    The Standard of Proof for Redressing Wrongful Convictions - A Comparative Study with Case Analyses

    Get PDF
    Instances of wrongful conviction have the nature of universality and latency. The determination of wrongful conviction has the nature of ambiguousness and antagonism. The facts behind a case of wrongful conviction are not always black-and-white; sometimes there is a grey zone, meaning that there is no way to determine with accuracy whether the defendant is guilty or not. As a result, the rectification of wrongful conviction becomes very difficult. In the case of Hugejiletu, for example, although the true perpetrator came out in 2005, the wrongful conviction had not been corrected by the court until the end of 2014. Therefore, the standard of proof for redressing wrongful convictions needs to be clarified. Through case analyses of the standard in USA, UK and Germany, we can see that the standard for redressing wrongful convictions are different from the standard for convictions, with the former being generally lower than the latter. We should restate the standard of proof for redressing wrongful convictions in Chinese criminal proceedings, and make distinctions between the standard for starting a retrial, the standard for redressing a wrongful conviction, and the standard for awarding a state compensation

    Exploring a Practical Pathway toward Democracy in China

    The current democratic system in the People’s Republic of China (PRC) is based on the political consultation and the people’s congress. In this system of indirect democracy, the key is to ensure that those in power are representing the people’s interests. Over the last thirty years, China has been exploring the pathway toward democracy, but a long road lies ahead. Currently, China needs to take substantial practical measures to guarantee people’s democratic rights, including the right to know, the right to speak, and the right to vote.

    The democratic system based on political consultation and the people’s congress in PRC belongs to the category of indirect democracy, in which the key is to guarantee those in power represent the public’s interests. The Cultural Revolution was an attempt for this purpose and gave Chinese people a chance to experience some practices of mass democracy, including the democratic supervision in the form of mass criticism, the democratic governance in the form of rebellion and usurping, and the democratic participation in the form of Trinity. However, the Culture Revolution became a national disaster. With lessons learned, the Chinese leadership recognized the importance of the rule of law

    A Method of EV Detour-to-Recharge Behavior Modeling and Charging Station Deployment

    Full text link
    Electric vehicles (EVs) are increasingly used in transportation. Worldwide use of EVs, for their limited battery capacity, calls for effective planning of EVs charging stations to enhance the efficiency of using EVs. This paper provides a methodology of describing EV detouring behavior for recharging, and based on this, we adopt the extra driving length caused by detouring and the length of uncompleted route as the indicators of evaluating an EV charging station deployment plan. In this way, we can simulate EV behavior based on travel data (demand). Then, a genetic algorithm (GA) based EV charging station sitting optimization method is developed to obtain an effective plan. A detailed case study based on a 100-node 203-branch transportation network within a 30 km * 30 km region is included to test the effectiveness of our method. Insights from our method may be applicable for charging station planning in various transportation networks

    PRMT2 promotes dextran sulfate sodium-induced colitis by inhibiting SOCS3 via histone H3R8 asymmetric dimethylation

    BACKGROUND AND PURPOSE: There is emerging evidence for critical roles of epigenetic modifiers in development of inflammatory bowel disease (IBD). Protein arginine methyltransferase 2 (PRMT2) is responsible for methylation of arginine residues on histones and targets transcription factors critically involved in many cellular processes, including gene transcription, mRNA splicing, cell proliferation and differentiation. However, its role in colitis remains unknown. In this study, the role and underlying mechanisms of PRMT2 in colitis was studied. EXPERIMENTAL APPROACH: A mouse dextran sulfate sodium (DSS)-induced experimental colitis model was applied to study PRMT2 in colitis. Lentivirus induced PRMT2 silencing or overexpression in vivo was applied to address the role of PRMT2 in colitis. Detailed western blot and expression analysis was done to understand epigenetic changes induced by PRMT2 in colitis. KEY RESULTS: PRMT2 is highly expressed in patients with IBD, inflamed colon of mice and TNF-α stimulated mice gut epithelial cells. PRMT2 overexpression aggravates while knockdown alleviates DSS-induced colitis in mice, suggesting that PRMT2 is a pivotal mediator of colitis development. Mechanistically, PRMT2 mediates colitis by increasing repressive histone mark H3R8 asymmetric methylation (H3R8me2a) at the promoter region of the suppressor of cytokine signaling 3 (SOCS3) promoter. Resultant inhibition of SOCS3 expression and SOCS3-mediated degradation of TNF receptor associated factor 5 (TRAF5) via ubiquitination led to elevated TRAF5 expression and TRAF5-mediated downstream NF-κB/MAPK activation. CONCLUSION AND IMPLICATIONS: Our study demonstrates that PRMT2 acts as a transcriptional co-activator for proinflammatory genes during colitis. Hence targeting PRMT2 may provide a novel therapeutic approach for colitis

    Manipulating Multiple Order Parameters via Oxygen Vacancies: The case of Eu0.5Ba0.5TiO3-{\delta}

    Controlling functionalities, such as magnetism or ferroelectricity, by means of oxygen vacancies (VO) is a key issue for the future development of transition metal oxides. Progress in this field is currently addressed through VO variations and their impact on mainly one order parameter. Here we reveal a new mechanism for tuning both magnetism and ferroelectricity simultaneously by using VO. Combined experimental and density-functional theory studies of Eu0.5Ba0.5TiO3-{\delta}, we demonstrate that oxygen vacancies create Ti3+ 3d1 defect states, mediating the ferromagnetic coupling between the localized Eu 4f7 spins, and increase an off-center displacement of Ti ions, enhancing the ferroelectric Curie temperature. The dual function of Ti sites also promises a magnetoelectric coupling in the Eu0.5Ba0.5TiO3-{\delta}.Comment: Accepted by Physical Review B, 201

    Integrated metabolomics and lipidomics evaluate the alterations of flavor precursors in chicken breast muscle with white striping symptom

    White striping (WS) is the most common myopathy in the broiler chicken industry. To reveal flavor changes of WS meat objectively, flavor precursors of WS breast muscle were evaluated systematically with integrated metabolomics and lipidomics. The results showed that WS could be distinguished from normal controls by E-nose, and four volatile compounds (o-xylene, benzene, 1,3-dimethyl, 2-heptanone and 6-methyl and Acetic acid and ethyl ester) were detected as decreased compounds by gas chromatography-mass spectrometry. Lipidomic analysis showed that WS breast fillets featured increased neutral lipid (83.8%) and decreased phospholipid molecules (33.2%). Targeted metabolomic analysis indicated that 16 hydrophilic metabolites were altered. Thereinto, some water-soluble flavor precursors, such as adenosine monophosphate, GDP-fucose and L-arginine increased significantly, but fructose 1,6-bisphosphate and L-histidine significantly decreased in the WS group. These results provided a systematic evaluation of the flavor precursors profile in the WS meat of broiler chickens
