Equality Before the Law and the Social Contract: When Will the United States Finally Guarantee Its People the Equality Before the Law that the Social Contract Demands?

Most European and several countries elsewhere in the world have recognized a right to counsel in many or most civil cases for as long as decades or even centuries - and many of these countries are willing to spend, proportionately, anywhere from three to twelve times as much of their national income as the U.S. currently does on the provision of counsel to their lower income populations in civil cases. This Article examines how courts around the world have interpreted the constitutional provisions emanating from the theory that underpins the right to equality before the law and why these decisions are relevant to courts in the U.S. The Article then describes how nations that have the right as a matter of statutory or constitutional law have implemented it. This leads to discussion of a draft generic state statute that would apply some of the lessons learned from the foreign experience to the American context. Finally, the Article considers the likelihood that American jurisdictions will adopt the right and make the level of financial commitment that so many other nations already have made

Some measurements of an EBF powered-lift wake

Results from a wind tunnel investigation in which velocity vector measurements were obtained in the near wake of an externally blown flap powered lift configuration were analyzed. These measurements were used to develop spanwise distributions for the momentum strength and location of the engine exhaust stream tube with the results used as input parameters to one jet flap analytical method. It is shown that a comparison of the momentum coefficients obtained from forward speed wake surveys with the predicted values from static force data results in a good correlation, which verifies the use of the flap thrust recovery factor as a means of predicting the momentum strength at the flap trailing edge. Also, when wake survey distributions of momentum strength and direction are used as input parameters to one analytical jet flap method, the results show reasonable agreement between the experimental data and analytical results

[Excerpt] There have been several recent reviews of different subtopics within the general performance appraisal literature. The reader of these reviews will find, however, that the accompanying citations may be of limited utility for one or more reasons. For example, the reference sections of these reviews are usually composed of citations which support a specific theory or practical approach to the evaluation of human performance. Consequently, the citation lists for these reviews are, as they must be, highly selective and do not include works that may have only a peripheral relationship to a given reviewer\u27s target concerns. Another problem is that the citations are out of date. That is, review articles frequently contain many citations that are fifteen or more years old. The generation of new studies and knowledge in this field occurs very rapidly. This creates a need for additional reference information solely devoted to identifying the wealth of new research, ideas, and writing that is changing the field

A New Marine Ascomycete from Australia

Most marine pyrenomycetes are lignicolous, but some are epiphytic on marine phanerogims and algae. Meyers (1957) listed 30 species of algae known to be attacked by these fungi. A number of reports dealing with marine ascomycetes on algal hosts appeared before 1900, the most noteworthy being those of Winter (1887), and Jones (1898). Cotton (1908) described a pyrenomycete on Ascophyllum nodosum (L.) Le Jol. and summarized previous reports of ascomycetes found on algae. Reed (1902) collected two species, and Sutherland, in a series of papers (1914-1916), reported several alga-infesting pyrenomycetes. More recently, a number of ascomycetes occurring on algae have been noted (Feldmann, 1957, 1958; Cribb & Herbert, 1954; Cribb & Cribb, 1955, 1960a, b; Wilson & Knoyle, 1961; Kohlmeyer, 1963). This report describes a heretofore unreported pyrenomycete collected from the marine alga, Ballia callitricha Ag. The material was obtained from Warrnambool, Victoria, in waters off southern Australia
