    Penelitian ini bertujuan untuk menakar kebijakan affirmative action dalam sistem kepartaian. Penelitian ini menggunakan jenis penelitian hukum empiris yaitu penelitian tentang bekerjanya hukum (law in action) di masyarakat. Hasil penelitian menunjukkan bahwa Kebijakan afirmasi yang ditegaskan dalam sistem kepartaian di Indonesia belum sepenuhnya dilaksanakan oleh internal partai politik. Hal ini terbukti dalam beberapa partai politik diantaranya Golkar, PKS, PAN, Demokrat, dan Nasdem yang dalam Anggaran Dasar dan Anggaran Rumah Tangga belum tertuang pasal yang mengatur kuota 30% keterwakilan perempuan. Maka dapat dipastikan bahwa Anggaran Dasar dan Anggaran Rumah Tangga tersebut cacat dan jika Anggaran Dasar dan Anggaran Rumah Tangga tersebut diuji dalam konteks Undang-Undang Partai Politik, maka dapat dipastikan partai tersebut melanggar. Affirmative action telah diatur dalam ketentuan nasional. Undang-Undang Partai Politik dan Undang-Undang Pemilihan Umum. Namun pada tataran praktis, kebijakan tersebut belum memberikan kepastian, kemanfaatan dan keadilan

    Legal Responsibilities of Members of the Makassar City Regional People's Representative Council (DPRD) to their Constituents in the Electoral District

    This research aims to examine the legal responsibilities of members of the Makassar City Regional People's Representative Council (DPRD) towards their constituents in the electoral district, as well as identifying the inhibiting factors faced by DPRD members in fulfilling their responsibilities towards constituents in their respective electoral areas. Employing an empirical legal research approach, the study seeks to comprehend the actual application of law and explore its functionality within the societal context, conceptualizing it as a social phenomenon influenced by various social variables. The study was conducted at the Makassar City DPRD office. Data collection methods encompassed interviews, observations, and literature review. The acquired data underwent qualitative analysis and descriptive elucidation. The research findings reveal that a significant number of elected representatives do not demonstrate expected behaviors, resulting in a considerable deficiency in their role of fulfilling responsibilities towards constituents in the electoral district. These limitations are attributed to several inhibiting factors, including inadequate community participation, limited financial allocation from the Makassar city government, constraints in meeting times and facilities, and the diverse and busy schedules of both DPRD members and constituents

    Permasalahan di bidang pendidikan yang terjadi di Indonesia sampai saat ini adalah tidak meratanya akses pendidikan. Tingkat dan kualitas pendidikan menjadi faktor yang sangat menentukan arah pertumbuhan bangsa. Penelitian ini adalah penelitian hukum empirik. Penelitian dilakukan di Kabupaten Manokwari, Provinsi Papua Barat. Hasil penelitian ini menunjukkan bahwa secara yuridis, dalam tataran internasional maupun nasional, instrumen hukum dan peraturan perundang-undangan Indonesia mengakui tentang adanya prinsip persamaan hak antara laki-laki dan perempuan. Hal itu menunjukkan bahwa implementasi kebijakan otonomi khusus di bidang pelayanan pendidikan di Kabupaten Manokwari, meliputi pemberian layanan kemudahan melalui dibentuknya Pendidikan Layanan Khusus bagi peserta didik di daerah terpencil, dan/atau mengalami bencana alam, bencana sosial, dan yang tidak mampu dari segi ekonomi. Selain itu, mewujudkan layanan pendidikan bermutu dengan menjamin ketersediaan guru dan distribusi guru yang tepat sasaran. Intervensi dalam Proses Pembelajaran. Prasyarat yang harus terpenuhi untuk meningkatkan akses dan mutu pendidikan di Papua dan Papua Barat adalah pemenuhan sarana pendidikan yang terstandarisasi. Selain itu, harus dikembangkan kurikulum lokal yang kontekstual dengan memperhatikan tipologi wilayah di tanah Papua.     This research aims to know and explain the application of the principles of good governance, namely the principles of transparency and participation and the constraints of applying the principles of transparency and participation in public services. The research method used is empirical research method, to achieve this goal, so this research uses data collection techniques through interviews, observations, document studies, and documentation. While the data sources used are primary and secondary data sources. The approach of this research is conceptual approach that is moving from the views or doctrines that develop in the science of law and the approach of the Law, namely the approach carried out by edilah regulation related to legal issues that are being studied. The results revealed that the principle of transparency has not run optimally because the SOP has not been informed to the public, the principle of participation has not run optimally because the management of complaints has not been good. Therefore, in the context of public services that are a very strategic part in measuring good governance needs to be optimized by providing SOP information on information boards, websites, brochures, opening complaints through social media or working with village officials, head of Cluster Area to directly socialize public service procedures and policies to the community

