    Parens patriae: the paternalist model of children's rights

    This study examines the role that paternalism plays in the exercise and vindication of the rights of the child. This study demonstrates that paternalism plays a determining role in the exercise and vindication of the rights of the child. The study shows that this paternalism was originally inherent in judicial lawmaking, deployed as a consequence of the importance of parens patriae to the constitutional and administrative framework of the State. The thesis analyses the judicial role in proceedings involving the rights of the child in Ireland, England, the United States and to a lesser extent Canada. The thesis demonstrates that the judicial role has a dual function. First, the judge must protect the integrity of the family unit to which a child is born. Second, the judge is the protector and vindicator of the child's rights. Chapter 1 outlines the rights model and the concept of parens patriae. This chapter also constructs the welfare model regulating the relationships between the child, parents and the State. This chapter shows that the judiciary have developed the welfare model in which they are the dominant actors. In chapter 2 the relevant literature is discussed and analysed. Chapters 3, 4 and 5 prove that judicial paternalism plays a determining role in proceedings concerned with the exercise and vindication of the rights of the child in the health care, education and juvenile justice systems. Chapter 6 contains the conclusions to this study and provides suggestions for reform. The main conclusion of the thesis is that an optimal model of child law must reiterate the concept of parens patriae shorn of its inappropriate paternalistic accretions

    Defining “elite” status in sport: from chaos to clarity

    The past two decades have seen a rapid rise in attention towards talent identification, athlete development and skill acquisition. However, there are important limitations to the evidentiary foundations of this field of research. For instance, variability in describing the performance levels of individuals has made it challenging to draw inferences about inter- and intrapopulation differences. More specifically, recent reviews on high performers in sport have noted considerable variation in how terms such as “elite” are used. This may be particularly concerning for researchers in high-performance disciplines, since they regularly struggle with small sample sizes and rely on research synthesis approaches (i.e. meta-analyses and systematic reviews) to inform evidence-based decisions. In this discussion piece, we (a) highlight issues with the application of current terminology, (b) discuss challenges in conceptualizing an improved framework and (c) provide several recommendations for researchers and practitioners working in this area

    Maturity-Associated Polygenic Profiles of under 12–16-Compared to under 17–23-Year-Old Male English Academy Football Players

    The purpose of this study was to examine polygenic profiles previously associated with maturity timing in male academy football players across different age phases. Thus, 159 male football players from four English academies (U12–16, n = 86, aged 13.58 ± 1.58 years; U17–23, n = 73, aged 18.07 ± 1.69 years) and 240 male European controls were examined. Polygenic profiles comprised 39 single nucleotide polymorphisms and were analysed using unweighted and weighted total genotype scores (TGSs; TWGSs). There were significant differences in polygenic profiles between groups, whereby U17–23 players had more genetic variants associated with later maturity compared to U12–16 players (TGS, p = 0.010; TWGS, p = 0.024) and controls (TGS, p = 0.038; TWGS, p = 0.020). More specifically, U17–23 players had over two-times the odds of possessing >36 later-maturing alleles than <30 compared to U12–16 players (odds ratio (OR) = 2.84) and controls (OR = 2.08). These results suggest there was a greater proportion of relatively later-maturing players as maturation plateaus towards adulthood, which may be explained by the ‘underdog hypothesis’. This study provides the first known molecular evidence that supports the notion that a maturity selection bias exists within male academy football

    Genetic associations with personality and mental toughness profiles of English academy football players: An exploratory study

