    Attorney Advertising in Texas: Regulations Mean Serious Business

    The purpose of this article is to provide attorneys with additional notice and explanation of the history, constitutional basis, and interpretation of Texas\u27 attorney advertising and solicitation rules. If an ounce of prevention is worth a pound of cure, the objective of this article is to help prevent unnecessary grievances and sanctions caused by a lack of knowledge about the Texas attorney advertising and solicitation rules. Part I of this article reviews the creation of the Texas rules and the Advertising Review Committee. Part II provides a summary of the new Texas rules, including a discussion of the most common violations. Part III provides a history of the constitutional issues related to the First Amendment and commercial speech. In conclusion, Texas attorneys should note that compliance with the advertising and solicitation rules is required to avoid potentially serious sanctions

    Phase response measurement technique for waveguide grating filters

    A simple interferometric technique is described which can be used to accurately measure the phase response of waveguide grating filters. A narrowband, tunable Ti:sapphire laser is used in a Michelson interferometer configuration, where light reflected from a waveguide grating filter is combined with a reference beam. The intensity of the combined beams is measured as the wavelength of the Ti:sapphire laser is tuned. The measured intensity exhibits a quasisinusoidal wavelength dependence, from which the phase response of the filter can be deduced.     Examining the California Cut Score: An Empirical Analysis of Minimum Competency, Public Protection, Disparate Impact, and National Standards

    The selection of a minimum bar exam passing score (“cut score”) shapes the representation of racial and ethnic minorities in the legal profession and the quality of access to justice in the state. California and national policy makers have not had the benefit of detailed exam performance data that analyzes the effect of the cut score on race and ethnicity. Because policy makers consider the cut score an important public protection mechanism, this study also explored whether the selection of higher cut scores better protected the public from attorneys who do not have the minimum competence to practice law. To conduct the analysis, the study used two data sets. The first data set included 85,727 examinees who sat for 21 administrations of the CBX from 2009-18 and the race and ethnicity of each examinee. The second data set included the ABA discipline data from up to 48 U.S. jurisdictions from 2013-18 and the cut scores in each jurisdiction. Using the first data set,the study determined how the selection of a minimum cut score (1) widens or narrows the racial and ethnic impacts of the bar exam and/or (2) alters the racial and ethnic composition of new attorneys joining the legal profession. Both historical actual and simulated cut scores were analyzed. Using the second data set, this study examined a third factor: the relationship, if any, between minimum cut scores and rates of attorney discipline. This analysis determined that initial and eventual passing rates differed significantly between racial and ethnic groups, and this gap was wider at higher simulated cut scores. A simulation analysis using actual examinee scores confirmed that selecting a lower cut score would have significantly narrowed the achievement gap between Whites and racial and ethnic minorities and would have increased the number of newly admitted minority attorneys in California. For example, at 1440, the achievement gap between Whites and Blacks was 27.4 percentage points. But at a simulated cut score of 1300, the achievement gap between these two groups would have been only 14.5 percentage points. This 12.9 percentage point difference in the achievement gap at 1440 and 1300 demonstrates a disparate effect of the higher cut scores. Using the second data set about disciplinary statistics, the study determined that no relationship exists between the selection of a cut score and the number of complaints, formal charges, or disciplinary actions taken against attorneys in the jurisdictions studied. California’s recent decision to lower the cut score from 1440 to 1390 moved California from having the second-highest cut score to the fourth-highest cut score in the country. However, the report data established that at 1390 California will continue to produce significantly disparate pass rates on the basis of race and ethnicity when compared to the national norm of 1350, the New York standard of 1330, and the simulated model of 1300. This study establishes that maintaining a high cut score does not result in greater public protection as measured by disciplinary statistics but does result in excluding minorities from admission to the bar and the practice of law at rates disproportionately higher than Whites

    Synchrotron radiation from a charge moving along a helical orbit inside a dielectric cylinder

    The radiation emitted by a charged particle moving along a helical orbit inside a dielectric cylinder immersed into a homogeneous medium is investigated. Expressions are derived for the electromagnetic potentials, electric and magnetic fields, and for the spectral-angular distribution of radiation in the exterior medium. It is shown that under the Cherenkov condition for dielectric permittivity of the cylinder and the velocity of the particle image on the cylinder surface, strong narrow peaks are present in the angular distribution for the number of radiated quanta. At these peaks the radiated energy exceeds the corresponding quantity for a homogeneous medium by some orders of magnitude. The results of numerical calculations for the angular distribution of radiated quanta are presented and they are compared with the corresponding quantities for radiation in a homogeneous medium. The special case of relativistic charged particle motion along the direction of the cylinder axis with non-relativistic transverse velocity (helical undulator) is considered in detail. Various regimes for the undulator parameter are discussed. It is shown that the presence of the cylinder can increase essentially the radiation intensity.Comment: 18 pages, 8 EPS figure