    Structuring Autonomy System in Realizing the Peoples’ Welfare in Indonesia

    This research reviews the structuring autonomy system in realizing the peoples’ welfare in Indonesia. The type of study was a normative-juridical research. Research is conducted qualitatively with library research within primary and secondary legal approach. Data were analyzed with descriptive qualitative analysis with content analysis. The outcomes of the research indicate that the basic principle of the enactment of local autonomy is a broad principle, real and responsible. As it turns out in practice, however, it has certain weaknesses, particularly in view of the accountability and legitimacy aspects of its establishment. Unfortunately, this principle is no longer shared by local government laws that exist today, so that it shows the existence of local autonomy into weak. The arrangement of decentralized governance in Indonesia is still influenced by the conflict of interest between the central and local government. Reviewing from the aspect of social welfare, the implementation of local autonomy system has not been fully able to realize the welfare of the people in Indonesia, this is caused by the pattern of relationships between central and local governments is unclear both from the aspect of authority, financial and community empowerment.     The Essence of the Presidential Election as a Political Education Instrument

    The principle of people sovereignty in the state’s administration in its implementation is reaffirmed in Article 1 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. There are 2 (two) basic essentials of regulation of the election of the President as an instrument of political education, first – Facilities to Increase Political Participation can be approached in to some laws such as the 1945 Indonesian Constitution, the Law Number 23 of 2003 concerning the Election of the President and Vice President, the Law No. 42 of 2008 concerning the Election of the President and Vice-President, and The Law No. 7 of 2017 concerning Elections; Second, Realizing Responsible Governance. It means that General election is universally interpreted as an institution as well as a political practice that enables the formation of a legitimate government. Therefore, elections are not only related to the facility for the people to articulate their aspirations and interests, but also become a test tool for the validity of government power. Therefore, the nature of the presidential election arrangement is as a facility of increasing citizens' literacy and political awareness. Therefore, they can actively raise awareness and participation of the people's politics and create a responsible government as a constitutional mandate.     The Nature of General Election Supervisory Board (Bawaslu) as the Guardian of the People's Sovereignty

    Genaral election is one manifestation of a democratic system of state administration. The general election administration with different variants/models has been carried out in democracy modern countries in a specific purpose. The basic regulation of it can be seen in the third amendment to the 1945 Constitution Chapter VII B on General Election Article 22E. To guarantee the implementation of democratic elections (the general election) run in accordance with the principles of the election and the electoral law, it is needed on body to supervise the election – called General Election Supervisory Board (hereinafter referred to Bawaslu). Its decision is final and binding. Bawaslu as the guardian of democracy is visible when the democracy is in the form of active democracy. This is consistent with the concept of the supervison of Bawaslu to monitor, review, check, and assess democracy in the active position, or when the democracy is embodied in the election. So, when the election is carried out by KPU, supervision process never stops starting stages of updating the voter list to the polling, counting, and determination of election results.     Pelaksanaan Pengawasan Atas Penangkap Ikan yang Dapat Mengganggu dan Merusak Keberlanjutan Sumber Daya Ikan

