    In Landon v. Plasencia, the United States Supreme Court reversed the Ninth Circuit Court of Appeals and held that a permanent resident alien returning to the United States from a brief visit abroad is not necessarily entitled to have the question of her admissibility determined at a deportation hearing. The Court has, however, clarified the standards to be applied in determining, on a case-by-case basis, what process is due. After tracing the development of relevant case law as it has affected the rights of the permanent resident alien, the author concludes that the practical effect of Plasencia actually may be to ensure the higher standard of treatment originally ordered by the Ninth Circuit

    Clinical presentation and outcome of pediatric ANCA-associated glomerulonephritis

    Background Antineutrophil cytoplasmic antibody (ANCA)-associated vasculitis is a small- and medium-sized vasculitis classically seen in adult patients, with peak onset near the fifth to seventh decade of life. There is little data on ANCA-associated vasculitis in pediatric patients, and most studies have limited follow-up. Methods This is a retrospective chart review of 22 patients with ANCA-positive glomerulonephritis in a single institution from 1991 to 2013. Results Of the 22 patients, eight (36 %) required renal replacement therapy (RRT) at diagnosis; four of these patients recovered sufficient renal function to initially discontinue dialysis. Five patients (23 %) were treated with plasmapheresis at presentation. The median time from presentation until first clinical or serologic relapse was 1.7 ± 1.2 years. After a median follow-up of 5.8 years, just over half of our patients had chronic kidney disease (CKD) stages 1–3 (55 %). Seven (32 %) patients progressed to end-stage renal disease (ESRD) and eventually required kidney transplant. Conclusion ANCA-associated glomerulonephritis is a rare disorder in children. Presentation and outcomes vary significantly among patients. More research is required to follow these patients who are diagnosed in childhood to further characterize the long-term outcome of the disease

    A Risk Management Perspective on Statistical Estimation and Generalized Variational Inference

    Generalized variational inference (GVI) provides an optimization-theoretic framework for statistical estimation that encapsulates many traditional estimation procedures. The typical GVI problem is to compute a distribution of parameters that maximizes the expected payoff minus the divergence of the distribution from a specified prior. In this way, GVI enables likelihood-free estimation with the ability to control the influence of the prior by tuning the so-called learning rate. Recently, GVI was shown to outperform traditional Bayesian inference when the model and prior distribution are misspecified. In this paper, we introduce and analyze a new GVI formulation based on utility theory and risk management. Our formulation is to maximize the expected payoff while enforcing constraints on the maximizing distribution. We recover the original GVI distribution by choosing the feasible set to include a constraint on the divergence of the distribution from the prior. In doing so, we automatically determine the learning rate as the Lagrange multiplier for the constraint. In this setting, we are able to transform the infinite-dimensional estimation problem into a two-dimensional convex program. This reformulation further provides an analytic expression for the optimal density of parameters. In addition, we prove asymptotic consistency results for empirical approximations of our optimal distributions. Throughout, we draw connections between our estimation procedure and risk management. In fact, we demonstrate that our estimation procedure is equivalent to evaluating a risk measure. We test our procedure on an estimation problem with a misspecified model and prior distribution, and conclude with some extensions of our approach