    Psychological characteristics influence the performance of youth football players and are significant predictors of development and success at adulthood. Although genetic factors may explain a considerable portion of inter-individual differences in psychological traits, psychogenetic research in football is scarce. As such, the purpose of this study was to examine the association of ten single nucleotide polymorphisms (SNPs) with personality and mental toughness profiles of academy football players. Seventy-three male under-12 to under-18 football players from a Category 3 English academy were genotyped for ten SNPs. Personality and mental toughness were assessed using a 50-item IPIP Big Five personality traits questionnaire and the Mental Toughness Index, respectively. Simple linear regression was used to analyse individual SNP associations with personality dimensions and mental toughness, whereas both unweighted and weighted total genotype scores (TGSs; TWGSs) were computed to measure the combined influence of all SNPs. There was a significant association between DRD3 (rs167771) and agreeableness (p = .043), where A/A homozygotes scored higher than G allele carriers. TGSs and/or TWGSs were significantly correlated with mental toughness and each personality dimension except openness, explaining between 3 and 17% of the variance. The results of this study suggest psychological characteristics of youth football players are partly determined by genetic factors

    Protocolised non-invasive compared with invasive weaning from mechanical ventilation for adults in intensive care : the Breathe RCT

    Background: Invasive mechanical ventilation (IMV) is a life-saving intervention. Following resolution of the condition that necessitated IMV, a spontaneous breathing trial (SBT) is used to determine patient readiness for IMV discontinuation. In patients who fail one or more SBTs, there is uncertainty as to the optimum management strategy. Objective: To evaluate the clinical effectiveness and cost-effectiveness of using non-invasive ventilation (NIV) as an intermediate step in the protocolised weaning of patients from IMV. Design: Pragmatic, open-label, parallel-group randomised controlled trial, with cost-effectiveness analysis. Setting: A total of 51 critical care units across the UK. Participants: Adult intensive care patients who had received IMV for at least 48 hours, who were categorised as ready to wean from ventilation, and who failed a SBT. Interventions: Control group (invasive weaning): patients continued to receive IMV with daily SBTs. A weaning protocol was used to wean pressure support based on the patient’s condition. Intervention group (non-invasive weaning): patients were extubated to NIV. A weaning protocol was used to wean inspiratory positive airway pressure, based on the patient’s condition. Main outcome measures: The primary outcome measure was time to liberation from ventilation. Secondary outcome measures included mortality, duration of IMV, proportion of patients receiving antibiotics for a presumed respiratory infection and health-related quality of life. Results: A total of 364 patients (invasive weaning, n = 182; non-invasive weaning, n = 182) were randomised. Groups were well matched at baseline. There was no difference between the invasive weaning and non-invasive weaning groups in median time to liberation from ventilation {invasive weaning 108 hours [interquartile range (IQR) 57–351 hours] vs. non-invasive weaning 104.3 hours [IQR 34.5–297 hours]; hazard ratio 1.1, 95% confidence interval [CI] 0.89 to 1.39; p = 0.352}. There was also no difference in mortality between groups at any time point. Patients in the non-invasive weaning group had fewer IMV days [invasive weaning 4 days (IQR 2–11 days) vs. non-invasive weaning 1 day (IQR 0–7 days); adjusted mean difference –3.1 days, 95% CI –5.75 to –0.51 days]. In addition, fewer non-invasive weaning patients required antibiotics for a respiratory infection [odds ratio (OR) 0.60, 95% CI 0.41 to 1.00; p = 0.048]. A higher proportion of non-invasive weaning patients required reintubation than those in the invasive weaning group (OR 2.00, 95% CI 1.27 to 3.24). The within-trial economic evaluation showed that NIV was associated with a lower net cost and a higher net effect, and was dominant in health economic terms. The probability that NIV was cost-effective was estimated at 0.58 at a cost-effectiveness threshold of £20,000 per quality-adjusted life-year. Conclusions: A protocolised non-invasive weaning strategy did not reduce time to liberation from ventilation. However, patients who underwent non-invasive weaning had fewer days requiring IMV and required fewer antibiotics for respiratory infections. Future work: In patients who fail a SBT, which factors predict an adverse outcome (reintubation, tracheostomy, death) if extubated and weaned using NIV?     Talent Identification in an English Premiership Rugby Union Academy: Multidisciplinary Characteristics of Selected and Non-selected Male Under-15 Players

