploration balance and is well-suited to the solution of the SHE problem.