    ABSTRACT: This study aims to determine the legal regulations implementation and law enforcement in supervision over fishing in Pangkep Regency. The research data is classified into 2 (two) types of data, namely primary data and secondary data. Data collection was carried out in 2 (two) ways, viz. library research methods and field research methods. After the relevant data is collected, the data is analyzed descriptively qualitatively, which describes the applicable laws and regulations related to legal theories and positive law enforcement practices that raise related issues. Based on the exposure of the research results, the authors then draw the following conclusions: (a) The implementation of legal regulations on the supervision of fishers in Pangkep Regency is carried out in several ways, namely the establishment of law enforcement arrangements for fishing activities in Pangkep Regency; (b) supervising marine and fishery resources for fishing in Pangkep Regency; (c) understand the forms of fishing violations in Pangkep Regency along with the implementation of supervision; (d) implement sanctions for fishing violations in Pangkep Regency. Then, the factors that affect the effectiveness of law enforcement in terms of supervision over fishing in Pangkep Regency are legal factors, law enforcement official’s factors, community factors, facilities factors, and cultural factors. ABSTRAK: Tujuan penelitian ini adalah guna mengetahui implementasi peraturan hukum serta efektivitas penegakan hukum dari segi pengawasan atas penangkap ikan di Kabupaten Pangkep. Penelitian ini tergolong jenis penelitian empiris. Pengumpulan data dilakukan dengan 2 (dua) cara yakni metode penelitian kepustakaan dan metode penelitian lapangan. Setelah data relevan dihimpun, maka data tersebut dianalisis secara deskriptif kualitatif yaitu menggambarkan peraturan perundang-undangan yang berlaku dikaitkan dengan teori-teori hukum dan praktek pelaksanaan hukum positif yang mengangkat permasalahan terkait. Berdasarkan paparan hasil penelitian, penulis kemudian menarik kesimpulan sebagai berikut:  (a) Implementasi peraturan hukum terhadap pengawasan atas penangkap ikan di Kabupaten Pangkep dilakukan dengan beberapa cara yaitu pembentukan pengaturan penegakan hukum atas aktivitas penangkapan ikan di Kabupaten Pangkep; (b) melakukan pengawasan sumber daya kelautan dan perikanan terhadap penangkapan ikan di Kabupaten Pangkep; (c) memahami bentuk-bentuk pelanggaran penangkapan ikan di Kabupaten Pangkep disertai implementasi pengawasan; (d) melakukan penerapan sanksi pelanggaran penangkapan ikan di Kabupaten Pangkep. Kemudian, faktor-faktor yang mempengaruhi efektivitas penegakan hukum dari segi pengawasan atas penangkap ikan di Kabupaten Pangkep yaitu faktor hukum, faktor aparat penegak hukum, faktor masyarakat, faktor sarana, dan faktor kebudayaan

    Reconstructing Local Representatives Budgeting Function: Development Planning and Budgeting in Decentralized Indonesia

    Several empirical studies reveal inconsistencies in planning and budgeting in many regions in Indonesia. Despite being the cause of inconsistencies, the budgetary authority of the local representative is unlikely to be abolished. It is reflected in the work of the local representatives in the area of budget allocation. The research is a normative legal research and supported by statutory and conceptual approaches; it is a reform-oriented research. The results show that the essence of the budget function of local representatives is supervision. Through this function, the local representatives supervise the determination of sources of regional revenue and expenditure in one year. It is carried out by discussing and approving or disapproving the draft proposed by the regional head. The local representative is still referred to as a controlling agency for regional budgeting and expenditure (control of budget). It is intended for the regional budget can truly be an instrument to realize community welfare through planning. Currently, the mechanism of budget discussion is long and complicated, making it difficult for local governments to maintain the consistency of plans in the budgeting process. The mechanism of discussion must be reconstructed in its concept as a way to maintain the consistency of budgeting decisions with planning.     IMPLEMENTATION OF FUNCTIONS OF POLITICAL PARTY IN INDONESIAN CONSTITUTIONAL SYSTEMS

    In Indonesia, the existence of the political party is form of freedom of association and  freedom of assembly, which is existence  derivative of freedom of thought and freedom of expression. Therefore, the freedom of association is deemed as  various forms political activity in the political party, which is in accordance with the laws and is protected through the Indonesian Constitution. Reform era has been give away room for political freedom and freedom of expression for comprehensively growth for the political party marked with more and more the amount the political party formed. In 1999, 48 the political parties participated in the first election in the reform era. In the next election period, in 2004, it was 24 contestants participated in the election. In 2009 then, there were 44 the political parties participating in political elections. Finally,  in 2014,  15 of the political parties came along the election. The function of the political parties can be seen in Article 11 of the Law No. 2 of 1999 concerning The Political Party. In terms of the political education for the community, Article 31 of the Law No. 2 of 1999 concerning The Political Party emphasises on the issue.