    Entry into an academy can be a defining moment for a promising young player. The aim of this study was to explore the multidimensional characteristics that differentiated selected and non-selected male under-15 rugby union players at an English Premiership academy. Seventy-four players (mean age 14.6 ± 0.3 years: selected n = 29; non-selected n = 45) were measured across nine characteristics from four overarching factors: (a) anthropometric (n = 2), (b) physiological (n = 5), (c) cognitive (n = 1), and (d) birth quartile. An ANOVA compared differences between groups (selected vs. non-selected), whilst a Welch's t-test and Cohen's d were used for further comparisons. A multivariate logistic regression was also used to predict selection. Results showed significant differences between selected and non-selected players for anthropometric (P = 0.021) and physiological factors (P < 0.001). Moreover, relatively older players were overrepresented with 65% born in the first half of the year, whereas no significant differences were apparent for the cognitive test. More specifically, selected players possessed greater body mass (P = 0.022, d = 0.5) and handgrip strength (P = 0.020, d = 0.5) compared to non-selected players, whilst multivariate analysis showed the 20 m sprint explained 25.4% of the variance (P = 0.001). Overall, it appears selection into an English Premiership rugby union academy may be due to enhanced physical attributes rather than cognitive abilities

    Exploring the Multidimensional Characteristics of Selected and Non-Selected White British and British South Asian Youth Cricketers: An Exploratory Machine Learning Approach

    Selection into a County Age Group (CAG; under 10–18) programme is the first step for young aspiring cricketers on their journey to achieving professional status. Recognising that the British South Asian (BSA) community represents 30% of those who play recreational cricket compared to less than 5% of those who are selected to play at the professional level in England and Wales, it is important to better understand the characteristics of selected and non-selected players based on ethnicity to identify potential sociocultural differences during selection. Thus, the purpose of this study was to investigate the multidimensional factors that differentiated between selected and non-selected adolescent male cricketers as well as between White British (WB) and BSA selected players into a CAG programme. A total of 82 male participants aged between 14 and 17 years were included (mean = 15.3 ± 1.1 years: selected n = 33 and non-selected n = 49: WB n = 34, BSA n = 44, Other n = 4). In total, 104 characteristics were measured over nine tests, which were subsequently placed into five overarching factors: (a) physiological and anthropometrical, (b) perceptual–cognitive expertise, (c) psychological, (d) participation history, and (e) socio-cultural influences. A Bayesian binomial regression was performed in rSTAN using a weak normal prior to highlight differentiators in selection as well as differences between WB and BSA selected players. The results highlighted that athleticism, wellbeing and cohesion, the number of older brothers, and being born in birth quarters two and three were positively correlated with player selection into a CAG. Conversely, increases in psychological scores, a greater number of younger brothers and older sisters, as well as antisocial behaviour resulted in a reduced chance of player selection. Finally, several developmental factors (i.e., athleticism, wellbeing and cohesion, psychological distress, and levels of anti-social behaviour) differed based on ethnicity. These exploratory findings serve as a useful opening to highlight there are important differences to consider based on selection and ethnicity in CAG cricket

    Talent inclusion: An imperfect solution to genetic testing in sport - Response to commentaries

    We are extremely grateful our esteemed colleagues Craig Pickering, Duarte Araújo, Keith Davids, and Kevin Till have read and offered insightful reflections on the target article “Talent inclusion and genetic testing in sport: A practitioner’s guide”. We take the opportunity in the present article to respond to the three commentaries provided by these authors. In our target article, we highlighted at this moment in time, there is unequivocal disapproval in the scientific community with regards to the implementation of genetic testing in sport. Despite an insufficient evidence base, however, various stakeholders (e.g., athletes, support staff) have used, and will likely continue using, genetic tests. We offered potential explanations regarding the allure of genetic information to sports stakeholders before suggesting some imperfect solutions in terms of increasing genetic literacy, promoting talent inclusion, and following a minimum set of best practice guidelines
