    Conspiracy--Cline v. State was an appeal from a conviction of a conspiracy to dynamite and destroy a public school building in Clinton, Tennessee, in violation of a statute making it a felony for two or more persons to agree to commit an illegal act capable of producing conditions destructive to life or property.. . by possessing, transporting or using explosives. Three men, D1, D2 and D3, had been indicated; but, before defendants were put to trial, the state entered a nolle prosequi against D1, who became a state\u27s witness. Afterwards, D2 was acquitted in the same trial in which D3, the appellant here, was convicted. Reversal was sought on the basis of precedent holding that, it being essential to criminal conspiracy that two or more persons combine to do an illegal thing, when only two are charged with a conspiracy, and one of them is acquitted, the conviction of the other is void. The court conceded that on authority if both D1 and D2 had been acquitted the case against D3 as a joint conspirator would have failed. But it distinguished precedent on the ground that here only D2, and not D1 as well, had been acquitted and--adopting the rule that so long as the acquittal or death of co- conspirators does not remove the basis for a charge of conspiracy, a single defendant may be prosecuted and convicted of the offense. . . . --found no error in this regard concerning D3\u27s conviction

    Tennessee courts have the means for upholding informal marriages whenever the social reasons are sufficiently strong to impel them to do so. This is a very desirable result, and one which is not open to the criticism that the courts are inviting or encouraging informal marriages as against the ceremonial, statutory marriage. These devices are not alternative means of attaining the marriage status ab initio, but are merely remedial devices looking backwards, which the courts may use on occasion when satisfied that it is for the good of the state and society, as well as for the parties and their children and descendants. Of course, the application of these devices will continue not to be mechanical, but the courts will carefully consider the motives of the parties and the character of the relationship they maintained, both in the inception and in subsequent years, and weigh in the balance the somewhat conflicting public policies noticed above, before deciding which result would be more for the overall good

    The substantive criminal law receives little attention from the Tennessee appellate courts. No doubt this observation would be equally true of most jurisdictions. To one who received his legal training in a common law system of criminal law and who yet has had some experience with Canada\u27s federal code of criminal law, the emphasis on criminal procedure is surprising. Does this mean that the state codes of substantive law have reached such heights of perfection and expertise that the efforts of the Model Penal Code draftsmen are unnecessary or, at best, academic? It is unlikely. The position rather reflects a preoccupation with constitutional rights and a criticism of the present law of criminal procedure. This accentuation is not unexpected in the light of the great activity of the United States Supreme Court in the field of constitutional criminal procedure in recent years

    UV Capabilities of the CETUS Multi-Object Spectrometer (MOS) and NUV/FUV Camera

    The Cosmic Evolution Through UV Spectroscopy (CETUS) concept enables parallel observations by the UV multiobject spectrometer (MOS) and near-UV/far-UV camera which operate simultaneously but independently with their separate field of views. The near-UV MOS can target up to 100 objects at a time without confusion with nearby sources or background zodiacal light. This multiplexing will allow over 100,000 galaxies to be observed over a typical mission lifetime. The MOS includes a next-generation micro-shutter array (NGMSA), an efficient aspheric Offner-like spectrometer design with a convex grating, and nanotube light traps for suppressing unwanted wavelengths. The NUV/FUV Camera has the capability to image in a range of sub-bands from 115-400 nm at the same time the MOS is operating at 180-350 nm. The UV camera has a similar Offner-like relay, selectable filters, and two separate detectors to optimize observing in either the far-UV (115-175 nm) or the near-UV (180-400 nm) utilizing a CsI Micro-Channel Plate detector (MCP) and a CCD respectively

    A possible role for Phlebotomus (Anaphlebotomus) rodhaini (Parrot, 1930) in transmission of Leishmania donovani

