    Islam is the religion that the majority of the population embraces the state of Indonesia, not only religion of worship, but also as a social system. Islamic law is very global in meet human needs and concerns. Islam too consider family planning issues factually and affectionate and has sponsored human plans invarious individual and social affairs, including the birth plana child.Al-Ghazali who adheres to the Islamic teachings of the Shafi'iyah madhhab in his book Ihya' 'Ulumuddin mentions that 'azl can be done without the consent of the wife. In addition to basing his argument on the hadith of the Prophet, Imam Al-Ghazali also discussed this issue from various aspects, especially from the biological aspect and the economic aspect.Unlike the case with Imam Ibn Hazm, most of his opinions are contrary to the Ulama'. Ibn Hazm who adheres to the Islamic teachings of the Zahiri school strongly opposes the implementation of the practice of 'azl on the grounds of "covered infanticide". With this statement, Imam Ibn Hazm strictly forbids the implementation of the practice of 'azl.

    This research is motivated by technological developments, especially information technology, which makes it very easy for the public to get information wherever and whenever the Supreme Court as a State Judicial Institution makes innovations in case administration services using e-court applications that have been implemented in Court institutions throughout Indonesia, especially in the Jombang Religious Court Class 1B. The writing of this article uses field research methods, this article tries to explain the use of e-court applications in the Jombang Religious Court Class 1B, the effectiveness of using e-court applications for the Jombang Religious Court Class 1B environment and the general public. The e-court application is an electronic case registration service where the registrant will receive registration, payment, summons and trial information via the registrant’s email. The implementation of the e-court application at the Jombang Religious Court Class 1B is still not effective because there is no obligation for case registrants to register cases electronically. The results showed that the effectiveness of the use of the e-court application at the Jombang Religious Court Class 1B,was not yet ineffectiv

Adapun metode kajian penelitian kualitatif ini sifatnya lebih ke arah metode kajian atas gagasan konseptual sedang data-data yang dikumpulkan dan yang akan dianalisis bertumpu pada ketersediaan sumber data di perpustakaan Penggunaan media sosial seperti chatting, update status, upload foto yang menyatakan dirinya dan mempertontonkan dirinya dalam masa iddah tidak dibenarkan dalam islam karena hal tersebut tidak sesuai dengan ketentuan. Hal tersebut didasarkan pada hukum tentang wnaita iddah tidak boleh keluar rumah, bersolek dan memakai make up, tidak  boleh dikhitbah dan menerima khitbah dari laki-laki lain pada masa iddah

    Religious harmony is living in peace and mutual tolerance for all despite different religions. The religion adopted by the Junrejo community is very diverse, ranging from Islam, Christianity, Hinduism, Catholicism and Buddhism. So conflicts with religious backgrounds can occur anytime and anywhere. Therefore, the role of Islamic religious instructors is very much needed for the creation of a society that respects each other even though they have different beliefs. This research was conducted at the Office of Religious Affairs, Junrejo District to determine the objective conditions, the role of Islamic religious educators, and the obstacles experienced in increasing inter-religious harmony. This study uses a descriptive qualitative method, using three collection techniques, namely observation, interview and documentation. The results of this study show that the objective conditions of inter-religious harmony are still very conducive. The role of the Islamic Religious Counselor is to provide broad religious insight to all people in order to strengthen the friendship. The obstacle is because of the limited time in the midst of a busy community and also because the number of target groups is not proportional to the number of religious instructors in Junrejo District, Batu City.Keywords : Islamic religious educator, Harmony, Religious peopl

    TRADISI BAYAR ADAT PISUKE TERHADAP PERNIKKAHAN SUKUK SASAK DALAM PERSPEKTIF ANTROPOLOGI HUKUM DAN HUKUM ISLAM

    The Sasak people have local wisdom and have their own practices in getting married. In the practice of the Sasak tribe there is a process called pisuke. Pisuke is a security deposit that must be paid by the man to the woman's family owned by the Sasak people. This study uses a qualitative approach that can be used to understand the meaning that comes from social problems. The purpose of this study is to describe the traditional pisuke payment at a Sasak marriage in Kediri Selata Village, West Lombok from the perspective of legal anthropology according to Islamic law. The traditional pisuke payment tradition is a traditional payment process before or after the marriage contract. The pisuke tradition is burdened on the men for the cost of the Thanksgiving procession after the marriage contract. The pisuke custom in terms of legal anthropology is how the local community reacts to maintain and preserve the values that exist in the Sasak community. Legal anthropology is inseparable from social values such as the traditional pisuke payment tradition in Sasak marriages. As for the tradition of paying the pisuke custom, from the point of view of Islamic law, it is called 'urf shahih or a habit that is repeated by many people and the rules are accepted by the surrounding communit

