Note: The Legislature Should Clean Up Its Act—The Minnesota Citizens’ Personal Protection Act, a DNR Technical Bill, and the Single-Subject and Title Clause of the Minnesota Constitution

This note explores the Ramsey County District Court’s decision in Unity Church v. Minnesota recently affirmed by the Minnesota Court of Appeals. This note does not, however, debate the merits of Minnesota’s conceal-and-carry law. Part II traces the legislative path taken by both the natural resource and conceal-and-carry bills. Part II surveys the history of the single-subject and title clause of the Minnesota Constitution and the evolution of the Minnesota Supreme Court’s interpretation of the clause since its enactment. Part III summarizes the factual and procedural posture of the Unity Church decision. Part IV then contends that the legislature’s enactment of the amended natural resource law failed to comply with the single-subject provision of article IV, section 17 of the Minnesota Constitution. Moreover, this note asserts a contrary holding eviscerates the Blanch v. Suburban Hennepin Regional Park District “mere filament” test to a “mere figment” and renders the single-subject and title clause meaningless. In contrast to the law’s failure to comply with the single-subject provision, this note contends that the amended natural resource law’s title gave reasonable notice of its contents. Further, Part IV asserts that the proper sanction renders the entire law unconstitutional. This note concludes that the appellate courts should return to their proper role in interpreting the single-subject and title clause of the Minnesota Constitution, namely to give each part of the constitution the plain meaning and effect of its language

Neue Raumtypen für die Mobilitätsforschung

Aus der Mobilitätsforschung des Bundes kommt der Wunsch nach einer stark differenzierten Raumtypik, die sich sowohl als wissenschaftliches Analyseinstrument qualifiziert als auch raumordnerische Leitvorstellungen abbilden kann. Ein erster Entwurf auf Ebene der 4 532 Gemeindeverbände identifiziert 13 Gruppen von Metropolen, Regiopolen, größeren Mittelstädten und städtischer wie ländlicher Umgebung in Metropol-, Regiopol, zentrennahen und peripheren Gebieten. Erste Tests zeigen signifikante Mittelwertunterschiede bei der Bevölkerungs- und der Siedlungsflächenentwicklung wie bei den Pendlerbeziehungen. Inwiefern diese Raumtypik aber als universelles Analyseinstrument in der Raumforschung gelten kann, muss sich noch zeigen. Überdies sind weitere Anforderungen – rasterbasierte Darstellung und innerkommunale Differenzierungen – noch nicht umgesetzt

Diffusion et valorisation de la recherche urbaine française sur les pays en voie de développement dans les années quatre vingt

La présente étude vise à identifier les réalités de la diffusion et de la valorisation de la recherche urbaine française portant sur les pays en développement, au cours des dix dernières années. L'étude s'est concentrée sur la recherche finançée par les deux principaux ministères qui ont commandité des recherches et lançé des appels d'offres dans ce domaine,le ministère de l'Equipement et celui de la Recherche. Pour les différents commanditaires : le Plan Construction et le Programme Rexcoop, le Plan Urbain, le Bureau de la Recherche Architecturale, le Ministère de la Recherche, sont donnés l'historique des thèmes et des appels d'offre, la liste des études produites et les modalités de leur diffusion. Puis sont recensés les instruments de la diffusion : centres de documentation, banques de données, réseaux scientifiques, édition puis le rôle des chercheurs et de leurs institutions dans la diffusion des résultats de la recherche. A partir du constat d'une mauvaise diffusion des rapports de recherche, l'auteur prône un certain nombre de mesures pour y remédier, en particulier conforter le rôle du centre de documentation de "Villes en Développement

Stadt-Umland-Definitionen in der Raumbeobachtung

Stadtregionsabgrenzungen stellen ein Instrumentarium dar, die gesellschaftliche und politische Debatte um die Stadtentwicklung und Transformationsprozesse innerhalb und zwischen Städten und ihrem Umland empirisch-analytisch begleiten zu können. Für die Bundesrepublik existieren verschiedene Abgrenzungen, von denen in diesem Beitrag vier vergleichend näher vorgestellt werden. Um angemessen die stattfindenden Transformationsprozesse abbilden zu können, sind differenzierte Typen hilfreicher als Abgrenzungen, die ausschließlich Städte und deren Umland definieren. Da es zukünftig Daten auf Rasterebene geben wird, sind entweder parallel neue Abgrenzungen auch für diese kleinteilige Ebene zu entwickeln oder bestehende Abgrenzung dahingehend zu verfeinern

Systematische Gliederung der Böden Mitteleuropas - Statusbericht der AG Bodensystematik

Die Arbeitsgruppe Bodensystematik der Kommission  Bodengenetik, Bodensystematik, Bodeninformation trifft sich jeweils 3 Mal pro Jahr für 3 Tage.  Im Focus der Beratungen stehen die pedogene Gliederung der Böden Mitteleuropas sowie die Gliederung der bodenbildenden Substrate. Im Statusbericht wird die Weiterentwicklung der Gliederungen im Vergleich zur fünften Auflage der Bodenkundlichen Kartieranleitung vorgestellt. Schwerpunkt der aktuellen Diskussionen sind die Gliederung der Terrae calcis, Pelosole, A/C-Böden und terrestrischen Organosole
