    THE IMPACT OF LABOUR LAW ON THE SERVICE RELATIONSHIPSOF THE UNIFORMED OFFICERS — SELECTED ISSUESThis article explains the impact of labour law on the service relationships of the uniformed officers. In this regard, there are two key elements — the first one is the legislation and the second one — the judicial decisions. The first part of the article describes how the legislator makes provisions for uniformed officers concerning, for example, how their powers and duties become similar to the labour law regulations. Judicial decisions should be, and in the vast majority of cases are, a  consequence of the legislation but sometimes they go beyond the framework marked out by the legislature.     The subject of the study is the issue of protecting the durability of non-working service rela-tionships of uniformed officers, whose uniformed formations have undergone a deep reorganisation in recent years. The author made a critical assessment of transitional legal solutions aimed at ad-justing the existing human resources to the current needs and requirements, which in fact exclude the immanent feature of the official employment, which is its stabilisation. In this regard, special attention should be given to issues related to the legal nature of the relevant superior’s proposal to perform the service or employee employment or information about the lack of such an offer and the need to issue a decision terminating the service relationship in the event of its transformation into anemployment relationship under an indefinite contract or fixed period. The subject of the assessment is also the jurisprudence of administrative courts based on the legal solutions adopted by the legis-lator in the indicated scope.Przedmiotem opracowania jest problematyka ochrony trwałości niepracowniczych stosun-ków służbowych funkcjonariuszy służb mundurowych, których formacje mundurowe uległy w ostat-nich latach głębokiej reorganizacji. Autorka dokonała krytycznej oceny przejściowych rozwiązań prawnych, mających na celu dostosowanie dotychczasowego zasobu kadrowego do aktualnych po-trzeb i wymagań, wyłączających w istocie immanentną cechę zatrudnienia służbowego, jaką jest jego stabilizacja. W tym zakresie szczególną uwagę należało poświęcić zagadnieniom związanym z charakterem prawnym składanej funkcjonariuszowi przez właściwego przełożonego propozycji pełnienia służby lub zatrudnienia pracowniczego, lub informacji o braku oferty tego rodzaju oraz konieczności wydania decyzji rozwiązującej stosunek służbowy w razie jego przekształcenia w sto-sunek pracy na podstawie umowy na czas nieokreślony lub określony. Przedmiot oceny stanowi rów-nież dorobek orzeczniczy sądów administracyjnych powstały na tle przyjętych przez ustawodawcę rozwiązań prawnych we wskazanym zakresie

      THE SPECIAL PROTECTION OF EMPLOYMENT RELATIONSHIP ON THE BASIS OF APPOINTMENTRESULTING FROM THE LABOUR CODE The subject matter of this study is an analysis of the legal mechanisms resulting from the provisions of the Labour Code which concern the special protection of an employment relationship which is based on appointment, regarding both their subjective scope as well as the terms of the correctness of their applications by the appellant the employer. Among the ways of establishing an employment relationship, appointment stands out by providing the smallest degree of stabilization, not only because of the scope of the claims that recalled employees are entitled to and the lack of the possibility of applying the usual modes of conduct for the termination of an employment contract, but also because of the nature of the special protection, which allows for the appointed employee to be recalled and poorly protects against the termination of the employment relationship. Measures for the protection of an employment relationship on the basis of appointment, resulting from the provisions of the Labour Code, have a limited subjective range.     The article analyzes the issue of competent court in the scope of protecting claims arising from employment relationships of judges and prosecutors. In the nominative employment relations of these subjects, the public law elements prevail significantly over the employee elements. The author attempts to define the concept of a case for claims arising from employment relations of this kind. The main aim of the paper is to show, based on selected examples from the current regulations, that the legislator does not perceive the complexity and specificity of the employee’s service employment, which results in negative implications for the realization of the constitutional principle of the right to a court.Artykuł poddaje analizie zagadnienie sądu właściwego w zakresie ochrony roszczeń wynikających ze stosunków zatrudnienia sędziów i prokuratorów. W nominacyjnych stosunkach pracy tych podmiotów elementy publicznoprawne istotnie przeważają nad pracowniczymi. Autorka podejmuje próbę zdefiniowania pojęcia sprawy o roszczenia wynikające ze stosunków służbowych tego rodzaju. Celem opracowania jest wykazanie, na podstawie wybranych przykładów wynikających z obecnie obowiązujących regulacji, że ustawodawca nie dostrzega złożoności i specyfiki pracowniczego zatrudnienia służbowego, co ma negatywne implikacje w zakresie realizacji konstytucyjnej zasady prawa do sądu