    Marriage is an inner and outer bond that is woven by a man and woman as husband and wife to reach the pleasure of Allah SWT. To achieve it affection, love, good two-way communication and attention are needed so these things minimize the divorce occurrence. Among the types of divorce is divorce qobla dukhul, which means a divorce that occurs between a husband and wife have not had sexual relations. This divorce resulted a different law from the divorce of ba'da dukhul, therefore the author is interested in researching more deeply, especially regarding the maintenance and the period of iddah for women who are divorced in qobla dukhul state. This study uses literature review research, by conducting a study of library sources which in this case is centered on text study of the book of Abdurrahman al Jaziri namely fiqh ala madzahibil arba'ah. The result of this literature review  is that Imam Syafi'i and Imam Abu Hanifah both do not require a living for a divorced wife in qobla dukhul state. Imam Shafi'i’s opinion is that a divorced wife in qobla dukhul state is not entitled to undergo the iddah whether she had khalwat with her husband or not. Imam Abu Hanifah's opinion is that a wife who is in khalwat with her husband has to undergo iddah and a divorced wife in qobla dukhul state who had not khalwat with her husband is not entitled to undergo idda

    Artikel ini membahas tentang validitas Ijab Kabul melalui media sosial dalam perspektif kompilasi hukum Islam. Hal ini penting untuk diteliti secara mendalam karena pesatnya perkembangan teknologi telah menimbulkan permasalahan baru di masyarakat, seperti pernikahan online. Hasil penelitian ini akan dianalisa oleh penulis untuk memunculkan jawaban tentang sahnya perkawinan secara online dengan mendeskripsikan mekanisme keabsahan akta nikah melalui media online, keabsahannya menurut UU No 1 Tahun 1974, dan legalitasnya. hukum perkawinan menurut pelaksana KUA dalam pandangan hukum Islam. Penelitian ini merupakan jenis penelitian kepustakaan dengan menggunakan pendekatan penelitian doktrinal. Hasil penelitian ini adalah: 1) Dalam pelaksanaan Ijab Kabul yang dilakukan secara online walaupun tempat terpisah, dalam mengucapkan akad nikah tetap dilakukan secara terus menerus antara wali dengan pihak mempelai pria. Menjamin kebenaran gambar dan suara calon mempelai, sehingga tidak diragukan keabsahan perkawinan yang tidak dilaksanakan dalam satu majelis, 2) Keabsahan perkawinan melalui media sosial menurut UU No. 1. 1974 tentang Perkawinan, hukum positif Indonesia tidak memiliki undang-undang yang mengatur secara formal tentang perkawinan online, 3) Menurut hukum Islam, praktik ijab kabul yang dilakukan secara online dapat dianggap sah jika satu majelis dalam prosesi akad nikah hanya menyangkut kesinambungan waktu antara pengucapan ijab kabul.Kata Kunci: Keabsahan Ijab Kabul, Media Sosial, Perspektif Hukum Isla

    Contextual Teaching and Learning Learning Strategy is a learning strategy thatt emphasizes students to be involved directly and actively that is able to connect the knowledge possessed with material in the learning process and can apply it in everyday life. The process of Islamic religious education tends to use lecture and question and answer methods so that it does not make students active in the learning process and lacks understanding of the material and less motivates students in learning Islamic religious education. For that contextual teaching and learning learning strategies really help develop learning motivation etc. student learning outcomes. Researchers carry out research related to the application of contextual teaching and learning learning strategies in Islamic Religious Education. The focus of the research relates to the application of strategy, supporting and inhibiting factors for implementing the strategy, and the impact of implementing the strategy. Researchers used a qualitative approach to the type of descriptive qualitative research. Data collection techniques using observation, interviews, and documentation.
