Особливості юридичної відповідальності посадових і службових осіб Фонду гарантування вкладів фізичних осіб

It has been determined what categories of the employees of Deposits Guarantee Fund (DGF) belongs to officials and civil servants. It has been established that officials and civil servants of Deposit Guarantee Fund may, within the limits of their professional activities, be brought to administrative or disciplinary liability. Disciplinary liability of the employees of the Fund arises for violations of labor discipline, that is, non-performance or improper performance assigned to him duties due to the employee’s guilt. Administrative liability is spread only to the Fund’s Managing Director as an official of a legal entity of public law, who is personally responsible for the activities of the DGF and fulfills the tasks assigned to him. The Managing Director of the Fund is a subject to administrative liability for administrative offenses related to non-observance of established rules in the field of protection of the order of administration, state and public order, nature, health of the population and other rules, the enforcement of which is included to his official duties. The peculiarity of the legal status of the employees of Deposit Guarantee Fund has been considered, which is the non-dissemination of civil liability on them because of being protected under the Law of Ukraine “On the System of Guaranteeing Deposits of Individuals”.Досліджено особливості юридичної відповідальності посадових і службових осіб Фонду гарантування вкладів фізичних осіб (ФГВФО), визначено, хто з працівників Фонду належить до посадових і службових осіб. Установлено, що посадові та службові особи ФГВФО у межах своєї професійної діяльності можуть бути притягнені до дисциплінарної (порушення трудової дисципліни) або адміністративної (поширюється лише на директора – розпорядника Фонду як на посадову особу юридичної особи публічного права) відповідальності. Розглянуто особливість правового статусу працівників ФГВФО, що полягає в нерозповсюдженні на них цивільно-правової відповідальності через перебування під захистом закону України «Про систему гарантування вкладів фізичних осіб»

СОВРЕМЕННЫЕ ПОДХОДЫ К ХИРУРГИЧЕСКОМУ ЛЕЧЕНИЮ БОЛЬНЫХ РАКОМ ПИЩЕВОДА И КАРДИАЛЬНОГО ОТДЕЛА ЖЕЛУДКА

Приведены результаты хирургического лечения 218 больных по поводу рака пищевода (РП) и кардиального отдела желудка (РКОЖ). Рассмотрены вопросы лимфодиссекции D2 без спленэктомии. Предложен новый вариант наложения пищеводно–желудочного анастомоза. Проанализированы послеоперационные осложнения, частота которых составила 34,9%, преимущественно с поражением сердечно–сосудистой системы (15,1%). После операции умерли 4 (1,8%) больных
