    The Roberts Court and Oral Arguments: A First Decade Retrospective

    This Article summarizes some prominent data points of the Roberts Court justices’ behavior during oral arguments at the Supreme Court. Johnson relays accounts from observers who have recognized an increase in questioning from the justices during oral arguments. The Articles suggests this increase may be attributed to the more talkative style of newer justices, as well as the changing role of the questions during oral arguments, which can inform the justices about their fellow judges’ thoughts and opinions. The Article concludes that these trends in questions, number of words spoken, and interruptions are likely to change as more attention is placed on the importance of oral arguments

    The development of a cislunar space infrastructure

    The primary objective of this Advanced Mission Design Program is to define the general characteristics and phased evolution of a near-Earth space infrastructure. The envisioned foundation includes a permanently manned, self-sustaining base on the lunar surface, a space station at the Libration Point between earth and the moon (L1), and a transportation system that anchors these elements to the Low Earth Orbit (LEO) station. The implementation of this conceptual design was carried out with the idea that the infrastructure is an important step in a larger plan to expand man's capabilities in space science and technology. Such expansion depends on low cost, reliable, and frequent access to space for those who wish to use the multiple benefits of this environment. The presence of a cislunar space infrastructure would greatly facilitate the staging of future planetary missions, as well as the full exploration of the lunar potential for science and industry. The rationale for, and a proposed detailed scenario in support of, the cislunar space infrastructure are discussed

    Advice from the Bench (Memo): Clerk Influence on Supreme Court Oral Arguments

    Scholars of the U.S. Supreme Court have long debated the role, and possible influence, of clerks on the decisions their Justices make. In this Paper, we take a novel approach to analyze this phenomenon. We utilize pre-oral argument bench memos sent to Justice Harry A. Blackmun from his clerks. Specifically, we use these memos to determine whether Justice Blackmun asked questions of counsel that were recommended by his clerks in the memos. Our data indicate Justice Blackmun often followed his clerks’ advice. Accordingly, we provide another important link to demonstrate Supreme Court clerks can and do affect how their Justices evaluate cases

    Total Probability of Collision as a Metric for Finite Conjunction Assessment and Collision Risk Management

    On-orbit collision risk is becoming an increasing mission risk to all operational satellites in Earth orbit. Managing this risk can be disruptive to mission and operations, present challenges for decision-makers, and is time-consuming for all parties involved. With the planned capability improvements to detecting and tracking smaller orbital debris and capacity improvements to routinely predict on-orbit conjunctions, this mission risk will continue to grow in terms of likelihood and effort. It is very real possibility that the future space environment will not allow collision risk management and mission operations to be conducted in the same manner as it is today. This paper presents the concept of a finite conjunction assessment-one where each discrete conjunction is not treated separately but, rather, as a continuous event that must be managed concurrently. The paper also introduces the Total Probability of Collision as an analogous metric for finite conjunction assessment operations and provides several options for its usage in a Concept of Operations

    Variable Hard X-ray Emission from the Candidate Accreting Black Hole in Dwarf Galaxy Henize 2-10

    We present an analysis of the X-ray spectrum and long-term variability of the nearby dwarf starburst galaxy Henize 2-10. Recent observations suggest that this galaxy hosts an actively accreting black hole with mass ~10^6 M_sun. The presence of an AGN in a low-mass starburst galaxy marks a new environment for active galactic nuclei (AGNs), with implications for the processes by which "seed" black holes may form in the early Universe. In this paper, we analyze four epochs of X-ray observations of Henize 2-10, to characterize the long-term behavior of its hard nuclear emission. We analyze observations with Chandra from 2001 and XMM-Newton from 2004 and 2011, as well as an earlier, less sensitive observation with ASCA from 1997. Based on detailed analysis of the source and background, we find that the hard (2-10 keV) flux of the putative AGN has decreased by approximately an order of magnitude between the 2001 Chandra observation and exposures with XMM-Newton in 2004 and 2011. The observed variability confirms that the emission is due to a single source. It is unlikely that the variable flux is due to a supernova or ultraluminous X-ray source, based on the observed long-term behavior of the X-ray and radio emission, while the observed X-ray variability is consistent with the behavior of well-studied AGNs.Comment: 7 pages, 4 figures, 2 tables; accepted for publication in Ap