    Observations of Infrared Radiative Cooling in the Thermosphere on Daily to Multiyear Timescales from the TIMED/SABER Instrument

    We present observations of the infrared radiative cooling by carbon dioxide (CO2) and nitric oxide (NO) in Earth s thermosphere. These data have been taken over a period of 7 years by the SABER instrument on the NASA TIMED satellite and are the dominant radiative cooling mechanisms for the thermosphere. From the SABER observations we derive vertical profiles of radiative cooling rates (W/cu m), radiative fluxes (W/sq m), and radiated power (W). In the period from January 2002 through January 2009 we observe a large decrease in the cooling rates, fluxes, and power consistent with the declining phase of solar cycle. The power radiated by NO during 2008 when the Sun exhibited few sunspots was nearly one order of magnitude smaller than the peak power observed shortly after the mission began. Substantial short-term variability in the infrared emissions is also observed throughout the entire mission duration. Radiative cooling rates and radiative fluxes from NO exhibit fundamentally different latitude dependence than do those from CO2, with the NO fluxes and cooling rates being largest at high latitudes and polar regions. The cooling rates are shown to be derived relatively independent of the collisional and radiative processes that drive the departure from local thermodynamic equilibrium (LTE) in the CO2 15 m and the NO 5.3 m vibration-rotation bands. The observed NO and CO2 cooling rates have been compiled into a separate dataset and represent a climate data record that is available for use in assessments of radiative cooling in upper atmosphere general circulation models

    Degree and connectivity of the Internet's scale-free topology

    In this paper we theoretically and empirically study the degree and connectivity of the Internet's scale-free topology at the autonomous system (AS) level. The basic features of the scale-free network have influence on the normalization constant of the degree distribution p(k). We develop a mathematics model of the Internet's scale-free topology. On this model we theoretically get the formulas of the average degree, the ratios of the kmin-degree (minimum degree) nodes and the kmax-degree (maximum degree) nodes, the fraction of the degrees (or links) in the hands of the richer (top best-connected) nodes. We find the average degree is larger for smaller power-law exponent {\lambda} and larger minimum or maximum degree. The ratio of the kmin-degree nodes is larger for larger {\lambda} and smaller kmin or kmax. The ratio of the kmax-degree ones is larger for smaller {\lambda} and kmax or larger kmin. The richer nodes hold most of the total degrees of the AS-level Internet topology. In addition, we reveal the ratio of the kmin-degree nodes or the rate of the increase of the average degree has power-law decay with the increase of the kmin. The ratio of the kmax-degree nodes has power-law decay with the increase of the kmax, and the fraction of the degrees in the hands of the richer 27% nodes is about 73% (the '73/27 rule'). At last, we empirically calculate, based on empirical data extracted from BGP, the average degree and the ratio and fraction using our method and other methods, and find that our method is rigorous and effective for the AS-level Internet topology.Comment: 22 pages, 8 figure

    Severe steroid-related neuropsychiatric symptoms during paediatric acute lymphoblastic leukaemia therapy—An observational Ponte di Legno Toxicity Working Group Study

British Journal of Haematology published by British Society for Haematology and John Wiley & Sons Ltd.Steroids are a mainstay in the treatment of acute lymphoblastic leukaemia (ALL) in children and adolescents; however, their use can cause clinically significant steroid-related neuropsychiatric symptoms (SRNS). As current knowledge on SRNS during ALL treatment is limited, we mapped the phenotypes, occurrence and treatment strategies using a database created by the international Ponte di Legno Neurotoxicity Working Group including data on toxicity in the central nervous system (CNS) in patients treated with frontline ALL protocols between 2000 and 2017. Ninety-four of 1813 patients in the CNS toxicity database (5.2%) experienced clinically significant SRNS with two peaks: one during induction and one during intensification phase. Dexamethasone was implicated in 86% of SRNS episodes. The most common symptoms were psychosis (52%), agitation (44%) and aggression (31%). Pharmacological treatment, mainly antipsychotics and benzodiazepines, was given to 87% of patients while 38% were hospitalised due to their symptoms. Recurrence of symptoms was reported in 29% of patients and two previously healthy patients required ongoing pharmacological treatment at the last follow up.