    <p>Abstract</p> <p>Background</p> <p>Visceral leishmaniasis (VL, kala azar), caused by <it>Leishmania donovani </it>is a major health problem in Sudan and other East African countries. In this region the only proven vectors of <it>L. donovani </it>are <it>Phlebotomus orientalis </it>in eastern Sudan, Ethiopia and Upper Nile areas of Southern Sudan and <it>Phlebotomus martini </it>in Ethiopia, Kenya and Southern Sudan. In this report, we present the first evidence that <it>Phlebotomus rodhaini </it>may also play a role in maintaining transmission of <it>L. donovani </it>between animal reservoir hosts in eastern Sudan. The study was conducted in a zoonotic focus of visceral leishmaniasis in Dinder National Park, eastern Sudan, where previous work showed high infection rates of <it>L. donovani </it>in <it>P. orientalis</it>. Sand flies, captured by CDC traps were dissected and examined for infection with <it>Leishmania </it>parasites. Parasite isolates were subjected to <it>L. donovani </it>specific PCR. Field experiments were also carried out to compare efficiency of rodent baited and un-baited CDC traps in collection of <it>P. rodhaini </it>and determine its man-biting rate.</p> <p>Results</p> <p>Three female <it>P. rodhain</it>i were found infected with <it>Leishmania </it>parasites in an astonishingly small number of flies captured in three separate field trips. Two of these isolates were typed by molecular methods as <it>L. donovani</it>, while the third isolate was inoculated into a hamster that was subsequently lost. Although <it>P. rodhaini is </it>generally considered a rare species, results obtained in this study indicate that it can readily be captured by rodent-baited traps. Results of human landing collection showed that it rarely bites humans in the area.</p> <p>Conclusion</p> <p>It is concluded that <it>P. rodhaini </it>is a possible vector of <it>L. donovani </it>between animal reservoir hosts but is not responsible for infecting humans. It is suggested that the role of <it>P</it>. <it>rodhaini </it>in transmission of <it>L. donovani </it>in other zoonotic foci of visceral leishmaniasis in Africa should be re-examined.</p

    Impact of vitamin C supplementation on placental DNA methylation changes related to maternal smoking: association with gene expression and respiratory outcomes

    Background: Maternal smoking during pregnancy (MSDP) affects development of multiple organ systems including the placenta, lung, brain, and vasculature. In particular, children exposed to MSDP show lifelong deficits in pulmonary function and increased risk of asthma and wheeze. Our laboratory has previously shown that vitamin C supplementation during pregnancy prevents some of the adverse effects of MSDP on offspring respiratory outcomes. Epigenetic modifications, including DNA methylation (DNAm), are a likely link between in utero exposures and adverse health outcomes, and MSDP has previously been associated with DNAm changes in blood, placenta, and buccal epithelium. Analysis of placental DNAm may reveal critical targets of MSDP and vitamin C relevant to respiratory health outcomes. Results: DNAm was measured in placentas obtained from 72 smokers enrolled in the VCSIP RCT: NCT03203603 (37 supplemented with vitamin C, 35 with placebo) and 24 never-smokers for reference. Methylation at one CpG, cg20790161, reached Bonferroni significance and was hypomethylated in vitamin C supplemented smokers versus placebo. Analysis of spatially related CpGs identified 93 candidate differentially methylated regions (DMRs) between treatment groups, including loci known to be associated with lung function, oxidative stress, fetal development and growth, and angiogenesis. Overlap of nominally significant differentially methylated CpGs (DMCs) in never-smokers versus placebo with nominally significant DMCs in vitamin C versus placebo identified 9059 candidate "restored CpGs" for association with placental transcript expression and respiratory outcomes. Methylation at 274 restored candidate CpG sites was associated with expression of 259 genes (FDR < 0.05). We further identified candidate CpGs associated with infant lung function (34 CpGs) and composite wheeze (1 CpG) at 12 months of age (FDR < 0.05). Increased methylation in the DIP2C, APOH/PRKCA, and additional candidate gene regions was associated with improved lung function and decreased wheeze in offspring of vitamin C-treated smokers. Conclusions: Vitamin C supplementation to pregnant smokers ameliorates changes associated with maternal smoking in placental DNA methylation and gene expression in pathways potentially linked to improved placental function and offspring respiratory health. Further work is necessary to validate candidate loci and elucidate the causal pathway between placental methylation changes and outcomes of offspring exposed to MSDP
